Should I wait until my severance pay ends to file a claim for unemployment benefits in Washington?
Got laid off from my tech job 2 weeks ago and they're giving me 8 weeks of severance pay. I'm wondering if I should wait until the severance runs out before filing for Washington ESD unemployment benefits, or if I should file now? I've heard conflicting info about how severance affects your claim timing and I don't want to mess anything up. Anyone know the rules on this?

You should file your claim right away, don't wait! Washington ESD has specific rules about severance pay but it doesn't prevent you from filing. The key is when you're actually separated from employment, not when your severance ends. File within the first week after your job ends to avoid losing potential benefits.

•Really? I thought severance would disqualify me completely. So I can file now even though I'm still getting paid?

•Yes, you report the severance when you file but it doesn't stop you from filing the initial claim. Washington ESD will determine how it affects your weekly benefit amount.

I made this mistake last year - waited until my severance ended and lost out on benefits I could have gotten earlier. File ASAP but make sure you report the severance accurately on your weekly claims.

•Oh no, how much did you lose by waiting? I'm getting nervous I should have filed already.

•Probably around $2000 in benefits I could have received. Don't make the same mistake I did!

File immediately but understand that Washington ESD will likely put your claim in adjudication to review the severance situation. This is normal and can take 2-4 weeks to resolve. During this time you should still file your weekly claims even if you're not getting paid yet.

•What exactly happens during adjudication? Will they contact my former employer?

•Yes, they'll verify your separation details including the severance terms. Just be patient - adjudication delays are super common right now.

•Mine took 6 weeks in adjudication just for severance review. If you need to talk to someone at Washington ESD about your specific situation, I found this service called Claimyr that actually gets you through to a real person. Way better than trying to call yourself. Check out claimyr.com - they even have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works.

The severance will probably delay when you start receiving benefits but won't affect your total benefit amount. Washington ESD treats severance as wages for the period it covers, so you might not get UI payments until it's exhausted.

•So basically I'll get the same total amount just delayed? That actually makes me feel better about the timing.

•Exactly. Think of it like Washington ESD saying 'you're still getting paid from your job during the severance period' even though you're not working.

ugh the whole severance thing is SO confusing. I had 4 weeks severance and Washington ESD made me wait but my coworker with 6 weeks got benefits right away?? Makes no sense

•It depends on how the severance is structured - lump sum vs. continuing salary, continuation of benefits, etc. Each case gets reviewed individually.

•that explains it i guess. mine was lump sum, hers was weekly payments

File now but make sure you understand the job search requirements too. Even during severance review, Washington ESD expects you to be actively looking for work and documenting your search activities.

•Good point - I should start keeping track of applications even before benefits kick in. Do they require a minimum number per week?

•Usually 3 job search activities per week but check your individual requirements when you file. Better to document more than less.

Same situation happened to my brother - 12 weeks severance from Amazon. He filed right away and Washington ESD approved his claim but benefits didn't start until week 13. Still got the full 26 weeks of benefits though.

•That's reassuring to hear. So the benefit weeks don't get eaten up by the severance delay?

Oliver Fischer
•Nope, your benefit year starts when you're eligible to receive payments, not when you file the claim.

Pro tip: if your claim gets stuck in adjudication for weeks like mine did, that Claimyr service I mentioned earlier was a lifesaver. I was able to actually talk to someone at Washington ESD about my severance situation instead of just waiting in limbo. Worth checking out if you run into issues.

•How much does something like that cost? Seems like it might be worth it if adjudication drags on.

•Way less than I expected and definitely worth it for the peace of mind. Beats calling 100 times and never getting through.

Washington ESD's website has gotten better but the severance info is still buried. The main thing is don't delay filing - you can always sort out the details later but you can't backdate a claim if you wait too long.

•Yeah I looked on their site but couldn't find clear info about my specific situation. Sounds like filing ASAP is the consensus here.

•Exactly - when in doubt, file. Worst case they tell you to wait, best case you preserve your filing date.

