How does severance pay affect unemployment benefits in Washington ESD?
I just got laid off from my tech job and they're giving me 8 weeks of severance pay. I'm trying to figure out if I can file for unemployment right away or if I have to wait until the severance runs out? The Washington ESD website is confusing about this. Some parts say severance doesn't affect benefits but other sections make it sound like it delays when you can start collecting. Has anyone dealt with this before? I really need to know if I should file my claim now or wait.

You can file for unemployment immediately after your last day of work, even with severance pay. Washington ESD treats severance differently than wages - it won't delay your benefits as long as you're not working and are available for work.

•That's a relief! So I don't have to wait the full 8 weeks to start my claim?

•Nope, file as soon as you can. The key is that you're unemployed and actively seeking work, regardless of the severance.

wait I thought severance counted as income? when I got laid off last year they made me report it on my weekly claims

•You do have to report severance pay on your weekly claims, but it typically doesn't reduce your unemployment benefits in Washington. It's different from regular wages or vacation payouts.

I've been trying to get through to Washington ESD for THREE WEEKS about my severance situation and can't reach anyone. The phone lines are always busy and I keep getting hung up on. This is so frustrating when you need answers about something this important!

•I had the same problem until someone told me about Claimyr - it's a service that helps you get through to Washington ESD agents. Check out claimyr.com, they have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. I was skeptical at first but it actually got me connected to someone who could answer my severance questions.

The Washington ESD system is SO broken. They make everything unnecessarily complicated. Why can't they just have clear guidelines about severance?

•The guidelines are actually pretty clear - severance pay doesn't disqualify you from benefits. The confusion usually comes from mixing up severance with other types of separation pay.

Here's what you need to know about severance and Washington ESD unemployment: 1) File your claim the week after your last day of work, 2) Report severance pay when you file weekly claims, 3) Severance typically won't reduce your benefits, 4) Make sure you're actively job searching to meet the work search requirements. The key distinction is that severance is considered separation pay, not wages for services.

•This is super helpful, thank you! Do I need any special documentation from my employer about the severance?

•It's good to have your severance agreement handy in case Washington ESD has questions, but you don't need to submit it with your initial claim.

ugh this happened to my friend and she waited 2 months to file thinking she had to wait for severance to end... lost out on so much money

•Oh no, that's exactly what I was worried about! Good thing I asked here first.

•Yeah, that's a common mistake. Always file immediately - worst case they'll tell you to wait, but usually you can start collecting right away.

I got severance when I was laid off from Boeing and had no issues collecting unemployment at the same time. Filed my claim the Monday after my last Friday and got approved within a couple weeks. Just make sure you're honest about everything on your weekly claims.

•That's encouraging! How long did your severance last?

•12 weeks. Really helped bridge the gap while I was job hunting. The unemployment plus severance made the transition much less stressful.

does anyone know if the severance amount matters? like if its a really big amount does that change anything?

•The amount of severance doesn't typically affect your eligibility for unemployment benefits in Washington. Whether it's $5,000 or $50,000, the rule is the same - it's separation pay, not wages.

What about if you get severance paid out over time instead of a lump sum? Does that change anything for Washington ESD?

Freya Christensen
•Nope, doesn't matter if it's lump sum or periodic payments. You still report it on your weekly claims but it shouldn't affect your benefit amount.

I'm in HR and deal with this question all the time. Severance pay in Washington state does NOT create a waiting period for unemployment benefits. Employees can file immediately after their last day of work. The confusion often comes from other states that DO have waiting periods for severance.

•Thank you for the professional perspective! That makes me feel much more confident about filing right away.

•Wish Washington ESD would hire more people like you to answer phones! Still can't get through to anyone there.

•Have you tried that Claimyr service someone mentioned earlier? I used it last month when I couldn't get through to Washington ESD about my adjudication issue. Worth checking out their demo video if you're stuck.

One thing to watch out for - make sure your employer isn't also giving you vacation payout or other compensation along with severance. Those might be treated differently by Washington ESD.

Ravi Malhotra
•Good point! I am getting vacation payout too. Should I be worried about that?

Chloe Davis
•Vacation payout is treated as wages and might affect your benefits differently than severance. You'll want to report both separately on your weekly claims.

this whole thread is making me realize I probably should have filed for unemployment when I got my severance package 3 weeks ago... can I still file now or is it too late?

Freya Christensen
•You can still file! Washington ESD allows you to backdate your claim in certain circumstances. You might lose some benefits from the delay, but definitely still worth filing.

Just want to add - make sure you're meeting the job search requirements while collecting unemployment, even if you have severance coming in. Washington ESD still requires you to be actively looking for work.

•How many jobs do I need to apply to each week?

Ethan Moore
•It's typically 3 job search activities per week, but check the specific requirements on your claim. Can include applications, networking, job fairs, etc.

The bottom line is file your unemployment claim ASAP after your last day of work, regardless of severance. Don't leave money on the table by waiting!

•That seems to be the consensus here. I'm filing my claim tomorrow morning. Thanks everyone for all the helpful advice!

•Smart move! And if you run into any issues with Washington ESD not answering phones, remember that Claimyr option. Saved me tons of frustration when I needed to talk to someone about my claim status.

good luck with your claim! the whole process is stressful but at least severance + unemployment can help bridge the gap while job hunting

I went through this exact situation last year when I got laid off from Microsoft. Filed my unemployment claim the day after my last day of work even though I had 6 weeks of severance. Washington ESD approved my claim without any issues and I collected benefits while receiving severance payments. The key is being honest on your weekly claims about the severance income - you report it but it doesn't reduce your unemployment benefits. Don't make the mistake of waiting like I almost did!

•That's really reassuring to hear from someone who went through the exact same situation! I was definitely leaning towards waiting but this thread has convinced me otherwise. Did you have any issues with the weekly claim reporting process, or was it pretty straightforward to report the severance payments?
