Can you collect unemployment after being fired in Washington state?
I got terminated from my job last week and I'm not sure if I can even apply for unemployment benefits. My manager said it was due to 'performance issues' but I feel like they were just looking for a reason to let me go. I've been working there for 2 years and never had any formal write-ups or warnings. Can you still get Washington ESD benefits if you were fired? I'm really stressed about this because I need to start looking for work but also need some income while I search.

Yes, you can absolutely collect unemployment benefits after being fired in Washington state. The key is whether you were fired for 'misconduct' or not. Performance issues generally don't qualify as misconduct unless it was willful or repeated violations after warnings. Since you mentioned no formal write-ups, you should definitely apply through the Washington ESD website.

•That's a relief to hear. Should I mention the performance issues when I file or just say I was terminated?

•Be honest about the termination reason when you file. Washington ESD will investigate and contact your employer anyway, so it's better to be upfront from the start.

I went through this exact same situation last year. Got fired for 'not meeting expectations' but was able to collect benefits no problem. The adjudication process took about 3 weeks but I eventually got approved retroactively.

•Did your employer try to fight it or contest the claim?

Dmitry Petrov
•They did contest it initially, but Washington ESD ruled in my favor because they couldn't prove it was misconduct. Just poor performance isn't enough to disqualify you.

The Washington ESD phone lines are absolutely impossible to get through to right now. I've been trying for weeks to get answers about my claim status. If you need to talk to someone quickly, I found this service called Claimyr that actually gets you through to an agent. Check out claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Never heard of that service before. Does it actually work or is it just another scam?

•It's legit - I used it when my claim was stuck in adjudication. Way better than sitting on hold for hours just to get disconnected.

Be prepared for your employer to lie about the termination reasons. They'll probably claim it was misconduct to avoid their unemployment insurance rates going up. Document everything you can remember about your time there.

•I have all my performance reviews saved and they were actually pretty positive. Should I submit those with my application?

•Yes, definitely keep those handy. You might not need them initially but if there's a hearing or appeal, that documentation will be crucial.

Wait, so you can get unemployment even if fired?? I thought only people who got laid off could collect benefits. This is news to me.

•Common misconception! You can collect if fired for most reasons except misconduct. Things like poor performance, not being a good fit, or company restructuring all qualify you for benefits.

•Wow, I wish I had known this when I got fired 6 months ago. Is it too late to apply now?

•Unfortunately yes, you typically need to apply within a few weeks of job loss. But you can always check with Washington ESD to see if there are any exceptions.

The whole system is rigged against workers anyway. Even if you qualify, they'll find some reason to deny your claim or make you jump through hoops for months.

•That's not very encouraging... Are you speaking from personal experience?

•Yeah, I've been fighting with Washington ESD for 2 months over a simple claim. They lost my paperwork twice and keep asking for the same documents over and over.

Just file online at secure.esd.wa.gov and don't overthink it. The worst they can do is say no, but based on what you described, you should be fine.

•Good point. I'll file tonight and see what happens. Thanks for the encouragement.

Make sure you file ASAP because there's a waiting period before benefits start. Also, you'll need to start doing your job search activities right away even while your claim is processing.

•How many job search activities do I need to do per week in Washington?

QuantumQuasar
•It's 3 job search activities per week. You can use WorkSourceWA.com to track them, or keep your own log. Just make sure you have documentation.

I got fired for being late too many times and still got benefits. As long as it wasn't criminal misconduct or something really serious, you're probably good to go.

•How long did it take for your claim to get approved?

Keisha Jackson
•About 2 weeks for the initial approval, then another week for the first payment. Not too bad overall.

The adjudication process can be nerve-wracking but don't panic if your claim goes into review. It's pretty standard when there's a termination involved.

•What exactly happens during adjudication? Do they interview you and your employer?

•They'll usually call or email both parties to get the full story. Just be honest and stick to the facts. They're pretty good at sorting out who's telling the truth.

Pro tip: If you can't get through to Washington ESD on the phone, try calling right when they open at 8am or during lunch hours. Sometimes the hold times are shorter then.

•I've tried that and still can't get through. The Claimyr service mentioned earlier actually worked for me when I was desperate to talk to someone.

•Interesting, might have to try that if I need to call them again. The regular phone system is just broken.

Don't let your employer intimidate you into not filing. I've seen too many people get scared off by threats or misinformation from their former boss.

•My manager did say something about me not being eligible, but I think they were just trying to discourage me from applying.

Natasha Romanova
•Exactly. They don't want their unemployment insurance rates to go up, so they'll say anything to keep you from filing. Let Washington ESD make the determination, not your former employer.

Remember that even if you get denied initially, you can appeal the decision. The appeals process gives you another chance to present your case.

•How long do you have to file an appeal if you get denied?

NebulaNinja
•I think it's 30 days from the date of the denial notice. Don't quote me on that though - check the paperwork they send you.

File your weekly claims even while your initial claim is being processed. If you get approved, you'll get paid retroactively for those weeks.

The Washington ESD website has a lot of good information about what qualifies as misconduct vs. just being fired. Worth reading through before you apply.

•I'll definitely check that out. Want to make sure I understand the process before I start.

One thing to keep in mind - if you had any kind of severance package or final paycheck, that might affect when your benefits start. Make sure to report all income accurately.

Dylan Mitchell
•I did get paid for my unused vacation days. Should I report that when I file?
0 coins
Malik Thomas
•Yes, report any separation pay or vacation payout. They'll calculate how it affects your benefit start date.

Bottom line - you have nothing to lose by applying. The worst case scenario is they say no, but based on what you've described, you should qualify for benefits.

Just wanted to add that I used Claimyr when I was having trouble reaching Washington ESD about my overpayment issue. It's worth the cost when you're desperate to talk to someone and can't get through the regular phone lines.

•Good to know there are options if I run into phone issues. Hopefully I won't need it but it's reassuring to know it exists.

Make sure you keep detailed records of your job search activities from day one. Washington ESD can audit your claim at any time and ask for documentation.

Dylan Mitchell
•What kind of documentation do they want? Just a list of where I applied?

Freya Larsen
•Company names, dates, contact info, and what type of activity it was (online application, networking, etc.). The more detailed the better.

Don't stress too much about the process. Most people who file get approved eventually, especially if they were fired for performance rather than misconduct.

•That's reassuring. I was really worried I wouldn't qualify at all. Thanks for the perspective.

Dylan, I went through almost the exact same situation about 8 months ago - fired for "performance issues" with no prior warnings or write-ups. I was terrified I wouldn't qualify but ended up getting approved after about 3 weeks of adjudication. The key thing Washington ESD looks for is whether it was misconduct (willful wrongdoing) versus just not meeting expectations. From what you described, it sounds like you have a solid case. File as soon as possible and be completely honest about the termination reason - they'll find out anyway when they contact your employer. Also, start your job search activities right away even while waiting for approval, because you'll need to report 3 per week once benefits kick in. Don't let your former employer discourage you from filing - that's between you and ESD to determine, not them. Good luck!

•Thanks Mason, that's incredibly helpful to hear from someone who went through the same thing! It's such a relief to know that others have been approved in similar situations. I was really doubting myself and wondering if I should even bother applying. Your advice about being honest upfront makes total sense - better to be transparent from the start than have it come out later. I'm definitely going to file tonight and start documenting my job search activities immediately. Really appreciate you sharing your experience and the encouragement!
