Can I claim unemployment if I was fired from my job in Washington?

I got terminated from my warehouse job last Friday and I'm trying to figure out if I can even apply for unemployment benefits through Washington ESD. My supervisor said it was due to 'performance issues' but honestly I think they just wanted to get rid of me because I complained about safety violations. I've been working there for almost 2 years and never had any written warnings or anything formal. Does getting fired automatically disqualify you from UI benefits in Washington? I really need to know before I waste time filing a claim.

You can definitely still apply for unemployment even if you were fired. Washington ESD will look at WHY you were fired to determine if you're eligible. If it was for something like poor performance or not being a good fit, you'll likely qualify. But if it was for misconduct like stealing or fighting, then you'd be disqualified.

That's reassuring, thank you. It definitely wasn't misconduct - just them saying I wasn't meeting expectations even though they never gave me clear goals.

0 coins

Same thing happened to my brother. He got fired for 'performance' but still got approved for benefits after they investigated.

File your claim right away! Don't wait. Even if Washington ESD needs to investigate your separation (which they probably will), you want to get your claim date established. The worst thing that happens is they deny it and you can appeal. But if you wait weeks to apply, you lose that time.

0 coins

Good point about not waiting. Should I file online or call them?

0 coins

Definitely file online at esd.wa.gov - it's way faster than trying to get through on the phone. You'll get a confirmation number and can track your claim status.

I had a similar situation last year where I got fired for 'not fitting in with company culture' which was basically BS. I was worried about applying but decided to anyway. Washington ESD approved my claim after about 3 weeks of adjudication. The key is being honest about what happened when you file.

0 coins

How detailed should I be when explaining what happened? I don't want to write a novel but I want to make sure they understand it wasn't misconduct.

0 coins

Just be factual and stick to the main points. They'll contact your employer too to get their side of the story. If there's a big discrepancy they might call you for more details.

Honestly, trying to reach Washington ESD by phone is a nightmare if you have questions about your claim. I spent literally hours on hold last month. Recently found out about this service called Claimyr that calls them for you and gets you connected to an actual agent. Check out claimyr.com - they even have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Game changer for dealing with ESD phone issues.

0 coins

Is that legit? Sounds too good to be true with how impossible it is to get through to ESD.

0 coins

Yeah I was skeptical too but it actually worked. They handle all the calling and waiting, then patch you through when they get an agent. Way better than spending my whole day redialing.

You mentioned safety violations - if you were fired for reporting workplace safety issues, that could actually strengthen your unemployment case. Retaliation for safety complaints is a big deal and Washington ESD takes that seriously.

0 coins

I did file a complaint with L&I about the safety issues. Should I mention that in my unemployment application?

0 coins

Absolutely mention it. Having documentation from L&I shows you were acting in good faith about legitimate safety concerns.

0 coins

That's a really good point. Retaliation for safety reporting could actually make this a wrongful termination situation.

0 coins

ugh the whole system is so confusing. i got fired from my last job too and had no idea what to do. took me like a month to even figure out i could apply for benefits

0 coins

That's why it's important to apply right away even if you're not sure about eligibility. Better to have them tell you no than to miss out on weeks of benefits.

Performance issues vs misconduct is the key distinction. I work in HR and I've seen plenty of people get approved for UI after being terminated for performance. Washington ESD basically looks at whether you did something intentionally wrong or if you just weren't meeting job requirements.

0 coins

That makes sense. I definitely wasn't doing anything intentionally wrong, just had different ideas about how to do the job efficiently.

0 coins

Sounds like a classic case where you should qualify then. Performance terminations usually don't disqualify you from unemployment.

Make sure you file within the first week after losing your job. There's a waiting period anyway so the sooner you get the process started the better. And be prepared for them to potentially contact your former employer - that's standard procedure for any termination.

0 coins

Good to know about the waiting period. How long is it typically?

0 coins

Ev Luca

There's a one week waiting period before you can receive benefits, but that's after your claim is approved. The investigation can take 2-4 weeks depending on how complex your situation is.

