Can I get Washington ESD unemployment if I was terminated from my job?
I got fired from my warehouse job last Friday and I'm not sure if I can even apply for unemployment benefits. My supervisor said I was terminated for 'performance issues' but honestly I think it was because I complained about unsafe working conditions. I've been working there for 8 months and never had any formal write-ups. Can I still file for unemployment with Washington ESD if I was terminated? I really need the income while I look for another job.

Yes, you can definitely apply for unemployment even if you were terminated. Washington ESD will determine if your termination was for 'misconduct' or not. Performance issues usually don't qualify as misconduct unless it was willful or deliberate. File your claim as soon as possible since there's a waiting period.

•Thank you! I was worried I couldn't even apply. Should I mention the safety complaint I made or just focus on the performance stuff?

•Definitely mention the safety complaint - that could be important if they try to say you were fired for misconduct. Document everything you can remember.

I got fired too and still got approved for UI benefits. The key is that Washington ESD looks at whether you were fired for misconduct or just because you weren't a good fit. Performance issues without willful negligence usually don't disqualify you.

•How long did it take for them to make a decision on your claim?

Amara Adeyemi
•About 3 weeks, but that was because my employer contested it and it went to adjudication. If your employer doesn't fight it, could be faster.

File immediately and be completely honest about why you were terminated. I've seen people get denied because they weren't truthful on their application. Washington ESD will contact your employer anyway to get their side of the story.

•Good point. I'll be honest about everything when I file online.

•Exactly this. I tried to fudge the details once and it came back to bite me. Always tell the truth on these applications.

If you're having trouble getting through to Washington ESD to check on your claim status or ask questions, I recently found this service called Claimyr (claimyr.com) that helps you actually reach a human agent. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Really helped me when I was stuck in adjudication limbo.

•How much does something like that cost? I'm already tight on money.

•It's worth checking out their site for details, but honestly it saved me weeks of trying to get through on my own. Sometimes you need to talk to a real person to sort things out.

The whole system is rigged anyway. They'll find any excuse to deny your claim even if you were wrongfully terminated. Employers lie all the time and Washington ESD just believes whatever they say.

•That's not really true. I've seen plenty of people win their appeals even when employers contested. You just need to provide evidence and be persistent.

•Maybe you got lucky. I've been fighting them for months over my disqualification.

Update: I filed my claim online and it went through. Now it says 'pending' on my account. How long does it usually take to hear back from them?

Liam O'Connor
•Could be anywhere from a few days to several weeks depending on if they need to investigate. Keep filing your weekly claims even while it's pending.

•Don't forget to register with WorkSource Washington too - that's required for keeping your benefits.

I was fired for attendance issues and still got unemployment. As long as it wasn't willful misconduct you should be fine. Performance problems are different from deliberately doing something wrong.

•That makes me feel better. I really was trying my best at that job, just couldn't meet their unrealistic quotas.

•Unrealistic quotas could actually work in your favor if you can document that they were setting impossible standards.

Whatever you do, don't quit your next job without having another one lined up. I made that mistake and learned the hard way that voluntary quits are way harder to get approved for UI.

•Good advice. I'm definitely going to be more careful about my next position.

Just went through this exact situation. Got fired for 'not meeting expectations' but it was really because I refused to work unpaid overtime. Took about 2 weeks to get approved. The safety complaint angle might actually help your case.

•Did you have to do an interview with Washington ESD or did they just approve it automatically?

•They called me once to ask some questions about the circumstances, then approved it a few days later.

Check your email regularly for any requests from Washington ESD. They sent me a fact-finding questionnaire that I almost missed and it would have delayed my claim.

•Will do! I've been checking my SecureAccess Washington account daily.

•Also check your regular email, not just the ESD portal. Sometimes they send important stuff there too.

If you end up needing to speak with someone at Washington ESD about your termination case, that Claimyr service I mentioned earlier really does work. I was skeptical at first but they got me through to an actual adjudicator who explained exactly what documentation I needed for my appeal.

•I might need that if my claim gets complicated. Good to know there's an option if I can't get through normally.

Document everything about your termination - emails, witness statements, performance reviews, anything that shows you weren't fired for misconduct. I wish I had done this better when I got fired.

•I saved some emails about the safety issues I reported. Hopefully that helps.

•Perfect! That could be really important if they claim you were fired for cause.

been there, got approved after being fired. the worst they can say is no and then you appeal. at least you'll have income while you job hunt

•True, nothing to lose by applying. Thanks for the encouragement!

Make sure you're actively job searching and keeping a log. Washington ESD requires 3 job search activities per week and they do audit this. Don't let that be the reason you lose benefits later.

•I already started applying places. Should I be documenting every application I submit?

•Yes, keep track of where you applied, when, and what type of contact it was. They have a form on the WorkSource website.

The system is so confusing. I got fired and approved but my friend got fired for the same thing and denied. Nobody explains how they make these decisions.

•It really depends on the specific circumstances and how the employer reports it. Every case is different even if they seem similar.

Another thought - if your employer contests your claim, don't panic. That's normal and doesn't mean you'll be denied. Just respond to any requests for information quickly and honestly.

•I'm kind of expecting them to contest it since they seemed pretty angry when they fired me.

•Even if they do, you still have a good chance based on what you've described. Just be prepared to explain your side.

Hope it works out for you! I was so stressed when I got fired but the unemployment helped me get through until I found something better. Stay positive!

Final tip about Claimyr - if you do end up in adjudication or need to appeal, having someone who can actually get you through to talk to a real Washington ESD representative is invaluable. I wasted so much time trying to call on my own before I found that service.

Just want to add that retaliation for reporting safety issues is illegal and could actually strengthen your unemployment case. Might be worth consulting with an employment lawyer too.

•I hadn't thought about that angle. Might be worth looking into if the unemployment claim gets denied.
