Can you get Washington ESD unemployment benefits if you are fired from your job?
I was terminated from my job last week and I'm wondering if I can still file for unemployment benefits with Washington ESD. My supervisor said it was due to performance issues but I feel like they didn't give me proper training or support. I've been working for 18 months at this company and this is my first time dealing with unemployment. Does being fired automatically disqualify you from getting UI benefits in Washington? I'm really stressed about paying my bills and need to know if I should even bother applying.

You can absolutely still get unemployment benefits even if you were fired, but it depends on the reason. Washington ESD will look at whether you were terminated for 'misconduct' or not. Performance issues usually don't count as misconduct unless you were willfully negligent or violated company policy. You should definitely file your claim right away since there's a waiting period.

•Thank you! That's really helpful. What exactly counts as misconduct then? I was never written up or anything formal like that.

•Misconduct typically means things like theft, violence, insubordination, or repeatedly violating known company rules. Poor performance or not being a good fit usually isn't misconduct in Washington ESD's eyes.

I got fired for attendance issues last year and still qualified for unemployment. Washington ESD approved my claim after reviewing everything. The key is being honest on your application about why you were terminated.

•Did they contact your employer during the process? I'm worried my boss will say bad things about me.

•Yes, they send a form to your employer asking for their side of the story. But as long as you're truthful, you should be fine if it was really just performance related.

Honestly, trying to get through to Washington ESD on the phone to ask questions about your claim is nearly impossible. I spent weeks calling and either got busy signals or was hung up on after waiting for hours. I finally found this service called Claimyr (claimyr.com) that actually gets you connected to a real person at Washington ESD. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me so much frustration when I needed to clarify my eligibility after being let go.

•Really? I was dreading having to call them. How does that service work exactly?

•They basically handle the calling and waiting for you, then connect you when they get an actual Washington ESD representative on the line. Way better than spending your whole day redialing.

•That sounds too good to be true. Are there any catches or is it expensive?

•It's legit - they focus on actually getting you through rather than making you jump through hoops. The value is definitely worth it when you need real answers about your claim.

File your claim ASAP regardless! Even if there's an issue, Washington ESD will investigate and make a determination. You can always appeal if they deny you initially. Don't let fear stop you from applying - the worst they can say is no, but you might qualify.

•You're right, I should just apply. How long does the process usually take?

Justin Chang
•Initial processing is usually 2-3 weeks if there are no complications. If they need to investigate the circumstances of your termination, it could take longer due to adjudication.

ugh the whole system is so stressful!! I was fired 6 months ago and it took FOREVER to get my benefits sorted out. they make you feel like a criminal for asking for help after losing your job through no fault of your own

•That's exactly how I'm feeling right now. Did you end up getting approved eventually?

•yes but only after appealing their initial denial and waiting like 2 months total. such a nightmare when you're already stressed about money

Just to clarify some important points: Washington ESD uses a 'misconduct' standard, which is pretty specific. They look at whether your actions were a deliberate violation of your employer's interests. Poor performance, inability to do the job, or personality conflicts typically don't meet this standard. The burden is on your employer to prove misconduct occurred.

•This is good info. What if they claim you violated company policy though?

Marcus Williams
•They'd need to show you knew about the policy and willfully violated it. Simply making mistakes or not understanding expectations usually isn't enough for a misconduct finding.

I got terminated for 'not meeting expectations' last month and was approved for benefits within 3 weeks. No issues at all. Washington ESD seems to understand that sometimes jobs just aren't a good fit.

•That's encouraging! Did you have to provide any documentation or evidence?

•Nope, just filled out the application honestly. They contacted my employer but since it was performance-related and not misconduct, it was pretty straightforward.

Wait, I thought if you get fired you automatically can't get unemployment? This is news to me. I've been afraid to apply for months after getting let go.

•That's a common misconception! Being terminated for misconduct disqualifies you, but being fired for performance, downsizing, or not being a good fit usually doesn't.

•Wow, I wish I had known this earlier. I've been struggling financially for no reason.

The key thing is to file your weekly claims even while they're reviewing your case. If you're eventually approved, you'll get backpay for those weeks. Don't wait to start the process.

•Good point - I'll make sure to keep filing weekly even if there are questions about my initial eligibility.

Since you mentioned needing to talk to someone at Washington ESD about your specific situation, I can't recommend Claimyr enough. When I was dealing with questions about my termination, I needed to speak with an actual adjudicator to understand my case status. Trying to call directly was hopeless - busy signals, long holds, then getting disconnected. Claimyr got me through to someone who could actually look at my file and explain what was happening.

•How quickly were you able to get connected through them? I've been trying to reach Washington ESD for weeks.

•Much faster than doing it myself. They handle all the waiting and calling, then patch you through when they reach a rep. Definitely worth it when you need real answers about eligibility issues.

Here's what I learned from my experience: document everything from your job, especially if you think you might get fired. Save emails, performance reviews, any training materials. It helps if Washington ESD needs to investigate.

•I do have some emails about the lack of training I mentioned to my supervisor. Should I submit those with my application?

Hunter Brighton
•Keep them ready in case Washington ESD asks for more information during their review process. They might not need them initially but having documentation helps your case.

the worst part is they make you wait and worry while they 'investigate' like you did something wrong when really your boss just decided they didn't like you anymore

•I get the frustration but the investigation protects everyone. It prevents employers from gaming the system and ensures people who legitimately qualify get benefits.

Don't overthink it - just apply! Washington ESD processes thousands of these cases. They know the difference between misconduct and regular job separations. Your situation with performance issues and lack of training sounds like a pretty standard approval case.

•Thanks for the encouragement. I'm going to file my application tonight.

Similar thing happened to my brother - fired for 'performance' but really they just wanted someone cheaper. He got approved no problem. Don't let them intimidate you.

Jessica Suarez
•That does sound similar to my situation. It's reassuring to hear success stories.

One more important tip: when you file your claim, be completely honest about the reason for separation. Don't try to sugarcoat it or make it sound better. Washington ESD will get your employer's version anyway, and consistency between your stories helps your credibility.

•Good advice. I'll be straightforward about the performance issues they cited while also mentioning the training situation.

This thread has been so helpful. I'm going to apply for benefits too now that I understand you can qualify even after being terminated. Wish I'd known this months ago!

•Better late than never! Make sure to file ASAP since benefits are calculated from when you apply, not when you lost your job.

For anyone who needs to actually talk to Washington ESD about their specific termination situation, seriously check out Claimyr. I was skeptical at first but it really works. Having someone who can explain your case status and eligibility in real time is invaluable when you're dealing with job loss stress.

•I've been putting off calling Washington ESD because I know it'll be a nightmare. Maybe I should try this service instead of driving myself crazy.

•Exactly - let them deal with the phone system hassle while you focus on your job search and getting back on your feet.

Final thought: even if Washington ESD initially denies your claim, you have appeal rights. Don't give up if the first decision goes against you. Many people win on appeal, especially for performance-related terminations.