0 coins

I'm going through something similar right now. Got 'laid off' but I think it was really because I was making too much money for what they wanted to pay. Filed my claim two weeks ago and it's still in adjudication. The waiting is killing me.

0 coins

How do you check the status of your claim? Do they send updates or do you have to log in somewhere?

0 coins

You can check on the ESD website with your account. It'll show if it's pending, in adjudication, approved, etc. They also send letters to your address with updates.

0 coins

Just want to add that even if your initial claim gets denied, you can appeal the decision. I had to do that when they initially said my termination was for misconduct but I was able to prove it wasn't. The appeal process took a while but I eventually got approved and received back pay.

0 coins

That's encouraging to know there's an appeal option. How long did the whole appeal process take?

0 coins

About 6 weeks from filing the appeal to getting the decision. But I got all the back benefits once it was approved, so it was worth fighting for.

Another thing - start looking for work right away and keep track of your job search activities. Washington has work search requirements that kick in after a few weeks, and you'll need to show you're actively looking for employment.

0 coins

Do I need to prove I'm job searching from day one or does that start later?

0 coins

It typically starts after your first few weeks of benefits, but it's good to start documenting your job search activities right away just in case.

0 coins

WASHINGTON ESD is so backed up right now. I've been trying to get through to ask about my adjudication for weeks. Might have to try that Claimyr thing someone mentioned earlier because this is ridiculous.

0 coins

Seriously, Claimyr saved me so much time and frustration. Worth checking out if you need to actually talk to someone at ESD.

0 coins

I'm skeptical of any service that charges to help with government benefits, but if it actually works...

Document everything from your termination - save emails, notes from meetings, anything that shows the circumstances around why you were fired. If ESD needs more information during their investigation, having that documentation ready will help your case.

0 coins

I still have access to my work email for a few more days. Should I save relevant emails now before they shut off my access?

0 coins

Yes, absolutely save anything that might be relevant to your termination while you still can access it.

My cousin got fired for performance issues at his retail job and still got unemployment. The company tried to fight it but ESD sided with him because there was no evidence of willful misconduct. Performance problems happen but that doesn't mean you did anything wrong on purpose.

0 coins

That's exactly my situation - no evidence of misconduct, just them saying I wasn't performing well enough.

0 coins

Whatever you do, don't let them pressure you into saying you quit. I've heard of employers trying to get people to 'resign' instead of being fired because it makes their unemployment insurance rates look better. Stand your ground that you were terminated.

0 coins

They definitely fired me, no question about that. Good to know that distinction matters for the claim though.

0 coins

Yeah, quitting vs being fired makes a huge difference for unemployment eligibility. Always be honest about which one actually happened.

0 coins

One more tip - when you file weekly claims (if your initial claim gets approved), make sure you answer all the questions honestly. They ask things like if you worked any hours or earned any money that week. Being dishonest on those can get you in trouble later.

0 coins

Good to know about the weekly filing requirements. I haven't gotten that far yet but I'll keep that in mind.

0 coins

Bottom line - you have nothing to lose by applying. Worst case scenario they deny it and you're in the same position you are now. Best case you get approved and have some income while you look for your next job. File that claim ASAP.

0 coins

You're absolutely right. I'm going to file online today. Thanks everyone for all the helpful advice!

0 coins

Good luck! Hope your claim goes through smoothly.

Just saw this thread and wanted to mention that if you do need to contact Washington ESD for any reason about your claim, I had success with Claimyr recently. They basically handle the phone hassle for you - you just tell them what you need to discuss and they get you connected to an actual ESD representative. Super helpful when you can't afford to spend hours on hold.

0 coins

I'll definitely keep that in mind if I run into issues with my claim. Thanks for the tip!

Update us on how your claim goes! Always interested to hear how these situations work out since there's so much confusion about what qualifies for unemployment benefits.

0 coins

Will do! I'll try to remember to post an update once I know whether my claim gets approved or not.
