Can fired employees collect unemployment benefits in Washington state?
I got terminated from my job last week and I'm wondering if I can still file for unemployment benefits through Washington ESD. My manager said it was due to performance issues but I feel like they were looking for reasons to let me go. I've been working there for 2 years and never had any write-ups before this. Does being fired automatically disqualify you from getting UI benefits? I'm really stressed about this because I have rent and bills to pay.

You can definitely still apply for unemployment even if you were fired. Washington ESD looks at whether you were terminated for 'misconduct' - performance issues usually don't count as misconduct unless it was willful or deliberate. You should file your claim right away since there's a waiting period.

•That's a relief to hear. Should I mention that I think they were targeting me or just stick to the facts about performance?

•Just stick to the facts when you file. Washington ESD will investigate and contact your former employer for their side of the story during adjudication.

I was in a similar situation last year. Got fired for allegedly not meeting sales targets but I think my supervisor just didn't like me. Filed for unemployment anyway and got approved after about 3 weeks of adjudication. The key is that performance issues aren't the same as misconduct.

•How long did the whole process take from filing to getting your first payment?
0 coins
Theodore Nelson
•About 4-5 weeks total. The adjudication took the longest part because they had to interview both me and my former employer.

File immediately! I made the mistake of waiting because I thought being fired meant I couldn't get benefits. Turns out I was wrong and I lost 2 weeks of potential payments. Washington ESD will sort out whether you're eligible during the adjudication process.

•Wait, you lose benefits for the weeks you don't file? I thought it was retroactive.

AaliyahAli
•Nope, you can only get benefits for weeks after you file your initial claim. That's why they always say file right away even if you're not sure you qualify.

The whole calling Washington ESD thing is such a nightmare though. I spent hours trying to get through to ask questions about my claim when I got fired. Finally used this service called Claimyr (claimyr.com) that actually got me connected to an agent. They have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me so much frustration.

•How does that work exactly? Do they just call for you or something?

Arjun Kurti
•Yeah they handle the calling and waiting on hold, then connect you when an agent picks up. Was way better than spending my whole day redialing.

Being fired doesn't automatically disqualify you but it depends on the reason. Misconduct includes things like theft, violence, or willfully violating company policy. Poor performance or not being a 'good fit' usually doesn't rise to that level. Washington ESD will make the determination during adjudication.

•They said it was performance but honestly I think they just wanted to hire someone cheaper. Is that something Washington ESD would consider?

•If you were doing your job in good faith and they fired you for business reasons, that would likely make you eligible. The burden is on the employer to prove misconduct.

ugh the whole system is so confusing!! I got fired 3 months ago and STILL haven't figured out if I did everything right with my claim. They keep asking for more documentation and I don't even know what half of it means

Carmella Fromis
•What kind of documentation are they asking for? Usually it's just verification of your last day worked and wage information.

•something about a separation notice and they want me to explain why I was fired but I already told them like 3 times

File your claim online at esd.wa.gov - it's pretty straightforward. When they ask about the reason for separation, just put 'terminated/fired' and explain briefly. Don't overthink it. They'll contact your employer separately to get their version.

•Do I need to have all my pay stubs and stuff ready when I file?

Evelyn Kim
•Not necessarily for the initial filing, but have your last few pay stubs handy in case they ask for wage verification later.

I thought if you got fired you were screwed but apparently not? My friend got fired for being late too many times and still got unemployment. Seems like they're pretty lenient about what counts as misconduct.

•Chronic tardiness can be misconduct if it's willful and the employee was warned repeatedly. But each case is different and Washington ESD looks at all the circumstances.

Ellie Simpson
•Yeah she had gotten written warnings but I guess they still approved her claim. Maybe it depends on the job or something.

The thing that sucks is even if you get approved, there's usually a delay while they investigate. I was out of work for 6 weeks before my first payment hit. Make sure you keep filing your weekly claims even during adjudication or you'll lose those weeks.

Ryder Greene
•So I should file weekly claims even if my initial claim is still being reviewed?
0 coins
Diego Fisher
•Yes! Keep filing every week. If you're approved they'll pay you retroactively for those weeks, but only if you filed the weekly claims.

Just went through this exact situation 2 months ago. Got fired for 'not being a team player' which was total BS. Filed anyway and got approved. The adjudication interview was actually pretty fair - they asked me to explain my side and I was honest about the situation.

