Can you file for unemployment after being fired Washington ESD
Got terminated from my job last Friday and I'm wondering if I can still apply for unemployment benefits through Washington ESD? My supervisor said it was due to 'performance issues' but honestly I think they just wanted to cut costs. I've been working there for almost 2 years and never had any formal write-ups or warnings. Has anyone successfully gotten unemployment after being fired? I'm really stressed about this whole situation and need to know if it's even worth applying.

Yes, you can definitely file for unemployment even if you were fired! Washington ESD will investigate the circumstances around your termination. If you weren't fired for 'misconduct' (like theft, violence, or willful violation of company policy), you should be eligible. Performance issues usually don't count as misconduct unless you were deliberately not doing your job.

•Thank you! That's such a relief to hear. I was definitely trying my best at work, just maybe not meeting their unrealistic expectations.

•What exactly counts as misconduct though? I'm in a similar situation and my boss is claiming I was 'insubordinate' but I was just asking questions about the new procedures.

File your claim ASAP! Don't wait. The sooner you apply through Washington ESD, the sooner your claim can be processed. Even if your employer contests it, you'll likely get benefits while the adjudication process is happening. Make sure you have all your employment details ready - dates, wages, reason for separation.

•Should I mention that I think they fired me to avoid paying severance? Or just stick to what they officially said?

•Just be honest about what happened. If you have documentation or emails that support your side of the story, keep those handy in case Washington ESD needs them during the investigation.

I was in the exact same boat last year - fired for 'performance' but really they were just downsizing. Got approved for benefits after about 3 weeks. The key is Washington ESD looks at whether you were fired for something you did wrong on purpose vs. just not being good enough at the job. Sounds like you should be fine.

•That's encouraging! Did your employer fight it or did they just let it go?

•They contested it initially but Washington ESD sided with me after reviewing everything. I think they do that automatically sometimes to try to save money on their unemployment insurance rates.

Had a nightmare trying to get through to Washington ESD when I needed to clarify some stuff about my firing. Spent hours on hold just to get disconnected. Finally found this service called Claimyr (claimyr.com) that got me connected to an actual person in like 10 minutes. They have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me so much frustration!

•Is that legit? Sounds too good to be true with how impossible it is to reach anyone at Washington ESD these days.

•Totally legit! I was skeptical too but it actually worked. Way better than sitting on hold for hours just to get hung up on.

the whole system is rigged against workers anyway, they'll probably deny you just like they denied me even though I got fired for BS reasons too. companies just lie and say it was misconduct when it wasnt

Ethan Anderson
•That's not necessarily true. Washington ESD investigates each case individually and they're pretty fair about it. If you were wrongly denied, you can always appeal the decision.

•appealing takes forever though and meanwhile youre broke and cant pay rent

•I know it's frustrating but don't give up before you even try. The system isn't perfect but it does work for a lot of people who were wrongfully terminated.

Wait so if I got fired for attendance issues does that count as misconduct? I was late a few times because of my car breaking down but I always called in.

Ethan Anderson
•Attendance can be tricky. If you were chronically late without valid reasons, that might be misconduct. But if you had legitimate reasons and were communicating with your employer, that's different. You should still apply and let Washington ESD make the determination.

•Okay I'll give it a shot. Better than not trying at all I guess.

Make sure you file your weekly claims even if your initial claim is under review! I made that mistake and it delayed my payments by weeks. Also keep looking for work and document your job search - Washington ESD requires that.

Ava Kim
•Good point! How many jobs do I need to apply for each week?

Alexander Zeus
•I think it's 3 job search activities per week but check the current requirements on the Washington ESD website. Could be different now.

Lucas Notre-Dame
•It's still 3 activities per week. Can be job applications, networking events, career fairs, etc. Just keep good records of what you did.

honestly just apply and see what happens. worst case they say no and youre in the same situation as now. best case you get benefits while you look for a new job

•You're right, nothing to lose by trying. I'm going to file today.

I got fired from my restaurant job for dropping too many plates and still got unemployment. Washington ESD said it was just being clumsy, not intentional misconduct. Performance issues are usually not disqualifying unless you were doing something on purpose.

•Lol sorry but that's actually kind of funny. Glad it worked out for you though!

•Yeah I laugh about it now but I was mortified at the time. Point is, if I can get benefits for being a klutz, this person should be fine for 'performance issues.

The adjudication process can take a while so be patient. I think mine took about a month because my employer contested it. But I did get backpay for the whole time once it was approved. Just make sure you keep filing your weekly claims during the process.

•A month sounds like forever when you have bills to pay but at least there's backpay. Thanks for the heads up.

•You might want to look into food banks or other assistance programs while you're waiting. No shame in getting help when you need it.

Same thing happened to my buddy - fired for 'performance' but really they just didn't want to pay him anymore. He fought it and won. The key is Washington ESD looks at the actual facts, not just what your employer claims.

Ava Kim
•That gives me hope. Did he need a lawyer or anything?

•Nah, just documented everything and was honest about what happened. Washington ESD does their own investigation.

Pro tip: when you file, be very specific about why you think you were fired vs what they officially said. Like if you think it was really budget cuts but they said performance, mention both. Helps Washington ESD get the full picture.

•Good advice! I definitely think there was more to it than just my performance.

•But don't speculate too much or make accusations you can't prove. Stick to facts you can document.

I was so stressed when I got fired last year, thought my life was over. Turns out getting unemployment gave me time to find a way better job. Sometimes these things work out for the best. File your claim and focus on finding something better!

If you're having trouble reaching Washington ESD to ask questions about your claim, I had good luck with Claimyr too. Worth checking out if you need to talk to someone quickly about your situation.

•I'll keep that in mind if I run into issues. Hopefully the online application process goes smoothly.

Quick question - do you have to pay taxes on unemployment benefits? I'm filing for the first time and want to know what to expect.
0 coins
Lucas Notre-Dame
•Yes, unemployment benefits are taxable income. You can choose to have taxes withheld or pay them when you file your return next year.
0 coins
Sophia Russo
•Thanks! I'll probably have them withheld to avoid a big tax bill later.

Don't let them intimidate you into not filing. Employers sometimes try to scare people by saying they'll fight the claim, but that's just a tactic. You have rights and Washington ESD will investigate fairly.

Ava Kim
•My employer hasn't said anything yet but I'm sure they won't be happy when they find out I filed.

•That's their problem, not yours. You paid into the system through your taxes and you're entitled to benefits if you qualify.

One more thing - make sure you understand what 'able and available' means for your weekly claims. You have to be ready to work if someone offers you a job, even while you're getting benefits.

Ava Kim
•Yeah I'm definitely ready to work! Just need time to find the right opportunity.
