Got fired can I collect Washington ESD unemployment benefits?

So I just got terminated from my job yesterday and I'm trying to figure out if I can even apply for unemployment through Washington ESD. My manager said it was due to performance issues but honestly I think they were just looking for a reason to let me go. I've been working there for almost 2 years and never had any write-ups until last month when they suddenly started documenting everything. Can I still file for UI benefits or does getting fired automatically disqualify me? I'm really stressed about paying rent next month.

You can definitely still apply! Getting fired doesn't automatically disqualify you from Washington ESD benefits. The key question is whether you were terminated for 'misconduct' which has a very specific legal definition. Performance issues usually don't count as misconduct unless you were willfully negligent or violated clear company policies.

That's a relief to hear. They never said I violated any policies, just that my performance wasn't meeting expectations. Should I apply right away?

0 coins

Yes, apply as soon as possible. There's a waiting period anyway, and you want to get the process started. You can apply online at esd.wa.gov.

I was in the exact same situation last year. Got 'fired' for performance but it was really just corporate downsizing in disguise. Washington ESD approved my claim after about 3 weeks of adjudication. The employer will get a chance to dispute it but unless they can prove actual misconduct you should be fine.

How long did the whole process take for you to start getting payments?

About a month total. The hardest part was actually getting through to someone at Washington ESD when I had questions about my claim status.

Just went through this exact situation myself. The adjudication process can be nerve-wracking but if you were genuinely trying to do your job and weren't fired for things like theft, harassment, or repeatedly violating clear policies, you'll likely qualify. I struggled for weeks trying to call Washington ESD to check on my claim status until I found this service called Claimyr (claimyr.com) that actually got me through to a real person. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

Never heard of Claimyr before but I'll definitely check it out if I can't get through the normal way. Did they charge you a lot?

They focus on the value of actually reaching someone rather than the cost. Worth it when you're stressed about your claim and can't get answers any other way.

Interesting, I've been trying to call Washington ESD for days about my own claim. Might have to look into this Claimyr thing too.

File immediately and don't let them intimidate you. Employers often try to scare people into not filing by making the termination sound worse than it was. Washington ESD will do their own investigation during adjudication and make the final determination.

You're right, they did seem to be emphasizing the 'performance issues' pretty heavily when they let me go.

Classic employer tactic. They know most people don't understand the difference between poor performance and actual misconduct.

ugh this whole system is so confusing. i got fired 3 months ago and still don't know if i did everything right with my claim. the washington esd website is like a maze

What's your current claim status showing? You should be able to check on your SecureAccess Washington account.

0 coins

it just says 'claim under review' or something like that. been saying the same thing for weeks

Make sure you keep all your termination paperwork and any emails leading up to it. Washington ESD might ask for documentation during the adjudication process. Also start looking for work immediately because you'll need to show job search efforts.

Good point about the paperwork. I have the termination letter and some emails about the performance meetings.

Perfect, keep all of that. Also remember you need to document your job search activities in WorkSourceWA once you start filing weekly claims.

Been there! The waiting is the worst part. But honestly unless you were caught stealing or something really bad, getting fired for performance usually doesn't disqualify you from UI benefits. Just be honest on your application about what happened.

0 coins

Thanks, that makes me feel better. I was definitely not stealing or anything like that, just struggling to meet some unrealistic targets they set.

Whatever you do, DON'T let your former employer know you're filing for unemployment if you can avoid it. They'll probably contest it just to be difficult. Let Washington ESD handle the communication with them.

0 coins

Too late for that, I think they probably already know since I had to list them on the application.

0 coins

That's fine, Washington ESD contacts them automatically anyway. Just don't volunteer any extra information to your old boss.

Had a friend who got fired for 'performance' and it turned out the company was just trying to avoid paying for a layoff. She got her unemployment approved and the company got in trouble for misrepresenting the termination. Don't assume you're automatically disqualified!

0 coins

Wow, that's exactly what I suspect happened to me. They've been cutting costs everywhere lately.

The adjudication process can take forever though. I waited 6 weeks just to hear back about my eligibility. If you need to talk to someone at Washington ESD about your claim, that Claimyr service someone mentioned earlier actually works. I used it last month when I couldn't get through their phone lines.

How long did it take Claimyr to get you connected to Washington ESD?

0 coins

Way faster than trying to call myself. Actually got to speak with a real person instead of getting hung up on after waiting an hour.

Remember that even if your employer contests your claim, you can appeal their decision. Don't give up if the initial determination goes against you. The appeals process gives you a chance to present your side of the story.

0 coins

Good to know there's an appeal option. Hopefully it won't come to that but it's reassuring.

honestly the whole washington esd system is a joke. took me 3 months to get my first payment after getting laid off. good luck dealing with their bureaucracy

That's frustrating but layoffs are usually processed faster than terminations since there's no misconduct question involved.

Just file ASAP and don't overthink it. The worst they can say is no, but if you were genuinely trying to do your job and got fired for performance reasons, you'll probably qualify. Washington ESD sees this situation all the time.

0 coins

You're right, I need to stop worrying and just submit the application. Thanks everyone for the advice!

One more thing - make sure you understand the difference between being 'fired' and being 'terminated for cause.' If they didn't use the words 'for cause' or 'misconduct' in your termination, that's usually a good sign for your unemployment claim.

0 coins

They just said 'terminated due to performance issues' so I think I'm okay based on what everyone has said here.

I've helped several people through this process and performance-related terminations usually get approved as long as you weren't willfully negligent. The key is being honest about what happened and providing any documentation you have. If you run into issues getting through to Washington ESD, that Claimyr service really does work - I've recommended it to others who were stuck trying to reach someone about their claims.

Thank you so much for all this information. I feel a lot more confident about filing now.

You're welcome! Remember to file your weekly claims on time once you get approved, and keep track of your job search activities. You've got this!
