Can you collect unemployment if you are fired from your job in Washington?
I got terminated from my retail job last Friday after working there for 8 months. My manager said it was due to performance issues but I feel like they were looking for reasons to let me go. I've never been fired before and I'm really stressed about money. Can I still file for unemployment benefits with Washington ESD if I was fired? I heard some people say you can't get benefits if you're terminated but others say it depends on the reason. I need to know if I should even bother applying or if I'll just get denied.

You can definitely still apply for unemployment even if you were fired. Washington ESD doesn't automatically disqualify you just because you were terminated. They'll look at whether you were fired for 'misconduct' - things like stealing, violence, or willful violations of company policy. Performance issues usually don't count as misconduct unless you were deliberately not doing your job.

•That's reassuring to hear. They said it was performance but I was honestly trying my best. The metrics they wanted seemed impossible to meet.

•Yeah performance issues are different from misconduct. I got fired for not meeting sales quotas and still got approved for benefits.

Yes, you can absolutely collect unemployment benefits even if you were fired! The key is whether you were terminated for 'misconduct' or not. Performance issues usually don't qualify as misconduct unless it was willful or deliberate. You should definitely file your claim with Washington ESD right away - don't wait.

•Really? That's a relief. What exactly counts as misconduct then? I was never written up or anything, they just said my sales numbers weren't meeting expectations.

•Misconduct has to be willful violation of company policy or deliberately poor performance. Not meeting sales goals when you're trying your best is just poor performance, not misconduct. You should be fine.

File your claim as soon as possible! Even if there's a dispute about the reason for termination, Washington ESD will investigate and make a determination. You'll get a chance to explain your side of the story. The worst thing you can do is not apply at all - you might be eligible and not even know it.

•Good point, I should probably just file and see what happens. How long does the investigation process usually take?

Amina Bah
•It varies but usually 2-4 weeks if there's an adjudication. They'll contact both you and your employer to get the facts.

I was in the same situation last year - got fired from my warehouse job for 'productivity issues' and Washington ESD approved my claim. Like the other person said, there's a big difference between misconduct and just not being good at the job.

•How long did it take for them to approve your claim? I'm worried about the waiting period while they investigate.

•It took about 3 weeks because they had to do an investigation. They contacted my old employer and me to get both sides of the story. Just be honest about what happened when they call.

You need to file immediately! Even if you're not sure if you qualify, it's better to apply and let Washington ESD make the determination. The worst they can do is deny it, but you might be pleasantly surprised. I've been helping people with unemployment claims for years and performance-related terminations usually get approved.

•I've been trying to call Washington ESD all morning but keep getting busy signals or getting hung up on after waiting forever. Is there a better way to reach them?

•The phone system is absolutely brutal right now. I actually discovered this service called Claimyr that helps you get through to Washington ESD agents. Check out claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. It's been a lifesaver for people who need to actually talk to someone.

I was in a similar situation and had trouble getting through to Washington ESD to check on my claim status during the investigation. The phone lines are always busy and I kept getting disconnected. I ended up using this service called Claimyr (claimyr.com) that helps you actually reach a live agent. They have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Really saved me a lot of frustration trying to get answers about my case.

•How much does something like that cost? I'm already stressed about money since I lost my job.

•It's worth it when you need to actually talk to someone at Washington ESD. Way less stressful than calling hundreds of times yourself.

The key thing is whether they can prove misconduct. If it was just performance issues and you were making an honest effort, you should be fine. Make sure you have any documentation that shows you were trying to improve - emails, training records, anything like that.

•I do have some emails where I was asking for help and clarification on the job requirements. Should I submit those?

Javier Cruz
•Absolutely! Those emails show you were engaged and trying to do better. That's the opposite of misconduct.

The Washington ESD determination process looks at several factors when you're fired: was it willful misconduct, did you violate clear company policies, were you given warnings, etc. Performance issues alone usually don't disqualify you unless there's evidence you were deliberately underperforming or ignoring direct instructions.

Kingston Bellamy
•What if they claim you violated company policy but you disagree with their interpretation? Can you still get benefits?
0 coins
Morita Montoya
•Yes, you can appeal if they deny your claim. Washington ESD will review all the evidence and make a determination. If you disagree with that, you can request an administrative law judge hearing.

I got fired from my last job for being late too many times and still got unemployment benefits. Washington ESD said it wasn't misconduct because I had transportation issues and my employer knew about it. Every situation is different.

Alice Pierce
•That gives me hope! Did you have to go through any kind of appeal process or did they approve it right away?

