If you are fired are you eligible for unemployment in Washington - need help understanding my situation
So I got terminated from my job last Friday and I'm trying to figure out if I can even apply for unemployment benefits through Washington ESD. My manager said it was due to 'performance issues' but honestly I think they just wanted to get rid of me because I complained about safety violations. I've been working there for 2 years and never had any write-ups or formal warnings. Can you still get UI benefits if you're fired? I'm really stressed about this because I have rent due next week and don't know where to start with the Washington ESD system.

Yes, you can definitely be eligible for unemployment benefits even if you were fired! The key thing Washington ESD looks at is whether you were terminated for 'misconduct.' Performance issues usually don't count as misconduct unless they involve willful violations of company policy. Since you mentioned no prior warnings, that's actually good for your case.

•That's a relief to hear! What exactly counts as misconduct then? I'm worried they might try to claim something.

•Misconduct has to be willful and substantial. Things like theft, violence, or deliberately violating clear policies. Poor performance or not meeting expectations generally isn't misconduct.

You should file your claim ASAP through the Washington ESD website. Don't wait! Even if there's an issue, you want to get your claim date established. The employer has to prove misconduct if they want to contest it, and from what you described, performance issues without warnings usually won't qualify as misconduct.

•I'll start the application today then. How long does it usually take to hear back from Washington ESD?

•It varies but usually 2-3 weeks if there are no issues. If your employer contests it, it could go to adjudication which takes longer.

I had a similar situation last year where I got fired for 'attitude problems' but it was really because I wouldn't work unpaid overtime. I was so scared I wouldn't get benefits but Washington ESD approved my claim after like 3 weeks. The employer tried to fight it but they couldn't prove actual misconduct. Definitely apply right away!

•That gives me hope! Did you have to do anything special during the process or just wait it out?

•I had to do a phone interview with an adjudicator and explain my side. Just be honest about what happened and stick to the facts.

If you're having trouble getting through to Washington ESD to check on your claim status or ask questions, I found this service called Claimyr that helped me actually reach a real person. They basically call for you and get you connected to an agent. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me hours of trying to call.

•Interesting, I've never heard of that. Is it legit? I'm always skeptical of third-party services.

•Yeah it's totally legitimate. Check out their site at claimyr.com. They don't ask for your personal info or anything, just help you get through the phone system.

•I used Claimyr too when my claim got stuck in adjudication. Worked great and finally got to talk to someone at Washington ESD who cleared everything up.

The system is such a joke though. Why should people have to jump through all these hoops just to get benefits they paid into? If you got fired for BS reasons you should automatically get UI without all this misconduct investigation nonsense.

•I get the frustration but the misconduct rules exist to prevent abuse. Most legitimate terminations do result in approved claims.

•Maybe but Washington ESD makes it way harder than it needs to be. The whole system needs an overhaul.

Just to add - when you file your claim, be completely honest about being terminated. Don't try to make it sound like you quit or anything. Washington ESD will find out anyway when they contact your employer, and lying can disqualify you entirely.

•Good point, I'll make sure to be totally straightforward about what happened.

omg same thing happened to my friend except she got fired for being late too many times but they never gave her any formal warnings either. she got her unemployment approved after like a month of waiting. definitely apply!

•That's encouraging to hear! Seems like Washington ESD is pretty fair about these situations.

•They usually are if there's no clear misconduct. The key is having documentation or lack thereof - no warnings usually helps your case.

One more thing - make sure you understand the difference between being fired 'for cause' vs. just being terminated. For cause means misconduct. Regular termination (layoffs, performance, downsizing) usually qualifies for benefits. Your situation sounds like the latter.

Javier Torres
•They didn't use the phrase 'for cause' when they terminated me, just said performance. So that's probably good?

Emma Wilson
•Yes, that's actually a good sign. 'For cause' terminations are the ones that typically disqualify you from UI benefits.

I got fired from my last job too and was worried about the same thing. Turns out most people who get fired still qualify for unemployment unless it's something really bad like stealing or fighting. Washington ESD approved mine in about 2 weeks.

•Thanks for sharing that! It's making me feel a lot less anxious about applying.

Quick question - do you have to wait a certain amount of time after being fired to apply for unemployment? Or can you do it immediately?

QuantumLeap
•You can and should apply immediately! There's no waiting period for filing the claim. The sooner you file, the sooner your benefit year starts.

Emma Wilson
•Exactly, don't wait. Even if there are issues to resolve, you want to get your claim date established as early as possible.

I remember when I got terminated they made it sound like I wouldn't be eligible for anything. Scared me into not applying for like 2 months. Huge mistake! Turns out I was totally eligible and just lost out on those benefits. Don't make the same error I did.

Javier Torres
•Wow, that's awful! I'm definitely not going to wait around. Filing today for sure.

•Smart move. Employers sometimes say things to discourage you from filing even when you're eligible. Don't let them intimidate you.

Another tip - keep any documentation from when you were fired. Email notifications, termination letters, anything that explains their reasoning. It can help if Washington ESD needs to investigate.

•Good thinking! I do have the termination email that mentions performance issues. I'll save that.

The whole misconduct thing is really specific. Like my coworker got fired for attendance but since our company policy said 3 tardies = warning, 6 = final warning, 9 = termination, and they fired him after 7 without the final warning, he still got approved for UI.

•That's really detailed! Sounds like Washington ESD really looks at whether proper procedures were followed.

Emma Wilson
•Exactly right. If the employer doesn't follow their own disciplinary procedures, it's harder for them to prove misconduct.

just apply dont overthink it. worst case they say no and you appeal. i got fired for stupid reasons too and got my benefits no problem

When I was having issues with my unemployment claim getting stuck, someone recommended Claimyr to me and it was a lifesaver. Got me connected to a Washington ESD agent who walked me through exactly what was happening with my claim. Way better than sitting on hold for hours.

•I might need that if my claim runs into problems. Good to know there are options for actually reaching someone.

•Yeah definitely keep it in mind. The regular Washington ESD phone lines are basically impossible to get through on your own.

Performance issues without prior warnings is actually a pretty strong case for getting approved. I work in HR and see this stuff all the time. Washington ESD usually sides with the employee unless there's clear misconduct.

•That's really reassuring coming from someone who works in HR! I feel much better about my chances now.

•You should feel good about it. Your situation is pretty textbook for an approved claim based on what you've described.

Make sure when you do your weekly claims you're honest about job search activities too. Washington ESD requires proof you're looking for work to keep getting benefits.

•Good reminder! I should start keeping track of my job applications and interviews.

•Yes, you need to log at least 3 job search activities per week in most cases. Keep detailed records.

Ugh I hate how stressful this whole process is. Getting fired is bad enough without having to worry about whether you'll be able to pay rent. Hang in there OP, sounds like you have a good case!

Last thing - if your employer does contest your claim and it goes to adjudication, don't panic. That's totally normal and doesn't mean you won't get approved. Just means Washington ESD needs to investigate both sides before making a decision.

Javier Torres
•Good to know! I was wondering what would happen if they tried to fight it.

•Right, adjudication isn't a bad thing, it's just part of the process when there's a dispute. Be prepared to explain your side clearly.

You got this! File that claim today and don't let them scare you. Most people who get fired for performance stuff get approved for unemployment. The system isn't perfect but it generally works for legitimate cases like yours.
