Do you get unemployment if you get fired in Washington ESD?

Got terminated from my warehouse job last Friday and I'm not sure if I can file for unemployment benefits. My supervisor said it was for performance issues but I think they were just looking for reasons to let me go. I've been working there for almost 2 years and never had any write-ups before this month. Can I still apply for Washington ESD benefits if I was fired? What are my chances of getting approved?

You can definitely apply! Getting fired doesn't automatically disqualify you from unemployment in Washington. It depends on WHY you were fired. If it was for performance issues or downsizing, you'll likely qualify. If it was for misconduct (like stealing, fighting, etc.), then you won't.

They said it was performance but honestly I think they just didn't like me. Should I mention that when I file?

0 coins

Just stick to the facts when you file. Let Washington ESD investigate and make the determination. Don't speculate about their motives.

0 coins

File immediately! You have to wait a week anyway before benefits start, so don't delay. Washington ESD will contact your employer to get their side of the story. If there's a dispute, it goes to adjudication where they'll review everything and make a decision.

0 coins

How long does adjudication usually take? I need to know if I should start looking for temporary work.

0 coins

Can take anywhere from 2-6 weeks depending on how complex the case is. Definitely start job searching regardless - it's required anyway once you start receiving benefits.

0 coins

I went through this exact situation last year. Got fired from my retail job for 'performance issues' and was worried I wouldn't qualify. Filed anyway and got approved after about 3 weeks of adjudication. The key is being honest about what happened and letting Washington ESD sort it out.

0 coins

That's reassuring! Did your employer fight it at all?

0 coins

They responded to Washington ESD's inquiry but didn't contest the decision. I think they knew they didn't have a strong case for misconduct.

0 coins

Had the worst time trying to get through to Washington ESD when I was dealing with a similar situation. Spent hours on hold just to get disconnected. If you need to actually talk to someone about your case, I found this service called Claimyr that helped me get through. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ. Saved me so much frustration.

0 coins

Never heard of that before. Is it legit or just another scam?

0 coins

It's real - they basically call for you and get you connected to an actual person at Washington ESD. Check out claimyr.com if you're curious. Way better than sitting on hold for hours.

The Washington ESD system is so frustrating!! I got fired from my job 6 months ago and it took FOREVER to get my benefits approved. They make you jump through so many hoops and the adjudication process is a joke. Half the time they don't even look at the evidence properly.

0 coins

That sucks but at least you got approved eventually. How long did the whole process take?

0 coins

Almost 8 weeks total. Had to appeal the initial decision because they sided with my employer first. The appeal hearing was actually fair though.

0 coins

Make sure you have all your documentation ready when you file. Pay stubs, any warnings or disciplinary actions, emails, etc. Washington ESD wants to see everything.

0 coins

I don't have any written warnings because they never gave me any. Is that going to hurt my case?

0 coins

Actually that might help you! If they fired you for performance without any documented warnings, it looks like they didn't follow proper progressive discipline.

0 coins

Been there done that. Got canned from my construction job and thought I was screwed. Turns out Washington ESD approved me because my boss couldn't prove I did anything wrong. File your claim online and be patient.

0 coins

How specific do I need to be when describing what happened?

0 coins

Just tell the truth. Don't embellish but don't downplay it either. They'll figure out who's telling the truth.

0 coins

ugh the phone system for washington esd is absolutely terrible. tried calling 47 times yesterday and kept getting busy signals or hung up on. how is anyone supposed to get help??

0 coins

Try calling right at 8am when they open. That's your best bet for getting through.

0 coins

Or use that Claimyr service I mentioned earlier. Seriously saved my sanity when I needed to talk to someone about my adjudication.

0 coins

What exactly counts as 'misconduct' anyway? I always thought getting fired meant no unemployment but apparently that's not true?

0 coins

Misconduct is stuff like theft, violence, insubordination, violating company policy on purpose. Poor performance or not being a good fit isn't misconduct.

