If I'm fired can I collect unemployment benefits in Washington?
I just got terminated from my job yesterday and I'm not sure if I qualify for unemployment benefits. My manager said it was due to performance issues but I feel like they were looking for reasons to let me go. Can I still file for unemployment with Washington ESD if I was fired? I've been working there for 2 years and this is my first time dealing with unemployment. Really stressed about paying my bills next month.

Yes, you can still potentially collect unemployment even if you were fired, but it depends on the reason. Washington ESD will determine if you were fired for 'misconduct' or just poor performance. Performance issues usually don't disqualify you, but misconduct like theft or willful violations of company policy can. You should definitely file a claim as soon as possible.

•Thanks, that's reassuring. They said it was performance related, not misconduct. How do I know if Washington ESD will approve my claim?

•Washington ESD will contact both you and your former employer to get both sides of the story. They'll make a determination based on the facts. If they deny your claim initially, you have the right to appeal.

I went through this exact situation last year. Got fired for 'not meeting expectations' but was approved for benefits. The key is being honest when you file your claim and during any interviews with Washington ESD. They understand the difference between being bad at a job vs. doing something intentionally wrong.

•How long did it take for them to make a decision on your claim?

•About 3 weeks for me. They had to do what's called adjudication where they investigate the circumstances of my termination.

•That's pretty typical. Mine took about the same time when I got laid off.

Be prepared that your employer might fight your claim. Companies often contest unemployment claims to keep their tax rates down. If they do contest it, Washington ESD will schedule a hearing where both you and your employer can present your case. I had to use a service called Claimyr to actually get through to Washington ESD when my case got complicated - they help you reach agents by phone since the lines are always busy. Check out claimyr.com, they even have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works.

•Is that service expensive? I'm already worried about money.

•It's worth it when you need to actually talk to someone at Washington ESD. Way cheaper than missing out on benefits because you can't get through on the phone.

•I've heard of that service too. Friend used it when her claim got stuck in adjudication hell.

DEFINITELY file your claim right away! Don't wait. Even if you think you might not qualify, let Washington ESD make that determination. I made the mistake of waiting 2 weeks because I thought I wouldn't qualify and lost those weeks of potential benefits. You can file online at their website.

•Good point. I'll file today. Do I need any special documents?

•You'll need your Social Security number, driver's license, and employment history for the last 18 months. Also helpful to have your last pay stub.

ugh the whole system is so confusing. i got fired 6 months ago and still dont understand half the stuff they asked me during the phone interview

•What kind of questions did they ask you during the interview?

•lots of stuff about why exactly i got fired, what my boss said, if i had any warnings, whether i violated any policies. felt like i was on trial

•That's normal. They have to determine if the termination was your fault or not. Just be honest and factual.

The good news is that most people who get fired for performance reasons do get approved for unemployment. It's when you get fired for stealing or fighting or not showing up that you run into problems.

•What about if you get fired for being late too much? Asking for a friend...

•That's more of a gray area. Depends on whether your employer had a clear attendance policy and gave you warnings.

Whatever you do, don't quit your job thinking you'll get unemployment because you won't. I learned that the hard way. But getting fired is different - you can potentially still collect benefits.

•Yeah, I definitely got fired, didn't quit. They basically called me into HR and said today was my last day.

•That sucks. At least you can file for benefits though. When I quit my toxic job I was stuck with no income for months.

Here's something important - when you file your weekly claims, you'll need to report any severance pay or vacation payout. That might delay when your benefits start but it won't disqualify you completely.

Chloe Mitchell
•They didn't give me any severance, just my final paycheck. Does that affect anything?

Emily Parker
•Nope, that shouldn't affect your claim at all. Your final paycheck is just your regular wages.

I've been through this process twice unfortunately. The key thing is documentation. If you have any emails or write-ups related to your performance issues, keep copies. It helps show that it was performance-related and not misconduct.

•I do have some emails about my performance. Should I send those to Washington ESD?

Ezra Collins
•Keep them handy but don't send anything unless they specifically ask. They'll request documents if they need them during the adjudication process.

•Good advice. I sent too much stuff upfront and it just confused things.

Also remember that even if you get approved, you'll need to actively look for work and report your job search activities. Washington ESD requires you to make at least 3 job search contacts per week and keep a log.

•Applying for jobs, networking contacts, attending job fairs, even some online job search activities. They have specific requirements on their website.

One more thing - if your claim goes into adjudication, it can take weeks to get a decision. That's when services like Claimyr become really helpful because trying to call Washington ESD to check on your status is nearly impossible. The wait times are insane.

•This is so true. I spent hours on hold trying to reach someone about my claim status.

•Exactly why I ended up using Claimyr. They actually got me through to an agent who could explain what was taking so long with my adjudication.

Don't let your employer scare you into not filing. Some employers will try to tell you that you don't qualify or that filing will hurt you somehow. That's not true - it's your right to file for benefits if you lose your job.

•My manager did say something about how I probably wouldn't qualify. I wondered if he was trying to discourage me.

•Sounds like he was. Employers don't make the decision about your benefits - Washington ESD does. File your claim and let them determine your eligibility.

The worst thing you can do is nothing. I know it feels overwhelming but filing for unemployment is pretty straightforward. The Washington ESD website walks you through it step by step.

•Thanks everyone. I'm going to file my claim today. This has been really helpful.

•Good luck! Most people in your situation do end up getting approved. Just be patient with the process.

Quick tip - when you do your weekly claims, be super careful about how you answer the questions. One wrong answer can mess up your benefits. Read each question carefully and answer honestly.

•This is important. I accidentally answered a question wrong once and it flagged my claim for review.

•Exactly. And if something like that happens, that's another time when being able to actually talk to someone at Washington ESD becomes crucial.

Also just want to mention that if you do get denied initially, don't give up. The appeals process exists for a reason and many people win their appeals. You have rights in this process.

Chloe Mitchell
•How long do you have to file an appeal if you get denied?
0 coins
Eleanor Foster
•I believe it's 30 days from the date of the determination notice. Don't wait if you disagree with their decision.

Lucas Turner
•And remember, during the appeals process you can still file weekly claims. If you win your appeal, you'll get back pay for those weeks.