•They approved it after the initial investigation. My employer tried to fight it but Washington ESD sided with me because I had documented my transportation problems with HR.

File your claim online at secure.esd.wa.gov as soon as possible. Don't wait because your benefit year starts from when you file, not when you lost your job. Even if there's an investigation, you want to get that process started immediately.

Alice Pierce
•I'm filling it out now but some of the questions are confusing. Like it asks about 'separation reason' - should I put 'fired' or 'terminated' or something else?
0 coins
Isaiah Cross
•Be honest and specific. Put 'terminated for performance issues' or whatever they told you. Don't try to sugarcoat it - Washington ESD will get your employer's side anyway.

File online at secure.esd.wa.gov as soon as you can. Even if they deny you initially, you can always appeal. I had to appeal my case and ended up winning. The initial determination isn't always final.

•How did the appeal process work? Was it complicated?

•It was actually pretty straightforward. You get a hearing where you can explain your side. Just be honest and have any evidence ready.

Been there done that. Got canned from my retail job for supposedly being late too much but I had documentation showing most of those times were excused. Still had to go through the whole adjudication process but got approved eventually. The waiting was the worst part.

Washington ESD is supposed to give you the benefit of the doubt unless the employer can prove misconduct. That's what I was told anyway. Performance issues usually aren't enough unless you were like deliberately sabotaging things or refusing to do basic job duties.
0 coins
Isabella Costa
•That matches what I've read too. The bar for misconduct is actually pretty high in Washington state.
0 coins
Yara Khoury
•That makes me feel better about applying. I definitely wasn't sabotaging anything, just struggling to keep up with the pace they wanted.

Whatever you do, don't lie on your application! Be honest about being fired and let them sort it out. Lying will definitely get you disqualified and you might have to pay back benefits later.

The unemployment system is set up to protect workers from losing income through no fault of their own. Being bad at your job isn't your fault if you were trying your best. Don't let your employer scare you into thinking you can't get benefits.

•Exactly! Too many people don't even try to file because they think getting fired automatically disqualifies them. That's not how it works.

I used to work in HR and I can tell you that most employers don't even bother responding to Washington ESD's requests for information unless it was a really serious case. If they fired you for vague performance reasons they might not even fight your claim.

Yara Khoury
•Really? That's interesting. My company seemed pretty disorganized so maybe they won't respond.

•Yeah a lot of smaller companies especially just don't have the bandwidth to deal with unemployment claims unless it was like theft or something major.

Just a heads up - even if you get approved, you'll still need to do job searches and all that. Don't forget about those requirements while you're dealing with the adjudication stuff.

File ASAP because there's a waiting period anyway. Even if you're eligible, you won't get paid for the first week. So the sooner you apply, the sooner that waiting week is over with.

Been fired twice and got unemployment both times. First time was for attendance, second time was performance. As long as you weren't stealing or fighting or something crazy, you'll probably be fine. The system is set up to help people who lost their jobs through no major fault of their own.

Make sure you file within the first week after being terminated if possible. You can backdate a little bit but it's easier if you file right away. Also keep records of everything - when you were fired, what they said, any paperwork they gave you.

Yara Khoury
•I should probably file this week then since it just happened Friday. I do have the termination paperwork they gave me.

One more thing - if you do get into an adjudication situation and need to talk to Washington ESD, I had good luck with that Claimyr service too. Way better than trying to call on your own. They actually got me through to someone who could explain what was happening with my case.

Bottom line - apply and let them decide. You'll never know if you don't try, and you might be leaving money on the table if you're actually eligible. Performance issues usually aren't misconduct unless you were deliberately not doing your job or violating clear policies.

Washington ESD investigates all terminations to determine if misconduct was involved. They'll contact both you and your employer to get statements. Just be completely honest about what happened and provide any documentation you have.
0 coins
Alice Pierce
•What kind of documentation should I gather? I don't have any performance reviews or anything like that.

I used to work in HR and I can tell you that most employers don't fight unemployment claims that hard unless there was clear misconduct like theft or violence. Performance issues are usually not worth their time to contest.
0 coins
Christian Burns
•That's interesting. Do you think retail employers are more likely to contest claims than other industries?

•Not really. Most retail companies have high turnover and expect some performance-related terminations. They usually only fight claims for misconduct or policy violations.

Whatever you do, don't lie on your application. Washington ESD cross-references everything with your employer and getting caught in a lie will definitely disqualify you. Honesty is always the best policy with unemployment claims.
