Washington ESD unemployment eligibility if you're fired - what qualifies?
Got terminated from my warehouse job last Friday and I'm not sure if I can even apply for unemployment benefits through Washington ESD. My supervisor said it was for 'performance issues' but honestly I think they just wanted to get rid of me because I'd been there 3 years and was making more than the new hires. Does being fired automatically disqualify you from UI benefits in Washington? I've never filed for unemployment before and don't want to waste time applying if I'm not eligible.

Being fired doesn't automatically disqualify you from Washington ESD unemployment benefits. It depends on WHY you were fired. If it was for misconduct, then yes you'd be disqualified. But if it was for performance issues, attendance problems, or just not being a good fit, you can still qualify. You should definitely apply and let Washington ESD make the determination.

•Thanks! What exactly counts as 'misconduct' though? I was never written up for anything serious.

•Misconduct usually means things like theft, violence, insubordination, or willfully violating company policy. Poor performance or not meeting expectations typically doesn't count as misconduct.

You should apply regardless. Even if your employer contests it, you can appeal any disqualification. I got fired from my retail job for being late too many times and still got approved for UI after explaining my situation during the adjudication process.

•How long did the adjudication take? I'm worried about going weeks without any income.

•Mine took about 3 weeks but that was during COVID. Normal times it's usually 1-2 weeks for adjudication decisions.

I had a similar situation where I couldn't get through to Washington ESD to check on my claim status after being fired. Spent hours calling and either got busy signals or got disconnected after waiting on hold. Found this service called Claimyr that calls Washington ESD for you and gets you connected to an actual agent. Check out claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows exactly how it works.

•Is that legit? Sounds too good to be true.

•Yeah it's real. I was skeptical too but it actually worked. Got through to Washington ESD in like 20 minutes instead of spending all day redialing.

•I used Claimyr too when my claim was stuck in adjudication. Saved me so much frustration trying to get answers about why I was disqualified.

The key thing is to be honest on your application about why you were terminated. Washington ESD will contact your employer anyway, so don't try to hide anything. If they fired you for performance and not misconduct, you should be fine.

•Should I mention that I think they were just trying to save money by getting rid of higher-paid employees?

•Stick to the facts about what they told you. Don't speculate about their motives unless you have actual evidence.

ugh the washington esd system is so confusing!! i got fired from my job at target for missing too many shifts but i was having car trouble. do you think that counts as misconduct? im scared to apply because what if they deny me and then i cant reapply later?

Evelyn Xu
•You can always appeal a denial, so apply anyway. Missing shifts due to transportation issues isn't necessarily misconduct if you were trying to resolve the problem.

•ok thank you!! i didnt know you could appeal. going to apply tonight

From what I understand, Washington ESD looks at whether your termination was due to willful misconduct connected to your work. Things like poor performance, lack of skills, or good faith errors usually don't disqualify you. But deliberate violations of company policy or criminal behavior would.

•That makes sense. My situation was definitely performance-related, not anything intentional.

I got fired for supposedly 'not following procedures' but really my manager just didn't like me. Still got my unemployment approved after adjudication. Washington ESD seems pretty fair about distinguishing between actual misconduct and employers just making excuses.

•How did you explain your side during adjudication?

The Boss
•They did a phone interview where I explained that I was following the procedures I was trained on and never received clear correction. Be prepared to give specific examples.

Make sure you apply as soon as possible! There's a waiting period before benefits start, and you can't get paid for weeks before you actually file your claim. Even if there's adjudication, the process starts when you apply.

•Good point! I'll apply tomorrow morning. Do I need any specific documents?

•You'll need your Social Security number, previous employer info, and details about your termination. The online application walks you through everything.

THE WHOLE SYSTEM IS RIGGED AGAINST WORKERS! I got fired for 'attitude problems' which was really just me standing up for myself when my boss was being abusive. Of course Washington ESD sided with the employer initially but I appealed and won. Don't let them intimidate you!

•Did you have to go to a hearing for your appeal?

Evan Kalinowski
•Yes, had a phone hearing with an administrative law judge. Was actually pretty straightforward once I got to tell my side of the story.

Here's the thing - even if your employer contests your claim, that doesn't mean you'll be denied. Washington ESD makes the final determination based on state law, not what your employer wants. They look at the specific circumstances of your termination.

•This is so true! My old company tried to claim I was fired for misconduct but Washington ESD saw right through their BS excuse.

Quick question - if you get approved for unemployment after being fired, do you still have to do the job search requirements? I'm planning to start looking right away but wondering about the formal requirements.

Evelyn Xu
•Yes, you still need to complete your weekly job search activities and log them. Being fired doesn't change the ongoing eligibility requirements.

•Got it, thanks! Better to be prepared.

My brother went through this exact situation last year. Got fired from his construction job for 'safety violations' that were really just normal accidents. Took about a month to get approved but he did get his benefits. The key is providing your version of events clearly.

•A month seems like a long time when you have bills to pay.

Oscar Murphy
•Yeah it was tough but he got backpay for the whole period once approved. Worth fighting for.

Another tip - if you do need to talk to Washington ESD about your claim status or adjudication, Claimyr can save you hours of calling. I used it when I needed to provide additional information about my termination and got through immediately instead of waiting all day.

•I'll definitely check that out if I run into problems reaching them.

Performance issues are usually not considered misconduct unless you were deliberately performing poorly despite warnings and training. Sounds like you have a good case for benefits.

•That's reassuring. I was trying my best, just struggled with some of the new procedures they implemented.

dont overthink it just apply! worst case they say no and you appeal. i got fired for 'insubordination' which was really just me asking questions about unsafe working conditions and still got approved after explaining the situation

•You're right, I'm probably overthinking this. Going to apply first thing tomorrow.

Washington ESD has pretty clear guidelines about what constitutes misconduct for disqualification purposes. Generally it has to be something that shows willful disregard for the employer's interests or deliberate violation of reasonable workplace standards.

Sophia Russo
•Where can I find those specific guidelines? Might be helpful to review them.

•Check the Washington ESD website under 'Eligibility Requirements' - they have detailed information about misconduct standards.

I work in HR and see these cases all the time. Unless there was theft, violence, or blatant policy violations, most terminations don't rise to the level of misconduct that would disqualify someone from unemployment benefits.

•That's really helpful insight from someone who sees this from the employer side.

•Agreed. Most employers contest claims automatically but that doesn't mean they'll win.

One more thing - make sure you keep all documentation about your termination. If there's adjudication or an appeal, having emails, write-ups, or other records can be really helpful in presenting your case.

•Good thinking. I'll gather up everything I have from my time there.

Just wanted to echo what others said about Claimyr - when my adjudication was taking forever and I couldn't get through to Washington ESD, they got me connected to an agent who explained exactly what additional info was needed. Definitely worth using if you hit roadblocks.
