Can I apply for Washington ESD unemployment if I got fired from my job?

I was terminated from my warehouse job last Friday after working there for 8 months. My supervisor said it was due to performance issues but I feel like they never gave me proper training or feedback. I'm not sure if I can even apply for unemployment benefits through Washington ESD since I was fired rather than laid off. Does anyone know if being fired automatically disqualifies you from getting UI benefits? I really need the income while I look for another job.

You can definitely apply for unemployment even if you were fired. Washington ESD looks at the specific reason for termination. If you were fired for misconduct connected to work, you might be disqualified, but performance issues usually don't count as misconduct. I'd recommend filing your claim ASAP since there's a waiting period.

Thank you! That's a relief. What exactly counts as misconduct? I was never written up or anything formal like that.

Misconduct typically means willful violations of company policy, like theft, fighting, or repeatedly ignoring direct orders. Poor performance or lack of skills usually isn't considered misconduct.

File your claim right away! Even if they try to contest it, you can appeal. I got fired from my retail job for being late too many times and still got approved for benefits after the adjudication process.

How long did the adjudication take? I'm worried about how I'll pay my bills while waiting.

0 coins

Mine took about 3 weeks. The key is to file immediately and keep filing your weekly claims even during adjudication.

I had a similar situation and had trouble getting through to Washington ESD to check on my claim status. If you run into that problem, I found this service called Claimyr that helped me actually reach an agent. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Made a huge difference when I needed to explain my termination situation.

That's really helpful, thanks! Did they charge you a lot for that service?

0 coins

They focus on value rather than cost - honestly worth it when you can't reach anyone the normal way. Check out claimyr.com for more info.

I've heard good things about that service too. Sometimes you just need to talk to a real person to get things sorted out.

Whatever you do, be completely honest on your application about why you were terminated. Washington ESD will contact your employer anyway, so any discrepancies will hurt your case. I made that mistake and it delayed my benefits for weeks.

0 coins

Good point. Should I mention that I feel the firing was unfair or just stick to the facts?

0 coins

Stick to facts on the application. You can provide more context during the adjudication interview if needed.

The Washington ESD system is so frustrating! I got fired for supposedly not meeting sales targets but my manager never told me what the actual targets were. Still waiting 2 weeks for someone to review my case. This whole process makes me want to scream!!!

0 coins

Hang in there! The system is definitely broken but most people eventually get their benefits if they were wrongfully terminated.

0 coins

Thanks, I hope so. Just worried about my rent payment next month if this drags on much longer.

I work in HR and see this all the time. Performance-based terminations rarely result in UI disqualification unless there was documented misconduct. Make sure you document everything about your termination and any performance discussions you had.

0 coins

I wish I had kept better records. I don't have any written documentation of the performance issues they mentioned.

0 coins

That actually works in your favor - if they didn't document performance problems, it suggests they didn't follow proper progressive discipline procedures.

0 coins

Exactly! My employer couldn't provide any documentation when Washington ESD contacted them, which helped my case.

Update: I filed my claim online this morning and it went through without any immediate issues. Now I'm just waiting to hear back about whether my employer will contest it. Thanks everyone for the encouragement to apply!

Great job filing quickly! Remember to keep filing your weekly claims even if the initial claim is under review.

0 coins

Good luck! Hope it goes smoothly for you.

Been there! Got terminated for 'attitude problems' which was basically just me asking questions about unclear instructions. Washington ESD approved my benefits after a brief adjudication. Don't let employers intimidate you out of applying.

0 coins

That sounds similar to my situation. Did you have to do a phone interview during adjudication?

0 coins

Yes, they called me and asked about the circumstances. Just be honest and explain your side of things clearly.

0 coins

Quick question - do you have to actively look for work while your claim is being adjudicated? I'm in a similar boat and not sure about the job search requirements.

0 coins

Yes, you need to meet the job search requirements and keep a log of your activities. Usually 3 job search activities per week in Washington.

0 coins

Thanks! I'll make sure to track everything properly.

The whole unemployment system needs an overhaul but at least Washington ESD is better than some other states. I got fired from my manufacturing job for safety violations that weren't even my fault and still got benefits after explaining the situation.

0 coins

Safety violations sound more serious though. How did you prove it wasn't your fault?

0 coins

I had coworker statements and showed that the safety equipment was faulty. Documentation is key for these cases.

0 coins

Don't give up if your initial claim gets denied! I was denied at first because my employer lied about why I was fired, but I appealed and won. The appeal hearing was actually pretty straightforward.

0 coins

How long did the appeal process take? I'm hoping it doesn't come to that but good to know it's an option.

0 coins

About 6 weeks total, but I got backpay for the whole period once I won. Definitely worth fighting for if you're in the right.

0 coins

Another option if you can't reach Washington ESD directly - I used Claimyr recently and they got me connected to an agent within minutes instead of hours of busy signals. Really helped when I needed to clarify something about my termination.

0 coins

Is that service legit? Seems too good to be true that they can actually get you through to ESD.

0 coins

Totally legit! They have a demo video that shows exactly how it works. Saved me so much frustration trying to call on my own.

0 coins

Just want to add that if you do get approved, don't forget about the job search requirements! You need to log 3 activities per week and be ready to show your log if asked. Some people get benefits suspended for not following those rules.

0 coins

Good reminder! What counts as a valid job search activity?

0 coins

Applying for jobs, attending job fairs, networking events, interviews, updating your resume. Washington ESD has a list on their website.

0 coins

ugh i got fired too and my claim has been pending forever. this system is so slow and confusing. at least you guys are giving good advice here

0 coins

Hang in there! It's frustrating but most claims do get resolved eventually.

0 coins

thanks, just hard when bills are piling up and no idea when i'll hear back

0 coins

Former Washington ESD worker here - performance-related terminations are rarely considered misconduct unless there was willful disregard of job duties. The fact that you weren't formally written up actually helps your case significantly.

0 coins

That's really reassuring coming from someone who worked there! Any other tips for getting through the process smoothly?

0 coins

Be patient, keep detailed records, and don't take delays personally. The system is overloaded but generally fair in the end.

0 coins

Whatever happens, make sure you file your weekly claims on time every week! Even if your initial claim is under review, you need to keep filing to preserve your benefit weeks. I learned that the hard way.

0 coins

Good to know! I was wondering about that. Do I file even if I haven't been approved yet?

0 coins

Yes, absolutely! You can file weekly claims while your initial claim is being adjudicated. You'll get backpay if approved.

0 coins

The key thing is timing - file as soon as possible after your termination. There's a one-week waiting period anyway, so the sooner you file, the sooner you can potentially start receiving benefits. Don't second-guess yourself about whether you qualify.

0 coins

I filed the same day I saw this thread, so hopefully that helps with timing. Thanks everyone for all the advice!

0 coins

Smart move! Wishing you the best with your claim.

0 coins

Final thought - even if Washington ESD seems intimidating, they're actually pretty reasonable if you were fired for performance rather than misconduct. I've seen way more people get approved than denied for these types of situations. Stay positive!

0 coins

Thank you! This whole thread has been incredibly helpful and made me feel much more confident about the process.

This community is great for support during tough times. Hope everything works out for you!

0 coins

Definitely! And remember, if you need to actually speak with someone at Washington ESD, services like Claimyr can really help cut through the phone system frustrations.
