Can you get unemployment benefits if you get fired - Washington ESD eligibility question
Got terminated from my warehouse job last Friday and I'm trying to figure out if I can even apply for unemployment through Washington ESD. My supervisor said it was due to 'performance issues' but honestly I think they were just looking for reasons to let people go. I've been working there for almost 2 years with no major problems until recently when they started micromanaging everything. Does getting fired automatically disqualify you from UI benefits in Washington? I've never filed before and don't want to waste time applying if I'm not eligible.

You can still qualify for unemployment even if you were fired, it depends on the reason. Washington ESD distinguishes between being fired for 'misconduct' vs other reasons. Performance issues usually don't count as misconduct unless it was willful or you ignored repeated warnings.

•That's good to hear. They did give me a couple verbal warnings about productivity but nothing written. Should I mention that in my application?

•Yes, be honest in your application. Washington ESD will contact your employer to get their side of the story anyway. If it was just performance and not something like theft or insubordination, you should be fine.

I got fired from my retail job 6 months ago for being late too many times and still got approved for benefits. The key is whether it was misconduct or not. Poor performance usually isn't considered misconduct by Washington ESD standards.

•How long did it take to get approved? I'm worried about the waiting period.

•Mine took about 3 weeks but that included adjudication. They had to investigate the circumstances of my termination before approving.

File immediately don't wait. Even if there's a question about eligibility, Washington ESD needs time to process and investigate. You can always appeal if they deny you initially. I had to call them multiple times during my case but couldn't get through the phone lines for weeks. Finally used this service called Claimyr (claimyr.com) that helped me reach an actual agent. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

•Thanks for the tip about filing right away. How does that Claimyr thing work exactly?

•It basically calls Washington ESD for you and connects you when an agent picks up. Saved me hours of trying to get through myself.

DEFINITELY apply! I was convinced I wouldn't qualify because I got fired but turns out my employer couldn't prove misconduct. Washington ESD approved my claim after adjudication period. The worst they can do is say no but at least you'll know for sure.

•This is encouraging. I'm in a similar situation and was scared to even try applying.

•Don't let fear stop you. I almost didn't apply and would have missed out on months of benefits I was entitled to.

The Washington ESD handbook says misconduct has to be a willful violation of job duties or standards. Just being bad at your job or making mistakes isn't usually enough for them to deny benefits. Your employer has to prove you deliberately did something wrong.

•That makes sense. I wasn't deliberately doing anything wrong, just couldn't keep up with their new productivity requirements.

•Exactly, and if they changed requirements recently without proper training that actually helps your case.

One thing to remember is that even if you're approved, there might be a waiting period depending on the circumstances. But definitely worth applying to get the process started.

•What kind of waiting period? I really need the income as soon as possible.

•There's always a one week waiting period for everyone. Sometimes longer if they need to investigate misconduct allegations.

i got fired last year for attendance issues and still got UI after they investigated. took forever to get someone on the phone at washington esd though, kept getting busy signals

•That's what I'm worried about. Everyone says the phone lines are impossible.

•That's exactly why I mentioned Claimyr earlier. Game changer for actually reaching someone at Washington ESD.

Your employer will likely contest the claim if they think they can prove misconduct, so be prepared for that possibility. But don't let it discourage you from applying. Many employers contest automatically even when they don't have strong grounds.

•What happens if they contest it? Do I need a lawyer or anything?

Jamal Harris
•No lawyer needed. Washington ESD will schedule a hearing and you can represent yourself. Just bring any documentation you have about your termination.

Been through this exact situation twice unfortunately. First time I didn't apply thinking I was automatically disqualified for being fired. Second time I applied immediately and got benefits. Learn from my mistake!

•Wow, I'm glad you shared that. I was definitely leaning toward not applying.

•Yeah don't make my mistake. Let Washington ESD decide, don't decide for them.

Make sure you have all your employment information ready when you apply - dates of employment, reason for separation, supervisor names, etc. Washington ESD will need all those details for the initial application.

•Good point, I should gather all that info before starting the application.

•Also keep records of your job search activities right away. You'll need those for your weekly claims.

The online application is pretty straightforward but make sure you're honest about everything. They will verify information with your employer so any inconsistencies will cause problems later.

•Definitely planning to be completely honest. Not worth the risk of lying.

•Smart approach. Washington ESD takes fraud seriously but they're fair if you're truthful from the start.

Don't stress too much about it. I know several people who got fired and still received unemployment. As long as it wasn't for gross misconduct you should be fine.

•Yeah most terminations don't rise to the level of misconduct that would disqualify you.

One more thing - if you do get stuck trying to reach Washington ESD by phone, seriously consider that Claimyr service I mentioned. I was skeptical at first but it really works for getting through their phone system.

•Is there a cost for using that service?

•They don't make you pay upfront or anything sketchy. Worth checking out their demo video to see how it works.

Applied online last week after getting terminated for 'not meeting expectations' and already got my first payment. Don't overthink it, just apply and let the process work.

Aisha Mahmood
•That's really encouraging! Sounds like performance issues don't automatically disqualify you.

•Nope, they really do look at each case individually. Washington ESD was actually pretty fair about it.

The unemployment system exists for situations exactly like yours. You paid into it through your payroll taxes so you've earned the right to apply. Don't let employer intimidation keep you from claiming benefits you're entitled to.

Aisha Mahmood
•You're absolutely right. I did pay into the system so I should at least try to use it.

File tonight if you can. The sooner you apply the sooner you'll know if you qualify. Even if there's an adjudication period, at least the clock will be ticking.

•Good advice. I'm going to start the application as soon as I get home from work tomorrow.

•Perfect! And remember to file your weekly claims even during adjudication if they tell you to.

Had a similar experience with micromanaging supervisors who seemed to be building a case. Got fired for 'attitude problems' but Washington ESD saw right through it and approved my claim.

Aisha Mahmood
•That sounds exactly like my situation. They started documenting everything after being hands-off for months.

•Yeah sounds like they were trying to create grounds for termination. Washington ESD investigators can usually tell when that's happening.

Bottom line - Washington ESD wants to help people who lost their jobs through no fault of their own. Being fired for performance isn't your fault unless you were deliberately sabotaging things.
0 coins
Aisha Mahmood
•That's a good way to think about it. I definitely wasn't sabotaging anything, just couldn't meet their new unrealistic standards.

•Sounds like you have a solid case for benefits then. Don't let them make you feel like you don't deserve help.