Filed my claim while getting severance and had zero issues. Just make sure you're 100% honest about the severance amount and dates when you do your weekly certifications. Washington ESD will find out anyway if you're not truthful.

•Good reminder about being honest. I have all the paperwork from my employer so I should be able to report everything accurately.

•Perfect - having the documentation makes everything smoother. Keep copies of everything for your records.

Don't overthink it. File tomorrow morning. I've seen too many people wait and regret it. Washington ESD will figure out the severance piece - that's their job.

•You're right, I'm probably overthinking this. Better to file and let them sort it out than miss out on benefits.

One thing to watch out for - some employers structure severance to try to delay your unemployment eligibility. Make sure you understand exactly how yours is set up and don't just take their word for what it means for your benefits.

•Interesting point. My HR person said I'd need to wait but maybe she doesn't actually know Washington ESD rules.

Malik Robinson
•Exactly - HR knows company policy but not necessarily unemployment law. Let Washington ESD make the official determination.

PLEASE file now! I cannot stress this enough. My wife waited 10 weeks thinking she had to and it was a nightmare trying to get her benefits sorted out. The Washington ESD system is designed to handle severance situations - you just need to get in the queue.

•Wow 10 weeks sounds awful. OK you've all convinced me - filing first thing tomorrow morning!

•Smart move! And remember to keep filing those weekly claims even if you're not getting paid yet during adjudication.

Quick question - will filing for unemployment while on severance affect my health insurance continuation or anything like that?
0 coins
StarSailor
•No, unemployment benefits are completely separate from COBRA or other employment-related benefits. One doesn't affect the other.

•Thanks for clarifying that. I was worried there might be some weird interaction between them.

The fact that Washington ESD makes this so confusing is ridiculous. Why can't they just have clear guidance on their website about severance timing?

Omar Farouk
•Because every severance situation is different and they probably don't want to give blanket advice that might not apply to everyone's situation.

•I guess that makes sense but it sure would be nice to have better info upfront.

Thanks everyone for all the advice! This thread has been super helpful. Going to file tomorrow and report my severance accurately. Fingers crossed the adjudication doesn't take too long.

Just want to echo everyone else - file immediately. I work in HR and see people make this mistake all the time. The filing date is what matters, not when benefits start flowing.

As someone who just went through this exact situation 3 months ago, I can't stress enough - FILE NOW! I had 6 weeks severance from my marketing job and made the mistake of listening to my former employer who told me to wait. Big mistake. When I finally filed, Washington ESD told me I should have filed immediately after separation regardless of severance. I lost about 3 weeks of potential benefits because of the delay. The severance just affects when payments start, not your eligibility to file. Don't make the same mistake I did - get your claim in the system ASAP and let them sort out the timing details.

•This is exactly the kind of real experience I needed to hear! So sorry you lost those 3 weeks of benefits - that must have been frustrating. It's crazy how many people (including employers) seem to give wrong advice about this. I'm definitely filing first thing tomorrow morning now. Did you have any issues during the adjudication process, or did it go smoothly once you finally got your claim in?

•Thanks for sharing your experience @Chloe Robinson! This is super helpful. I'm actually in the same boat - got laid off 2 weeks ago with 8 weeks severance and was told by HR to wait. But after reading everyone's responses here, I'm convinced I need to file immediately. It's frustrating that so many employers give incorrect advice about this. Did Washington ESD give you any trouble about the delay when you finally filed, or were they understanding about the misinformation you received?

•@Chloe Robinson Thank you so much for sharing your experience! This is exactly what I needed to hear. I m'the original poster and have been going back and forth on this all day. Your story about losing 3 weeks of benefits really drives home why I can t'afford to wait any longer. It s'infuriating that employers give such bad advice about this - my HR department told me the same thing about waiting until severance ends. I m'definitely filing tomorrow morning first thing. Did you end up having to deal with a long adjudication process once you finally got your claim submitted?
