Can you collect unemployment after severance pay runs out in Washington?
My company laid me off last month and gave me 8 weeks of severance pay. I'm wondering if I can file for Washington ESD unemployment benefits now or do I have to wait until the severance runs out? I've heard conflicting information about whether severance affects your eligibility. Has anyone dealt with this situation before? I want to make sure I don't mess up my claim by filing at the wrong time.

You can actually file your initial claim right away, but Washington ESD will defer your benefit payments until your severance period ends. The key is to get your claim established early so there's no gap in coverage.

•Oh that's good to know! So I should file now even though I'm getting severance?

Luca Esposito
•Yes, definitely file now. Washington ESD considers severance as wages in lieu of notice, so they'll calculate when your last effective work day was and start benefits after that.

This is correct - severance pay creates what's called a 'waiting period' but doesn't disqualify you from unemployment. Just make sure you report the severance amount accurately when you file your claim with Washington ESD.

•What happens if you don't report the severance correctly? I'm paranoid about making mistakes on my claim.

•If you underreport or don't report severance, Washington ESD will eventually find out through wage records and you could face an overpayment situation. Better to be honest upfront.

I went through this exact situation last year. Filed my claim immediately after being laid off even though I had 6 weeks severance. Washington ESD automatically calculated my waiting period and started my benefits right when the severance ended. Worked perfectly.

•That's reassuring to hear! Did you have any trouble getting through to Washington ESD to confirm everything was set up correctly?

•Actually yes, I couldn't get through on the phone for weeks. Eventually used this service called Claimyr that helped me reach an agent. Check out claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•How does that service work exactly? I've been trying to call Washington ESD for days with no luck.

IMPORTANT: Make sure you understand how your severance is structured. Lump sum severance is treated differently than continued salary payments. If it's continued salary, each payment might affect your weekly claim certification.

Zara Ahmed
•Mine is a lump sum payment. Does that make it easier?

Ethan Wilson
•Yes, lump sum is actually cleaner. Washington ESD will divide it by your weekly salary to determine how many weeks of waiting period you have.

ugh this is so confusing. i got severance too but nobody explained any of this to me. do i need to do anything special with my weekly claims?

•During your severance waiting period, you'll still need to file your weekly claims to keep your claim active, but you won't receive payments until the waiting period ends.

•ok that makes sense i guess. just keep filing even though no money comes in?

Question about job search requirements - do I need to be looking for work during the severance waiting period? Or can I wait until benefits actually start?

Nia Thompson
•You're required to be able and available for work and actively seeking employment from the day you file your claim, even during the severance waiting period.

•Good to know. I was hoping to take a little break before jumping back into job hunting.

Carmen Diaz
•Yeah the job search requirement starts immediately. You need to log your job search activities in WorkSourceWA from day one.

I'm dealing with this right now and it's been a nightmare trying to get clarification from Washington ESD. Every time I call I either get disconnected or sit on hold for hours.

GalaxyGuardian
•That's exactly why I mentioned Claimyr earlier. They basically get you connected to an actual Washington ESD agent without the endless hold times. Worth trying if you're stuck.

•I'll check that out, thanks. At this point I'll try anything to get through to someone who can explain my specific situation.

Just want to add that if you have any vacation pay along with your severance, that's also considered wages and will extend your waiting period further.

Zara Ahmed
•Oh no, I do have accrued vacation being paid out too. How do I calculate that?
0 coins
AstroAce
•Add your vacation payout to your severance total, then divide by your weekly wage. That gives you the total number of weeks you'll be in waiting status.

This whole system is ridiculous. Why make people jump through all these hoops when they just lost their job? The Washington ESD website doesn't explain any of this clearly.

Carmen Diaz
•I agree the system is frustrating, but the rules around severance actually make sense. They don't want people double-dipping on wages and unemployment at the same time.

•I get that, but they could at least make the information easier to find and understand.

Pro tip: keep all your severance documentation handy. Washington ESD might ask for proof of the amount and payment dates during the claims process.

•What kind of documentation do they usually want?

Jamal Brown
•Your termination letter showing severance details, pay stubs, and any HR documents explaining the severance package terms.

does anyone know if cobra payments affect this at all? my company is paying my cobra for 3 months as part of the severance package
0 coins
Luca Esposito
•COBRA payments don't count as wages for unemployment purposes, so they won't extend your waiting period. Only actual wage replacement counts.

•oh good thats one less thing to worry about thanks

I made the mistake of not filing right away when I got severance. By the time I filed, I had already lost several weeks of potential benefit time. Don't wait like I did!

Zara Ahmed
•Yeah that's what I was worried about. Filing this week for sure.

•Same thing happened to my brother. The clock starts ticking on your benefit year whether you file immediately or not.

Question about the monetary determination - will my severance pay be included in the wages they use to calculate my weekly benefit amount?
0 coins
Nia Thompson
•No, severance isn't included in the base period wages used to calculate your weekly benefit amount. Only regular wages from your base period quarters count for that calculation.

CosmicCaptain
•That's a relief. I was worried it might inflate my benefit calculation somehow.

If anyone else is struggling to reach Washington ESD about severance questions, I had success with that Claimyr service someone mentioned earlier. Got connected to an agent in under 10 minutes.

•Really? I've been trying to call for three weeks. How much does that service cost?

Giovanni Rossi
•They don't charge upfront - you just pay after they successfully connect you. Way better than wasting hours on hold every day.

For those filing new claims with severance, make sure you answer the severance question accurately on your initial application. It's one of the first things they ask about.

Zara Ahmed
•Good point. I'll have all my severance paperwork ready when I file online.

•And if you're not sure about any part of it, better to call and ask rather than guess. Wrong information can really mess up your claim.

Just to clarify for anyone reading this - severance creates a waiting period, not a disqualification. You will still get your full unemployment benefits, just delayed until the severance period ends.

StarSurfer
•This is an important distinction. I was worried I wouldn't be eligible at all because of the severance.
0 coins
Dmitry Petrov
•Nope, you're still fully eligible. The severance just acts like you're still employed during that period, then your benefits kick in normally.

•Thanks everyone for all the helpful info. Going to file my claim this week and get everything started.