0 coins

Ah okay that makes sense. So basically if you're not doing anything wrong on purpose, you should still qualify.

0 coins

File ASAP and don't let them intimidate you. Employers sometimes lie or exaggerate to avoid paying higher unemployment taxes. Washington ESD will investigate both sides.

0 coins

That's what I'm worried about - that they'll make up stuff to make me look bad.

0 coins

If they don't have documentation to back up their claims, Washington ESD will see right through it. That's why keeping records is so important.

0 coins

I'm going through adjudication right now for the same thing. My employer is claiming I was 'willfully negligent' but I know that's BS. It's been 4 weeks and still waiting for a decision. This whole process is nerve-wracking.

0 coins

4 weeks? That's so long! Are you able to work in the meantime or are you just waiting?

0 coins

I'm doing some gig work to pay bills but it's not enough. Really hoping this gets resolved soon.

0 coins

Remember you have to keep filing your weekly claims even during adjudication! A lot of people forget to do this and then lose benefits for those weeks.

0 coins

Wait really? Even if I haven't been approved yet?

0 coins

Yes! You need to file every week to keep your claim active. If you get approved, they'll pay you retroactively for all those weeks.

0 coins

Just went through this whole mess myself. Company tried to claim I was fired for cause but Washington ESD didn't buy it. Got my first payment about 5 weeks after filing. Hang in there!

0 coins

5 weeks total? That's not too bad considering everything I'm hearing about delays.

0 coins

Yeah could have been worse. The adjudication took about 3 weeks and then another week or two for the payment to show up.

0 coins

make sure to start your job search log right away even if you're in adjudication. they require 3 job search activities per week and they'll ask for proof later

0 coins

What counts as job search activities? Just applying for jobs?

0 coins

applying, networking events, career fairs, training courses, etc. keep detailed records of everything

0 coins

The whole system is designed to discourage people from filing. Don't let that stop you! You paid into unemployment insurance when you were working - you earned these benefits.

0 coins

Exactly! It's insurance that we all pay for. Don't feel guilty about using it when you need it.

0 coins

Thanks, I needed to hear that. I was feeling bad about filing but you're right - I did pay into this system.

0 coins

If your claim gets denied initially, don't give up! You can appeal and often win at the hearing level. I've seen a lot of wrongful termination cases get overturned on appeal.

0 coins

How does the appeal process work? Do I need a lawyer?

0 coins

You don't need a lawyer but you can have representation if you want. It's a phone hearing where both sides present their case to an administrative law judge.

0 coins

I had to use Claimyr twice when dealing with my claim issues. First time was to check on my adjudication status, second time was after I got a weird letter I didn't understand. Both times they got me through to someone who could actually help. Worth every penny when you're dealing with Washington ESD bureaucracy.

0 coins

How much does it cost? Seems like it might be expensive.

0 coins

It's not about the cost when you're stressed about your benefits and can't get through on the phone. The peace of mind is worth it.

0 coins

One thing nobody mentions is that your employer gets notified when you file for unemployment. They have a chance to contest it, so be prepared for that possibility.

0 coins

Do most employers actually contest it or do they usually just let it go?

0 coins

Depends on the company and the circumstances. Larger companies with HR departments are more likely to contest, especially if they think they have a good case.

0 coins

Bottom line - file your claim today. The worst thing that can happen is they say no, but you won't know unless you try. Don't let fear or embarrassment keep you from getting benefits you might be entitled to.

0 coins

You're absolutely right. I'm going to file online tonight. Thanks everyone for all the advice and encouragement!

0 coins

Good luck! Keep us posted on how it goes. This thread will probably help other people in similar situations.

0 coins

Also remember that even if you get approved, there's a one-week waiting period before benefits start. So file as soon as possible to get that clock ticking.

0 coins

Thanks for reminding me about the waiting week. Every day I delay is costing me money.
