Washington ESD unemployment eligibility with severance package - confused about timing

Just got laid off from my tech job after 6 years and they're giving me a severance package worth about $15,000 paid out over 8 weeks. I'm trying to figure out if I can file for unemployment benefits right away or if I need to wait until the severance runs out. The Washington ESD website isn't super clear about this and I don't want to mess up my claim by filing at the wrong time. Has anyone dealt with this before? Do they consider severance as wages that would disqualify me temporarily?

You can actually file for unemployment right away even with severance in Washington state. The key thing is HOW the severance is being paid out. If it's a lump sum, it doesn't affect your weekly benefits at all. If it's being paid as continuation of wages (like yours sounds like), then those weeks might be considered disqualifying because you're still technically receiving wages.

So since mine is spread over 8 weeks, I should wait until it's done before filing?

Luca Conti

•

Not necessarily - you should still file now to get your claim started. Washington ESD will determine if those weeks are payable or not. Better to have the claim in the system.

I went through this exact situation last year. Filed immediately and Washington ESD put my claim on hold during the severance period, then it kicked in automatically once the severance ended. Definitely file now though because there's usually a waiting period anyway.

That's really helpful! Did you have to do anything special when the severance ended or did it just automatically start paying?

Nia Johnson

•

It was automatic but I had to keep filing my weekly claims the whole time, even during the non-payable weeks.

The Washington ESD phone lines are absolutely impossible to get through to ask questions like this. I spent 3 hours trying to call them about my severance situation. Finally found this service called Claimyr (claimyr.com) that actually got me through to an agent in like 15 minutes. They have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Might be worth checking out if you need to talk to someone at Washington ESD directly about your specific severance package.

Never heard of that but getting through to Washington ESD is definitely a nightmare. How much does something like that cost?

I don't remember the exact cost but it was totally worth it to actually get answers instead of being on hold forever. Way less stressful than the regular phone system.

wait im confused, i thought any income disqualifies you from unemployment benefits? my severance was only $3000 lump sum and i waited 6 months to file because i thought i couldn't get benefits

•

No, lump sum severance doesn't disqualify you at all in Washington! You should have filed right away. Might be worth checking if you can still backdate your claim.

ugh seriously?? i've been struggling this whole time for nothing. how do i backdate a claim?

0 coins

You can only backdate claims in certain circumstances. You'll probably need to call Washington ESD to see if you qualify for backdating.

The Washington ESD handbook specifically says severance payments are evaluated on a case-by-case basis. If your former employer considers it 'wages in lieu of notice' then it might defer your benefits. If it's considered a gift or bonus, it won't affect anything. You really need to know how your company classified the payment.

Good point - I should check my severance agreement to see exactly how they worded it.

This is why the system is so confusing. Every situation is different and the rules aren't clear.

File immediately!! I made the mistake of waiting and lost out on benefits I was entitled to. Even if some weeks aren't payable due to severance, you want your claim established. Plus you need to start your job search requirements anyway.

•

That's a good point about the job search requirements. I need to register with WorkSource too right?

Carmen Ortiz

•

Yes, you need to register with WorkSourceWA within a certain timeframe. Don't wait on any of this stuff.

Been there! My severance was paid as 'continuation of salary' for 12 weeks. Washington ESD considered those weeks as still being employed, so no benefits during that time. But my claim was ready to go the day after severance ended. Definitely file now even if you can't collect right away.

Did you still have to file weekly claims during the severance period?

MidnightRider

•

Yes, had to file every week and report the severance income. It was marked as non-payable but kept the claim active.

Same exact thing happened to me. The weekly filing during severance is important to maintain your claim.

The whole severance thing is such a mess with Washington ESD. I've seen people get different answers from different agents about the same situation. Really depends on who you talk to.

That's exactly why I ended up using that Claimyr service someone mentioned earlier. At least I got a consistent answer instead of conflicting information.

Yeah I'm definitely going to look into that if I can't get clear answers through the normal channels.

Just to add another data point - my severance was a lump sum of $8000 and it didn't affect my unemployment at all. Filed the day after I got laid off and started getting benefits after the normal waiting week. But I know people with ongoing severance payments who had to wait.

Zara Ahmed

•

Thanks for the data point! It really does seem like lump sum vs. ongoing payments makes a big difference.

PRO TIP: When you file your claim, be very specific about how your severance is structured. Don't just say 'I'm getting severance' - explain if it's lump sum, ongoing payments, how many weeks, etc. The more detail you give Washington ESD upfront, the better they can process your claim correctly.

Zara Ahmed

•

That's really good advice. I'll make sure to have all those details ready when I file.

Yes! And keep all your severance documentation. Washington ESD might ask for it later during adjudication.

honestly the washington esd system is so broken, i filed 3 weeks ago and my claim is still in adjudication for no apparent reason. good luck getting any kind of timely response about severance questions

0 coins

Adjudication delays are the worst. Have you tried reaching out to your legislators office? Sometimes they can help push things along.

Amara Adebayo

•

didn't think of that, might be worth a try since calling washington esd is pointless

Update us when you file! I'm curious to see how they handle your specific situation since I might be in a similar boat soon.

Will do! Planning to file this weekend after I get all my paperwork together.

One more thing - make sure you understand the difference between severance and vacation payout. Unused vacation/PTO is usually considered wages and will definitely defer benefits. True severance might not, depending on how it's structured.

Zara Ahmed

•

Good distinction! My package includes both severance and vacation payout, so I'll need to separate those when I report.

0 coins

Sofia Gomez

•

Exactly - the vacation payout will almost certainly defer benefits for those weeks, but the severance portion might not.

Filed with severance about 6 months ago and used that Claimyr thing to get through to Washington ESD when I had questions. Honestly saved me so much frustration compared to trying to call the regular way. Worth every penny when you're dealing with uncertainty about benefits.

Good to hear another positive experience with that service. Might be my backup plan if the online filing doesn't give me clear guidance.

Bottom line: file now, report everything accurately, and let Washington ESD make the determination. Don't try to guess whether you're eligible or not - that's their job to figure out.

Zara Ahmed

•

That's probably the best advice in this whole thread. Thanks everyone for all the input!

Agreed! Always better to file and let them sort it out than to miss out on benefits you're entitled to.
