Can I get Washington ESD unemployment after being fired from my job?
I was terminated from my warehouse job last week and I'm wondering if I can still file for unemployment benefits with Washington ESD. My supervisor said it was due to performance issues but I feel like they never gave me proper training or feedback. I've been working there for 8 months and this is my first time dealing with unemployment. Can you get benefits if you were fired instead of laid off? I really need the income while I look for another job.

Yes, you can potentially get unemployment even after being fired, but it depends on the reason. Washington ESD will determine if you were terminated for 'misconduct' or just poor performance. Performance issues usually don't disqualify you unless it was willful misconduct or deliberate violation of company policy.

•That's a relief to hear. They said it was performance but I honestly think they just didn't want to train me properly. Should I mention that when I file my claim?

•Definitely be honest about your side of the story when you file. Washington ESD will contact your employer to get their version too, then make a determination.

File immediately! Even if they deny you initially, you can appeal. I got fired from my retail job for being late too many times (my car kept breaking down) and they initially denied my claim. But I appealed and won because I could prove the car issues were beyond my control.

•How long did the appeal process take? I'm worried about going without income for too long.

•About 6 weeks total, but they paid me retroactively once I won the appeal. Just make sure to keep filing your weekly claims even during the appeal.

The key distinction Washington ESD looks for is whether you were fired for misconduct or just not being a good fit. Things like theft, fighting, or deliberately violating safety rules = misconduct = no benefits. Poor performance, personality conflicts, or not meeting productivity standards usually don't count as misconduct.

•They never accused me of anything like theft or safety violations. Just said I wasn't meeting their expectations for productivity.

•That sounds like it shouldn't disqualify you then. File your claim and let Washington ESD make the determination.

I had a similar situation and couldn't get through to Washington ESD for weeks to check on my claim status. If you run into that problem, there's a service called Claimyr (claimyr.com) that can help you actually reach an agent. They have this demo video that shows how it works: https://youtu.be/7DieNd3C7zQ. Saved me so much frustration.

•I'll keep that in mind if I have trouble getting through. Right now I just want to get my initial claim filed.

•Is that service legit? Seems too good to be true that they can actually get you through to Washington ESD.

•Yeah it's real. I was skeptical too but it actually worked. Way better than sitting on hold for hours just to get hung up on.

ugh the whole system is so stressful when you're already dealing with losing your job! but definitely file ASAP even if you're not sure if you qualify. better to file and get denied than not file at all

When you file, make sure you have all your employment information ready - dates of employment, reason for separation, your employer's contact info. The more complete information you provide upfront, the smoother the process usually goes.

•Good point. I still have my last pay stub with all the company details.

•Also make sure to file online through the SecureAccess Washington portal. It's way faster than trying to do it over the phone.

Just went through this myself. Got fired for 'attitude problems' which was really just me questioning their unsafe practices. Filed for unemployment and got approved after they investigated. Washington ESD was pretty fair about it.

•How long did the investigation take?

•About 3 weeks. They called me and my former employer separately to get both sides of the story.

Whatever you do, don't wait! There's a time limit on when you can file after losing your job. I think you have to file within a certain timeframe or you lose out on some benefits.

•You should file within the first week after becoming unemployed to avoid losing any potential benefits. You can file for the week you lost your job.

•Good to know. I'll file this weekend then.

I got fired for being 5 minutes late once too often (even though I stayed late almost every day to finish work). Still got unemployment because Washington ESD said it wasn't willful misconduct. Don't let your employer scare you into thinking you can't get benefits.

•That gives me hope. My situation sounds similar - they said performance but I was really trying my best.

Make sure you're prepared for them to contact your employer. Some employers will try to fight your claim even when they don't have good grounds. Just stick to the facts about what happened.

•Will they tell me what my employer says about why I was fired?

•If there's a dispute, you'll usually get to see their response and have a chance to respond to it.

One more thing - even if you get approved, make sure you understand the job search requirements. You have to actively look for work and report it on your weekly claims. Keep good records of where you apply.

•How many jobs do I need to apply to each week?

Sean Flanagan
•I think it's 3 job contacts per week, but check the Washington ESD website for the current requirements. They can change.

Same boat here! Got 'let go' last month for not fitting their company culture (whatever that means). Filed immediately and got approved. The investigation process was nerve-wracking but fair.

•Company culture seems like such a vague reason to fire someone. Glad you got approved though!

Just wanted to follow up on the Claimyr thing - I used them again last week when I had questions about my continued claim and got through to an agent in like 10 minutes. If you end up needing to talk to someone at Washington ESD about your claim, it's seriously worth checking out.

•How much does something like that cost?

•I'm not sure about exact pricing but it was worth it for me to avoid the hours of frustration trying to get through on my own.

Pro tip: when you file your claim, be very specific about the circumstances of your termination. Don't just say 'performance issues' - explain what specifically happened, what training you received or didn't receive, etc.

•That's good advice. I should probably write down all the details while they're still fresh in my memory.

honestly Washington ESD is pretty reasonable about these things. I've seen people get benefits after being fired for way worse reasons than performance issues. Just be honest and file your claim.

•Thanks, that makes me feel more confident about filing.

Final reminder - make sure to file your weekly claims every week even if your initial claim is still being processed. You can't go back and claim those weeks later if you miss filing them.

Diego Flores
•Good point. I'll set a reminder on my phone to do the weekly claims every Sunday.

Good luck with everything! Being fired sucks but at least Washington ESD tries to be fair about determining eligibility. You'll probably be fine given what you've described.

Just make sure you have a backup plan in case it takes a while to get approved. The process can sometimes drag on longer than expected, especially if your employer disputes the claim.

•Yeah I'm trying to cut expenses and see if family can help out if needed. Thanks for the reality check.

One last thing - if you do get denied initially, don't give up! The appeal process exists for a reason and lots of people win on appeal even after being denied the first time.

Diego Flores
•I'll definitely keep that in mind. Sounds like persistence is key with this whole process.
