Can you still collect Washington ESD unemployment if you get fired?
I got terminated from my job last week and I'm not sure if I can file for unemployment benefits. My manager said it was due to performance issues but I feel like they were just looking for a reason to let me go. I've been working for 2 years and never had any write-ups before this. Does Washington ESD approve unemployment claims when you get fired? I really need the income while I look for another job.

Yes, you can definitely collect unemployment if you were fired, but it depends on the reason. Washington ESD will approve your claim unless you were terminated for misconduct. Performance issues usually don't count as misconduct unless it was willful or deliberate poor performance.

•That's good to hear. They said it was performance but I was doing my best, just struggling with the workload they kept adding.

•Performance issues are different from misconduct. You should be fine to collect benefits.

I went through this exact situation last year. Got fired for 'performance' but it was really just a toxic workplace. Filed my claim right away and Washington ESD approved it without any issues. The key is being honest on your application about why you were terminated.

•How long did it take for your claim to get approved? I'm worried about paying rent next month.

•Mine took about 3 weeks total. File as soon as possible though, benefits start from when you file, not when you lost your job.

Be prepared for your employer to contest your claim though. When I got fired they tried to fight it by saying I was terminated for cause. Had to go through an adjudication process where Washington ESD investigated both sides of the story.

•What happens during adjudication? That sounds scary.

•It's not too bad. Washington ESD will call you and your employer separately to get both sides. Just be honest about what happened and you'll be fine.

•If you need to reach Washington ESD during adjudication, I found Claimyr really helpful for getting through to an actual agent. Their website is claimyr.com and they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

DONT WAIT TO FILE! I made that mistake thinking I needed to 'figure things out' first. You can file online right now at esd.wa.gov. The sooner you file, the sooner your benefits start.

•I'll file today then. Thank you for the push I needed!

•This is so important. I see people wait weeks thinking they need documents first.

Make sure you have your work history ready when you file. You'll need employment dates, wages, and reason for separation for all jobs in the last 18 months.

•I only had one job in the last 18 months. Do I still need all that info?

•Yes, even for one job. Have your start date, end date, gross wages, and be ready to explain why you were terminated.

been there done that. got fired from retail job for being 'slow' but really they just hired too many people for the holidays and needed to cut staff. filed unemployment and got approved no problem

•That sounds similar to my situation. They kept adding responsibilities without training.

•Employers do this all the time unfortunately. At least unemployment is there for situations like this.

Important distinction: There's a difference between being fired for misconduct vs being fired for other reasons. Misconduct means you deliberately violated company policy or broke rules. Poor performance usually isn't misconduct unless you were intentionally doing bad work.

•I definitely wasn't intentionally doing bad work. I was trying my hardest but they kept changing my responsibilities.

•That sounds like a legitimate unemployment claim to me. Document everything you remember about the termination.

•Yes! Keep any emails, write down dates and times of conversations. Could be helpful if your employer contests.

I'm dealing with this right now too. Got fired three weeks ago and my claim is still in adjudication because my old employer is fighting it. The waiting is killing me financially.

•Oh no, how do you survive during adjudication? Do you get any money?

Mateo Gonzalez
•You don't get paid until it's resolved. I've been doing gig work just to eat. Really stressful.

•Have you tried calling Washington ESD to check on your adjudication status? I used Claimyr when I needed to get through quickly - saved me hours of calling.

File ASAP but also start job searching immediately. You have to do job search activities every week to keep getting benefits. Keep a log of everywhere you apply.

Freya Christensen
•How many jobs do you have to apply to each week?

Aisha Ali
•It's 3 job search activities per week in Washington. Can be applications, networking, interviews, etc.

Word of advice - when you file your claim, stick to the facts about why you were terminated. Don't get emotional or try to justify everything. Just state what happened objectively.

Freya Christensen
•That's good advice. I was planning to write a whole story about how unfair it was.

•Save that for if you need to appeal or go to a hearing. For the initial claim, just the basic facts.

my friend got fired and unemployment approved her claim but then her employer appealed it and she had to go to a hearing. she won but it took months to get her money

•A hearing sounds terrifying. Was it like going to court?

•nah its done over the phone usually. just you, your employer, and a judge asking questions

The unemployment system is so broken. You get fired through no fault of your own and then have to jump through hoops to get benefits you paid into. Makes me sick.

•I feel you but at least the benefits exist. Better than nothing when you lose your job.

•True, I'm grateful for unemployment insurance. Just wish the process wasn't so stressful.

Check your employee handbook if you still have it. Sometimes it will spell out what constitutes misconduct vs performance issues. Could help your case if your employer tries to contest.

•You might be able to find company policies online or ask former coworkers if they have a copy.

Been unemployed twice in the last 5 years, both times I got fired and both times I collected benefits. As long as you weren't stealing or doing something obviously wrong, you should be approved.

Freya Christensen
•That's reassuring. I definitely wasn't doing anything wrong, just couldn't keep up with their expectations.

•Sounds like you have a solid case. File that claim today!

One more thing - if your claim gets denied initially, don't give up! You can appeal the decision. I've seen plenty of people win on appeal even after being denied the first time.

Freya Christensen
•How long do you have to file an appeal?
0 coins
Jamal Thompson
•30 days from the date on the denial letter. Don't wait though, file as soon as you get it.

•And if you need help navigating the appeal process, Claimyr can help you get through to Washington ESD agents who can explain your options.

Just wanted to add that you should keep filing your weekly claims even if your initial claim is being investigated. If you're approved later, you'll get back pay for those weeks.

Freya Christensen
•Even if I'm not getting paid yet? That seems weird.

CosmicCadet
•Yes! It keeps your claim active. If you stop filing weekly claims, you could lose benefits for those weeks even if you win.
