Does getting fired disqualify you for unemployment benefits in Washington?
I got terminated from my job last week and I'm not sure if I can even apply for unemployment. My manager said it was due to performance issues but I feel like they were looking for reasons to let me go. I've been working there for 2 years with no major problems until recently. Does getting fired automatically disqualify you from getting unemployment benefits through Washington ESD? I've never filed for unemployment before and I'm really stressed about paying my rent next month.

Getting fired doesn't automatically disqualify you from unemployment benefits in Washington. It depends on WHY you were fired. If it was for misconduct, then yes you'd be disqualified. But if it was for performance issues or not being a good fit, you should still qualify. Washington ESD will investigate during the adjudication process to determine if there was misconduct.

•What exactly counts as misconduct? They said I was missing deadlines but I was never formally written up or put on a performance improvement plan.

•Misconduct has to be willful or deliberate violation of company policy. Simply not meeting performance standards usually isn't considered misconduct unless you were deliberately not doing your job.

You should definitely apply! I got fired for 'performance issues' last year and still got approved for unemployment. The key is that Washington ESD looks at whether your termination was due to misconduct or just regular employment issues. File your claim as soon as possible because there's a waiting period anyway.

•How long did it take for them to make a decision on your claim? I'm worried about the adjudication process taking forever.

•Mine took about 3 weeks for adjudication. They contacted both me and my former employer to get both sides of the story before making their decision.

I had such a hard time getting through to Washington ESD when I had questions about my termination and eligibility. Spent hours on hold and kept getting disconnected. Finally found this service called Claimyr that actually got me connected to an agent in like 10 minutes. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Made the whole process so much less stressful.

•How much does that service cost? I'm already worried about money and don't want to pay extra fees.

•It's totally worth it when you need to actually talk to someone about your specific situation. Way better than sitting on hold for hours and never getting through.

The Washington ESD system is so confusing! I thought any firing meant you couldn't get benefits but apparently that's not true. Why don't they make this clearer on their website?

•The information is there but it's buried in legal language. Basically, you can get benefits unless you were fired for 'misconduct connected with your work' - which has a very specific definition.

•Thanks for clarifying! I wish they would just use plain English instead of all that legal jargon.

I've been through this process twice unfortunately. Once for performance issues (got benefits) and once for attendance problems (got disqualified). The difference was that the attendance issue was considered willful misconduct because I had been warned multiple times. Performance issues without warnings usually don't count as misconduct.

•That's really helpful to know. I never received any formal warnings about my performance, just some casual feedback from my manager.

•That works in your favor. Document everything you can remember about your employment and termination for the adjudication interview.

File immediately! Even if you think you might not qualify, let Washington ESD make that determination. The worst they can do is say no, but you might be surprised. I know someone who got fired for what seemed like misconduct but still got approved because the employer couldn't prove it was willful.

•Good point. I guess I have nothing to lose by applying. How do I start the process?

•Go to esd.wa.gov and file your initial claim online. You'll need your Social Security number, employment history, and details about your termination.

The unemployment system is such a joke. They make it so complicated to figure out if you even qualify. Meanwhile people are struggling to pay bills while they take weeks to make a decision.

•I get the frustration, but the adjudication process exists to prevent fraud and ensure people who qualify actually get benefits. It's not perfect but it serves a purpose.

•I suppose, but it shouldn't take a month to figure out if someone was fired for misconduct or not.

Make sure you have all your documentation ready - pay stubs, termination letter, any performance reviews, etc. Washington ESD will want to see everything during the adjudication process. Also be prepared to explain your side of the story clearly and honestly.

•I don't have a termination letter yet. Is that something I need to request from HR?

Zoe Stavros
•Yes, definitely request it. Also ask for a copy of your personnel file if possible. The more documentation you have, the better.

I'm dealing with something similar right now. Got let go for 'not meeting expectations' but I think it was really because they wanted to cut costs. Filed my claim two weeks ago and it's still in adjudication. The waiting is killing me.

•Have you been able to talk to anyone at Washington ESD about your case?

•That's been the hardest part. I can never get through on the phone. Might try that Claimyr service someone mentioned earlier.

Quick question - do you have to wait for the adjudication decision before you can start filing weekly claims? Or can you file them while they're investigating?
0 coins
GalaxyGazer
•You should file your weekly claims even during adjudication. If you're approved, you'll get back pay for those weeks. If you don't file, you lose those weeks forever.

•Good to know! I was worried about filing weekly claims before the decision was made.

The key thing is being honest about everything. Don't try to hide details about your termination because Washington ESD will contact your employer anyway. If you're upfront about what happened, even if it wasn't great, you have a better chance of getting approved.

Nia Harris
•That makes sense. I definitely don't want to make things worse by not being truthful.

Liam Sullivan
•Exactly. They've heard every story before. Just be honest and let them make the determination based on the facts.

Does anyone know what happens if you get denied? Can you appeal the decision?
0 coins
GalaxyGazer
•Yes, you can appeal within 30 days of the determination. There's a whole appeals process with hearings if needed.

I used Claimyr when I needed to check on my adjudication status and it was a lifesaver. Couldn't get through for days on my own but they connected me to an agent who explained exactly what was happening with my case. Worth every penny when you're stressed about money.

•Seems like a lot of people have had success with that service. I might give it a try if I can't get through on my own.

•Yeah, the peace of mind is worth it. Plus the agent was able to tell me exactly what documents I needed to submit to speed up my case.

Just want to add that even if you think your termination was justified, you should still apply. I thought for sure I'd get denied but ended up getting approved because the employer couldn't prove misconduct. Washington ESD has a pretty high bar for what counts as disqualifying misconduct.

Nia Harris
•That's encouraging to hear. I keep going back and forth on whether I should even bother applying.

•Definitely apply. The worst they can say is no, but you might be surprised by the outcome.

Performance issues are NOT the same as misconduct. I see people confuse this all the time. Misconduct is like stealing, showing up drunk, harassing coworkers - serious stuff. Not meeting deadlines or struggling with job duties is just regular employment stuff.

Nia Harris
•Thank you for making that distinction clear. I was definitely confused about what actually counts as misconduct.

•No problem! Too many people think any firing disqualifies them when that's not true at all.

The whole process is nerve-wracking but most people do end up getting approved if they weren't fired for serious misconduct. Just be patient with the adjudication process and keep filing your weekly claims.

One more tip - when you do your adjudication interview, stick to the facts and don't get emotional or defensive. Just explain what happened in a straightforward way. The adjudicator has heard it all before.

Nia Harris
•That's good advice. I tend to get flustered in these situations so I'll try to stay calm and factual.

•You'll do fine. Just remember they're not there to judge you personally, they're just determining eligibility based on the law.

For what it's worth, I got fired from my last job for performance issues and had no problems getting unemployment benefits. Filed online, did the phone interview a few weeks later, and got approved. The whole process took about a month from start to finish.

•That's exactly what I needed to hear. Thanks for sharing your experience!

Just to echo what others have said - apply now! The sooner you file, the sooner you can start getting benefits if you qualify. And definitely use that Claimyr service if you need to talk to someone at Washington ESD. Saved me so much time and frustration.
