If you are terminated can you get unemployment - Washington ESD eligibility question
Just got terminated from my job yesterday and I'm wondering if I can still apply for unemployment benefits through Washington ESD. My manager said it was due to performance issues but I feel like they didn't give me proper training or support. I've been working there for 8 months and this is my first time dealing with unemployment. Does being terminated automatically disqualify you from getting benefits? I'm really stressed about how I'm going to pay my bills.

You can definitely apply for unemployment even if you were terminated! Washington ESD looks at the reason for termination. If it was for performance issues rather than misconduct, you'll likely qualify. Misconduct means things like theft, violence, or willful violation of company policy. Poor performance usually doesn't count as misconduct.

•That's a relief! How do I prove it was performance and not misconduct? I don't have any written warnings or documentation.

•Washington ESD will contact your employer to get their side of the story. If they can't prove misconduct, you should be approved. Just be honest about what happened when you file your claim.

I got terminated last year and still received benefits. The key is being truthful on your application. Washington ESD will investigate and make a determination. Even if your employer contests it, you can appeal their decision.

•How long did it take for you to get approved? I'm worried about the waiting period.

AstroAdventurer
•It took about 3 weeks for my claim to process. There's always a one-week waiting period before benefits start, but they can backdate it if you're approved.

I've been trying to reach Washington ESD for weeks about my own claim status and it's impossible to get through on the phone. The system is so overloaded. Has anyone found a way to actually talk to someone there?

•I had the same problem until I found this service called Claimyr. They help you get through to Washington ESD agents by phone. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. It was a lifesaver for me!

•Interesting, I'll check that out. I've been calling for hours every day with no luck.

•Does that service actually work? I'm skeptical about paying for something like that.

•It worked for me! I was able to talk to someone within a few days instead of weeks of calling. Worth it when you need answers about your claim.

MAKE SURE YOU FILE IMMEDIATELY! Don't wait around thinking about it. Washington ESD can only backdate claims one week, so every day you wait is money lost. You can file online at their website 24/7.

•I was planning to file today. Do I need any specific documents or information before I start?

•You'll need your Social Security number, employment history for the last 18 months, and your last employer's information. Have your bank account info ready too for direct deposit.

The whole system is rigged against workers. They'll find any excuse to deny your claim. I got denied three times before finally getting approved after appealing. Don't trust what they tell you on the phone either.

•That's not really fair to say. Most legitimate claims get approved. The system has issues but it's not rigged against workers.

•Easy for you to say if you haven't been through the appeals process. It's a nightmare and they make it as difficult as possible.

Quick question - do you have to be actively looking for work while your claim is processing? I heard conflicting information about the job search requirements.
0 coins
Carmen Lopez
•Yes, you need to be actively seeking work and log your job search activities. Washington ESD requires 3 job search activities per week. You'll report this when you file your weekly claims.

•Thanks! I wasn't sure if that started immediately or after approval.

I'm going through something similar right now. Got fired for 'attitude problems' but I think my supervisor just didn't like me. My claim has been in adjudication for 2 weeks now and I'm getting anxious.

Yuki Ito
•That's exactly what I'm worried about! How do they determine what's misconduct vs just personality conflicts?
0 coins
Carmen Lopez
•Adjudication can take several weeks. They interview both you and your employer. Document everything you remember about the termination and any conversations with your supervisor.

•I wish I had kept better records. Hindsight is 20/20 I guess.

been there done that. filed my claim same day I got terminated and was approved within 2 weeks. performance issues are usually not misconduct unless you were deliberately doing bad work.

Yuki Ito
•That gives me hope! I definitely wasn't being deliberately bad at my job, just struggling with the workload.

Update: I tried that Claimyr service someone mentioned and actually got through to Washington ESD! Turns out my claim was approved but there was a technical issue with my account. Would never have known if I hadn't been able to talk to someone.

Zoe Papanikolaou
•Glad it worked for you too! Sometimes these technical issues can hold up your benefits for weeks if you don't know about them.

•Maybe I should try it too. I've been waiting for my appeal decision for over a month.

Don't forget about the mandatory one-week waiting period. Even if you're approved right away, your first week of unemployment won't be paid. It's just how the system works in Washington.

Yuki Ito
•Is that week permanently lost or do you get it back later?
0 coins
Giovanni Mancini
•It's permanently lost unless you get laid off again later and don't have to serve another waiting week. It's just part of the system.

Make sure you understand the difference between being terminated and being laid off. Layoffs are usually automatic approval but terminations require investigation. Sounds like yours will need adjudication.

Yuki Ito
•Yeah, it was definitely a termination. They said my performance wasn't meeting expectations.

Fatima Al-Suwaidi
•That should still qualify as long as you were trying to do your job. Inability to perform isn't the same as willful misconduct.

I'm dealing with Washington ESD right now too and their phone system is absolutely terrible. Been trying to get through for days about my weekly claim certification.

•Seriously, try Claimyr! I keep recommending it because it actually works. Their website is claimyr.com and they have a demo video that explains everything.

Just want to add that you should screenshot everything and keep records of all your communications with Washington ESD. If they deny your claim, you'll need documentation for your appeal.

•Good advice! I'll start documenting everything from the beginning.

The appeals process isn't as scary as people make it sound. I had to appeal my denial and it was pretty straightforward. Just tell your side of the story honestly.
0 coins
Jamal Wilson
•Maybe you got lucky. My appeal hearing was a disaster and the judge seemed biased toward the employer.
0 coins
StarSailor
•That's unfortunate. I think it depends on the specific circumstances and how well you can present your case.

Whatever you do, don't quit your job before they terminate you thinking it will be easier to get unemployment. Quitting makes it much harder to qualify.

•Too late for that advice but good to know for future reference!

I got terminated 6 months ago and my claim was approved without any issues. The key is being honest about what happened and not trying to hide anything from Washington ESD.
0 coins
Yuki Ito
•That's encouraging! Did your employer contest your claim at all?
0 coins
Ava Garcia
•They did contest it initially but Washington ESD still approved me after reviewing the case. I think they realized it was just a performance issue.

btw you might want to apply for other assistance programs while you're waiting for unemployment to kick in. food stamps, medicaid, etc. every little bit helps

Yuki Ito
•Good idea, I hadn't thought about that. Do you know if unemployment affects eligibility for other programs?
0 coins
Miguel Silva
•it might affect some programs but you should still apply. better to have the help while you need it

The most important thing is to file your weekly claims on time even if your initial claim is still pending. Missing a week can cause delays in your benefits.
0 coins
Yuki Ito
•When do the weekly claims start? Right after I file my initial application?
0 coins
Zainab Ismail
•Yes, you'll need to file your first weekly claim for the week you became unemployed. The system will tell you when your next claim is due.

Good luck with your claim! Most people who get terminated for performance reasons end up getting approved. It's the misconduct cases that get denied.

•Thanks for all the encouragement everyone! I'm going to file my claim today and see what happens.

Final update: Got my benefits approved! That Claimyr service really helped me get through to someone who could explain the process. For anyone else struggling to reach Washington ESD, it's worth checking out.
