Washington ESD unemployment benefits if you're fired - what are my options?

Got terminated from my warehouse job last week and wondering if I can still file for unemployment with Washington ESD. My supervisor said it was due to 'performance issues' but I feel like they were looking for reasons to let me go. I've been working there for 8 months and never had any formal write-ups. Can you still get UI benefits if you're fired? What does Washington ESD consider when they review these cases?

Yes you can potentially get benefits even if fired, but it depends on the reason. Washington ESD will look at whether you were terminated for 'misconduct' or not. Performance issues usually don't count as misconduct unless it was willful negligence.

0 coins

That's reassuring. They said it was performance but I was never coached or given improvement plans. Should I file right away?

0 coins

Yes file immediately. You can always appeal if denied, but you want to get the process started since there's a waiting period.

0 coins

The key is whether Washington ESD determines it was misconduct connected with work. Simple poor performance usually qualifies you for benefits. Things that would disqualify you include theft, harassment, willful violation of company policy, etc.

0 coins

What if they claim you violated policy but you disagree? I got fired for supposedly not following safety procedures.

0 coins

That's where the adjudication process comes in. Washington ESD will investigate and may contact both you and your employer for statements.

I was in a similar situation and had trouble getting through to Washington ESD to check on my claim status. The phone lines are always busy and I kept getting disconnected. Finally found this service called Claimyr that helped me get through to an actual agent. You can check it out at claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

0 coins

How much does something like that cost? I'm already strapped for cash being unemployed.

0 coins

It was worth it for me because I was able to get answers about my adjudication that had been pending for weeks. Much less stressful than calling over and over.

0 coins

Never heard of this but might be useful. The Washington ESD phone system is absolutely terrible.

0 coins

Make sure you have all your documentation ready when you file. Washington ESD will want details about why you were terminated and you want to present your side clearly.

0 coins

What kind of documentation should I gather? I don't have any formal disciplinary records since there weren't any.

0 coins

Any emails about your performance, your employment contract, attendance records if you have them. Also write down your version of events while it's fresh.

0 coins

been fired twice and got benefits both times lol. as long as you werent stealing or doing drugs youll probably be fine

0 coins

That's not entirely accurate. It really depends on the specific circumstances and how Washington ESD evaluates the case.

0 coins

yeah well thats been my experience anyway

0 coins

The whole process is so stressful. I got fired 3 months ago and my case is still in adjudication. Washington ESD takes forever to make decisions and you're just stuck waiting with no income.

0 coins

You can try calling to check on your adjudication status. Sometimes there are additional documents they need that you're not aware of.

0 coins

I've tried calling hundreds of times. Either busy signal or I wait on hold for hours then get disconnected.

0 coins

That's exactly why I ended up using Claimyr. Got through to someone in about 10 minutes and found out they needed additional verification documents I hadn't submitted.

0 coins

File online through SecureAccess Washington (SAW). The process is pretty straightforward and you'll get a determination letter within a few weeks usually.

0 coins

Do I need to start looking for work right away or can I wait until my claim is approved?

0 coins

You need to start your job search immediately and keep a log. Washington ESD requires 3 job search activities per week.

0 coins

Just want to add that even if you get benefits, your employer's unemployment insurance rates might go up. Some employers will fight legitimate claims just to avoid that cost increase.

0 coins

That's not the claimant's problem though. If you qualify for benefits you shouldn't feel guilty about filing.

0 coins

Absolutely agree, just explaining why some employers contest valid claims.

0 coins

I got fired for attendance issues but it was because I was having car trouble. Washington ESD still approved my claim because they said it wasn't willful misconduct.

0 coins

That gives me hope. My situation seems similar - more about circumstances than intentional wrongdoing.

0 coins

Exactly. Washington ESD looks at whether you had control over the situation and whether it was deliberate.

0 coins

Whatever you do, be completely honest on your application. If Washington ESD finds out you lied about anything, that will definitely disqualify you.

0 coins

Good point. I'll make sure to be upfront about everything, even if it doesn't make me look great.

0 coins

Right approach. It's better to be honest and possibly get benefits than to lie and definitely get denied.

0 coins

The Washington ESD system is so backed up right now. My brother filed 6 weeks ago and still hasn't heard anything about his determination.

0 coins

That's unusual. Most determinations come within 2-3 weeks. He should definitely follow up on that.

0 coins

He's tried calling but you know how impossible it is to get through to anyone at Washington ESD.

0 coins

I've heard mixed things about services that help you contact Washington ESD. Has anyone actually used Claimyr successfully?

0 coins

Yes I mentioned it earlier. It worked well for me - got connected to an agent quickly and resolved my issue. Worth checking out their demo video.

0 coins

I was skeptical at first but tried it last month when my weekly claims were showing errors. Got through same day and the agent fixed everything.

0 coins

Remember you have to file your weekly claims even while your initial claim is being adjudicated. Don't skip those or you could lose benefits for those weeks.

0 coins

Good to know. So I should file my initial claim and then start doing weekly claims right away?

0 coins

Exactly. Keep filing weekly even if you haven't been approved yet. If you get approved, you'll get backpay for those weeks.

0 coins

Make sure you understand the difference between being fired and being laid off when you fill out your application. They ask specifically about the reason for separation.

0 coins

I was definitely fired, not laid off. Should I select 'discharged' on the application?

0 coins

Yes, and then provide details about the circumstances in the comments section.

0 coins

If Washington ESD denies your claim initially, don't give up. You can appeal the decision and present additional evidence. Sometimes the first review doesn't capture the full picture.

0 coins

The appeal process gives you a chance to present your case more thoroughly, including witness testimony if relevant.

0 coins

Exactly. I've seen people win on appeal even after being initially denied for misconduct.

0 coins

Does anyone know how long Washington ESD keeps employment records? I'm worried they might not have accurate information about my termination from 2 years ago if it becomes relevant.

0 coins

They typically maintain records for several years, but they get most termination information directly from employers anyway.

0 coins

That makes sense. I guess they would contact my current employer about the recent termination.

0 coins

Just file and see what happens. The worst they can do is say no, and then you can decide whether to appeal. At least you'll know where you stand.

0 coins

You're right. I've been overthinking this. Going to file my claim today and deal with whatever comes next.

0 coins

Good decision. Time is important with unemployment claims, so don't delay any longer.

0 coins

Keep detailed records of all your job search activities starting immediately. Washington ESD audits these and you don't want to be caught without proper documentation.

0 coins

What counts as a job search activity? Just applying for jobs or other things too?

0 coins

Applications, networking events, career fairs, even updating your LinkedIn profile. Check the Washington ESD website for the full list.

0 coins

The whole unemployment system feels designed to discourage people from filing. But if you paid into it through your taxes, you have every right to collect when you qualify.

0 coins

Absolutely. It's insurance that you and your employer paid for. Don't let anyone make you feel bad about using it.

0 coins

Exactly my point. The stigma around unemployment benefits is ridiculous when it's literally insurance you paid for.

0 coins

Hope this all works out for you OP. Being fired is stressful enough without having to worry about navigating the unemployment system too.

0 coins

Thanks everyone for all the advice. Feeling much more confident about filing now. Will update this thread once I hear back from Washington ESD.
