Can you claim unemployment with severance pay from Washington ESD?
I just got laid off after 6 years at a tech company and they're giving me 8 weeks of severance pay. I'm confused about whether I can file for Washington ESD unemployment benefits right away or if I have to wait until the severance runs out. The HR person wasn't very clear about this and I need to know ASAP since I heard there's a waiting period. Has anyone dealt with this situation before?

You can file your unemployment claim right away even with severance! Washington ESD allows you to file immediately after job loss. However, your weekly benefit amount might be reduced depending on how much severance you receive each week. The key is reporting it accurately on your weekly claims.

•That's a relief! So I should file now rather than waiting 8 weeks? I was worried about doing something wrong.

•Definitely file now. The sooner you file, the sooner your claim gets processed. Just be honest about the severance on your weekly claims.

Wait, I thought severance counted as wages and you couldn't get UI benefits? I'm so confused about this stuff.

•It depends on how the severance is structured. Lump sum vs. continued pay makes a difference in how Washington ESD treats it.

•Mine was a lump sum when I got laid off last year. Still not sure if I reported it correctly.

I had this exact situation 6 months ago. Filed my claim immediately and got approved. The tricky part is the weekly reporting - you have to report the severance amount correctly or they'll flag your account. I actually used Claimyr (claimyr.com) to get through to an actual Washington ESD agent to make sure I was doing it right. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•How much did your severance reduce your weekly benefit amount? I'm getting $4,800 spread over 8 weeks.

•It was about 75% reduction for me while the severance lasted. But once it ended, I got the full weekly amount. The Washington ESD agent explained the calculation which helped a lot.

•Never heard of Claimyr but getting through to Washington ESD is impossible lately. Might check that out.

THIS IS SO FRUSTRATING! I've been trying to get clarification on this for weeks. Called Washington ESD maybe 50 times and either get disconnected or stuck on hold forever. Why is it so hard to get a straight answer about severance reporting?

•Same here! The website info is confusing and doesn't cover all the scenarios.

•Exactly! And then you're scared of making a mistake and having to pay back benefits later.

The general rule in Washington is that severance pay is considered wages for the period it covers. If you're getting $600/week in severance, that gets deducted from your weekly UI benefit. But you can still file your claim and get partial benefits if your severance is less than your full benefit amount.

•So if my weekly benefit would be $500 and I'm getting $600 in severance, I'd get nothing that week?

Adriana Cohn
•Correct. But you'd still want to file your weekly claim to keep your claim active. Once the severance ends, you'd get your full $500.

•This makes sense now. I wish Washington ESD explained this better on their website.

just went thru this last month, filed right away even with 12 weeks severance. no issues at all, just report it honestly each week

•Did you have any problems with adjudication or anything like that?

•nope, pretty smooth actually. took about 2 weeks to get approved initially

I'm dealing with something similar but my severance is being paid out monthly instead of weekly. Anyone know how that affects the reporting? Do I divide it by 4 weeks or report the full amount in one week?

Chloe Zhang
•You'd typically divide it by the number of weeks it's intended to cover. But honestly, this is complex enough that you should talk to Washington ESD directly.

•I tried that Claimyr service someone mentioned earlier and actually got through to a real person at Washington ESD. They told me to divide monthly severance by 4.33 weeks for reporting purposes.

•Thanks! That's exactly what I needed to know. Might try Claimyr myself since calling direct never works.

Be careful about the job search requirements too! Even if you're getting reduced benefits because of severance, you still need to do your 3 job searches per week in WorkSourceWA. I almost got disqualified because I thought I didn't need to search while on severance.

Sophia Carter
•Oh wow, I hadn't even thought about that. So I need to start job searching immediately even though I have 8 weeks of pay?

Luis Johnson
•Yes! The job search requirement kicks in as soon as you start filing weekly claims, regardless of severance.

The Washington ESD system is so outdated. Had to mail in paperwork for my severance documentation because their online system couldn't handle my situation. This was 3 months ago and I'm still waiting for them to process it properly.

•That's ridiculous. What kind of documentation did they want?

•Letter from HR explaining the severance terms, pay stubs, termination letter. Basically proof of everything I already reported online.

Quick question - does vacation payout count the same as severance? I got 3 weeks vacation pay plus 4 weeks severance when I was laid off.

Adriana Cohn
•Vacation payout is treated differently than severance. It's usually considered wages for the period you would have worked, so it affects benefits similarly but the timing might be different.

•This is getting complicated. Maybe I should talk to someone at Washington ESD to make sure I'm reporting everything correctly.

I was in your exact situation 2 years ago. Filed immediately, reported severance weekly, got partial benefits for 8 weeks then full benefits after. The whole process was smoother than I expected once I understood the rules.

Sophia Carter
•That gives me hope! Did you have any issues with overpayments or anything after the fact?

Alina Rosenthal
•Nope, as long as you report accurately from the start, you shouldn't have problems later.

The key thing people miss is that you MUST report the severance during the weeks it's intended to cover, not when you actually receive it. If you get a lump sum for 8 weeks, you report it over 8 weeks, not all in week 1.

•This is super important! I made this mistake and had to go through an overpayment appeal process.

•Good to know! My severance letter says it covers 8 weeks so I'll divide it up for reporting.

Also remember that your benefit year starts when you file, regardless of severance. So don't wait thinking you're saving time - you're actually potentially losing weeks of eligibility.

•I didn't know that! Definitely filing this week then.

•Yeah, this is one of those things Washington ESD doesn't make clear enough. File early, report honestly, and you'll be fine.

One more tip - keep all your severance documentation. If Washington ESD has questions later (and they might), you'll need proof of the amounts and dates. Screenshots, emails, pay stubs, whatever you have.

•Good advice! I'll make copies of everything before I file.

•Yes! And if you used Claimyr or somehow got through to Washington ESD to clarify anything, document that conversation too.

Bottom line for OP - file your claim now, report severance weekly as intended coverage, do your job searches, keep records. It's really not as complicated as it seems once you start the process.
