Washington ESD unemployment benefits after being terminated - am I eligible?
I was terminated from my job last Friday and I'm trying to figure out if I can get unemployment benefits through Washington ESD. My supervisor said it was due to performance issues but I feel like they were looking for reasons to let me go. I've been working there for 8 months and this is my first time dealing with unemployment. Can you still get UI benefits if you were fired? I'm really stressed about this because I have bills to pay and I don't know how long it will take to find another job.

Yes, you can potentially get unemployment benefits even if you were terminated, but it depends on the reason. Washington ESD will review your case during adjudication to determine if you were fired for misconduct or just poor performance. Performance issues usually don't disqualify you unless there was willful misconduct involved.

•That's good to know. How do I prove it wasn't misconduct? I never got any written warnings or anything like that.

•Document everything you can remember about your employment and termination. Washington ESD will contact both you and your employer during the adjudication process to get both sides of the story.

File your claim right away! Don't wait. Even if Washington ESD needs to adjudicate your case, you want to get the process started. I was terminated last year and it took 3 weeks for them to make a decision, but I eventually got approved.

•Did you have to do anything special during the adjudication process? I'm worried they'll just believe whatever my employer says.

•Be honest and provide any documentation you have. Employment records, emails, anything that shows your work history. Washington ESD is pretty fair about these things.

I had similar issues trying to get through to Washington ESD when I was going through adjudication. Spent hours on hold every day trying to check my claim status. Finally found this service called Claimyr (claimyr.com) that actually got me through to a real person at Washington ESD. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ. Really helped me get answers about my case.

•How much does something like that cost? I'm already worried about money.

•It's worth it when you consider how much time you save not sitting on hold for hours. Much cheaper than missing out on benefits because you can't get through to Washington ESD.

The key thing is whether your termination was for 'misconduct connected with work.' Simple poor performance usually doesn't count as misconduct under Washington ESD rules. Things like theft, harassment, or willful violation of company policy would be misconduct.

•So being late a few times or not meeting sales goals wouldn't count as misconduct?

•Probably not, unless you were consistently late despite warnings or deliberately underperforming. Washington ESD looks at the pattern and intent.

•This is helpful. I was worried about a couple times I was 10 minutes late due to bus issues.

ugh the washington esd system is so confusing!! why cant they just tell you yes or no right away instead of making you wait weeks for adjudication

•I know it's frustrating, but they need time to investigate termination cases properly. It's better than making quick decisions that might be wrong.

•i guess but its hard when you have no income coming in and bills due

Make sure you keep filing your weekly claims even during adjudication! A lot of people don't realize this and then they miss out on back pay if they get approved.

•Really? I thought you couldn't file until they approve your initial claim.

•Nope, you should keep filing weekly. If approved, you'll get paid for all the weeks you filed during adjudication.

Been through this exact situation. Performance termination after 8 months - sounds familiar. Washington ESD approved my claim but it took almost a month. The waiting is the worst part.

•A whole month? How did you survive financially during that time?

•Had to borrow money from family and use credit cards. But I got all the back pay once approved, so it worked out eventually.

What industry were you in? Some employers are more likely to fight unemployment claims than others. Retail and food service usually don't contest unless it's really bad.

•I was working in customer service at a call center. Not sure if they'll fight it or not.

•Call centers can go either way. Some are really strict about performance metrics, others just want to move on.

Whatever you do, don't lie about anything to Washington ESD. They can verify employment info and if they catch you in a lie, you'll be disqualified for sure.

•I wasn't planning to lie, but good to know they check everything.

•Yeah they're pretty thorough. Had a coworker get busted for claiming he was laid off when he was actually fired for attendance.

The Washington ESD adjudication process isn't fun but it's not as scary as it sounds. They'll send you a questionnaire about your termination, and your employer gets one too. Just be honest and provide details.

•Do I need to get a lawyer or anything like that?

•Not for the initial adjudication. If you get denied and want to appeal, then you might consider it.

I've been using Claimyr to get through to Washington ESD and it's been a lifesaver. Way better than trying to call at 8am sharp and still not getting through.

•Yeah it's real. They just help you get connected faster. Still talking to actual Washington ESD staff, just without the wait.

File immediately and start looking for work right away. Even if you get approved, you'll need to meet job search requirements to keep getting benefits.

•How many jobs do I need to apply for each week?

Sofia Morales
•I think it's 3 job search activities per week, but check the Washington ESD website for the current requirements.

man i feel for you. getting fired sucks even when its not your fault. at least washington esd is usually reasonable about performance issues vs real misconduct

Make sure you have your employer's exact reason for termination. If they told you one thing but report something different to Washington ESD, that could help your case.

•Good point. They told me performance but I wonder what they'll tell Washington ESD.

•Keep notes of what they told you and when. Might be useful during adjudication.

The Claimyr thing someone mentioned earlier actually worked for me too. I was stuck in adjudication hell for weeks and couldn't get anyone on the phone at Washington ESD. Used their service and finally got to talk to someone who explained exactly what was happening with my case.

•I might have to try that if I can't get through the normal way.

•Same here, totally worth it when you're stressed about your claim status.

Don't let them intimidate you during the process. Employers sometimes try to make terminations sound worse than they were to avoid paying unemployment taxes.
0 coins
Mateo Hernandez
•That's what I'm worried about. They might exaggerate things.

•Washington ESD hears these cases all the time. They can usually tell when employers are stretching the truth.

You'll be fine. Performance issues are way different from misconduct in Washington ESD's eyes. Just file your claim and be patient with the adjudication process.