Ryder Greene
•Did they ask you a lot of detailed questions during the interview?

Henrietta Beasley
•Just basic stuff - what happened, whether I had any warnings, if I understood company policies. Took maybe 15 minutes.

whatever you do don't lie on your application!! They WILL find out and then you'll be in way worse trouble. Better to be honest about being fired and let them sort it out than try to hide it

Ryder Greene
•I wasn't planning to lie but I was wondering how detailed I need to be about the circumstances.

Lincoln Ramiro
•Just give the basic facts. They'll ask for more details if they need them during the investigation.

Also make sure you're doing your job search requirements while waiting. Even during adjudication you need to be looking for work and logging it. I almost got dinged for not keeping up with that part.

•How many jobs do you have to apply for each week?
0 coins
AaliyahAli
•I think it's 3 job search activities per week but check the requirements when you file. It can include applications, networking, training, etc.

The worst part about getting fired is trying to reach Washington ESD when you have questions. Their phone lines are always busy and the hold times are insane. I finally found this thing called Claimyr that basically waits on hold for you and connects you when an agent answers. Total game changer.

Ryder Greene
•Is that expensive? I'm already worried about money.

•It's worth it to actually talk to someone instead of spending all day trying to get through. Check out their website at claimyr.com - they explain how it works.

Been there done that. Got canned from my retail job for supposedly having a bad attitude. Filed for UI and got approved after they investigated. The key thing is Washington ESD looks at whether you were trying to do your job or if you were deliberately causing problems.
0 coins
Ryder Greene
•That gives me hope. I was definitely trying to do my job well, they just had unrealistic expectations.
0 coins
Emma Johnson
•Exactly. Unrealistic expectations from management doesn't equal misconduct on your part. You should be fine.

File now, worry later. Seriously. Even if there's a chance you might not qualify, file anyway. Worst case they deny you and you're no worse off than you are now. Best case you get benefits while you look for a new job.

Ryder Greene
•Good point. I guess I have nothing to lose by trying.

Liam Brown
•Exactly! And if they do deny you initially, you can always appeal the decision if you think it's wrong.

I'm so sick of employers thinking they can fire people for bogus reasons and that we just have to take it. At least unemployment benefits give us some protection while we find something better.

Raúl Mora
•That's exactly what the unemployment system is for - to provide a safety net when people lose jobs through no fault of their own.

Olivia Garcia
•Right! It's not charity, we pay into this system with every paycheck.

Quick tip - when you file online, make sure you have your Social Security number, driver's license, and information about your last employer ready. Makes the process go faster.

Ryder Greene
•Do I need my former employer's contact info or just the company name?
0 coins
Noah Lee
•Company name and address should be enough. Washington ESD can look up the rest from their records.

Another success story here - got fired from a warehouse job for 'safety violations' that were really just accidents. Still got my unemployment benefits approved. Don't let them scare you into not filing!

Ryder Greene
•How long ago was this? I'm wondering if they've gotten stricter about approvals.

•This was about 6 months ago. I don't think the standards have changed much.

honestly trying to reach someone at Washington ESD is harder than finding a new job sometimes lol. I used that Claimyr service someone mentioned earlier and it actually worked. Saved me hours of redialing busy signals.

Ryder Greene
•I'll definitely look into that if I have trouble getting through. Thanks for the recommendation.

•Yeah no problem. The demo video they have shows exactly how it works - pretty clever system honestly.

Bottom line - being fired doesn't automatically disqualify you from unemployment benefits in Washington. File your claim, be honest about what happened, and let Washington ESD make the determination. You've got a good chance of being approved if it was truly about performance and not misconduct.

•Thanks everyone for all the advice and encouragement. I'm going to file my claim today.

•Good luck! Remember to keep filing your weekly claims even during the investigation period.

I went through something very similar about 8 months ago. Got let go for "not meeting expectations" but I suspect they just wanted to restructure my position. Filed for unemployment immediately and was approved after about 3 weeks of adjudication. The investigator was actually really fair during the phone interview - they asked both me and my employer detailed questions about the circumstances. My advice: file right away, keep detailed notes about what happened at your job, and don't stress too much about the outcome. Washington ESD really does look at each case individually and performance issues rarely count as disqualifying misconduct unless there was willful negligence involved.
