Washington ESD unemployment if company fires you - am I eligible?
Just got fired from my job yesterday and I'm wondering if I can still file for unemployment benefits with Washington ESD. My manager said it was due to 'performance issues' but honestly I think they just wanted to get rid of me because I complained about safety violations. I've been working there for 2 years and never had any written warnings or anything. Can I still get UI benefits even though I was terminated? I'm really stressed about this and need to know if I should even bother applying.

Yes, you can absolutely file for unemployment if you were fired! Washington ESD doesn't automatically disqualify you just because you were terminated. The key is whether you were fired for 'misconduct' or not. Performance issues usually don't count as misconduct unless it was willful neglect of duties.

•That's a relief to hear. So even if they say it was performance related, I should still apply?

•Definitely apply. Let Washington ESD make the determination. The worst they can say is no, but you might be surprised.

I got fired last year and still got my benefits. The company tried to fight it but Washington ESD ruled in my favor. You should definitely file your claim as soon as possible.

•How long did it take for them to make a decision? I'm worried about the waiting period.

•Mine took about 3 weeks because they had to do an adjudication. But I got all my back pay once it was approved.

File immediately! I tried calling Washington ESD for weeks to ask about my eligibility after being fired and could never get through. Finally used claimyr.com and got connected to an agent in like 10 minutes. They explained the whole process and I was able to file that same day. There's even a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•I've never heard of that service before. Is it legit?

•I used Claimyr too when I couldn't reach anyone at Washington ESD. Really helpful for getting answers quickly.

The fact that you mentioned safety violations is important. If you were fired for raising legitimate safety concerns, that could actually work in your favor. Washington has whistleblower protections that might apply to your unemployment case.

•I didn't know that could help with unemployment benefits. Should I mention that when I file?

•Absolutely mention it. Document everything you can remember about the safety issues and when you reported them.

DONT LET THEM SCARE YOU! Companies try to intimidate people into not filing for unemployment all the time. I was 'fired for cause' and still got my benefits because Washington ESD determined it wasn't misconduct.

•That makes me feel better. I was worried they'd automatically deny me since I was terminated.

•Same thing happened to me. Filed anyway and got approved. Companies lie about stuff all the time.

Just to clarify the process - when you file, Washington ESD will contact both you and your former employer to get both sides of the story. They'll look at whether your actions constituted 'misconduct' under their definition. Poor performance usually doesn't qualify as misconduct unless it was deliberate.

•How do they determine if it was deliberate or not?

•They look at things like whether you received proper training, had the tools needed to do your job, received warnings, and whether you were trying to improve. Sounds like you have a good case.

One thing to remember - even if your employer contests your claim, you'll still get benefits while the adjudication is pending. Just make sure to keep filing your weekly claims.

•That's good to know. I was worried I wouldn't get anything while they were deciding.

•Yeah, you get paid while it's being reviewed. If they deny you later, then you might have to pay it back, but most of the time they approve these cases.

My brother got fired for being late too many times and still got unemployment. The company didn't even bother to contest it. I think most employers don't want to deal with the hassle.

•That's encouraging. Maybe my employer won't fight it either.

•A lot of companies just accept it unless it was really serious misconduct like theft or violence.

Make sure you gather any documentation you have - emails about the safety issues, your employment records, anything that shows you were trying to do your job properly. This will help if there's an adjudication.

•I saved some emails about the safety concerns. Should I include those when I file?

•Keep them ready in case Washington ESD asks for more information during the review process.

Don't overthink it. Just file the claim. The worst case scenario is they say no and you're in the same position you're in now. But there's a good chance they'll approve it.

If you need to talk to someone at Washington ESD about your specific situation, seriously consider using Claimyr. I spent weeks trying to get through on my own and it was so frustrating. Worth every penny to actually get answers.

i was wondering the same thing when i got fired. turns out most people who get fired can still get unemployment unless they did something really bad

•That's reassuring to hear from someone who went through it.

The key distinction is between being fired for 'misconduct' versus being fired for other reasons. Misconduct typically involves things like theft, violence, willful violation of company policy, or gross negligence. Poor performance or personality conflicts usually don't qualify.

•That makes sense. I definitely didn't do anything that would count as misconduct.

•Right, and even if they claim it was misconduct, you can appeal if Washington ESD denies your claim.

File as soon as possible! There's no waiting period for applying, and the sooner you file, the sooner you can start receiving benefits if approved.

Just remember you'll need to be actively looking for work and report your job search activities. But yes, being fired doesn't automatically disqualify you from unemployment benefits.

•Good reminder about the job search requirements. I should start looking right away.

•Yeah, you'll need to log your job search activities in WorkSourceWA. It's part of the requirements to keep getting benefits.

My advice is file first, ask questions later. The application process will walk you through everything you need to know.

One more thing - if you do get approved and your employer contests it later, don't panic. The adjudication process is pretty fair and they really look at the facts. I had my employer contest my claim and Washington ESD still ruled in my favor after reviewing everything.

•Yeah, they have to prove misconduct, not just that they fired you. Big difference.
