Does unemployment start after severance pay ends in Washington ESD?
My company laid me off last month and I'm getting 8 weeks of severance pay. I'm confused about when I can start collecting unemployment benefits through Washington ESD. Do I have to wait until my severance completely runs out, or can I file my claim now? I've heard conflicting information and don't want to mess this up. The severance is keeping me afloat for now but I'm worried about the gap between when it ends and when unemployment kicks in.

You need to report the severance pay to Washington ESD when you file your claim. Generally, severance counts as wages and will delay your benefit start date. The rule is that you can't receive UI benefits for any week where your severance pay exceeds your weekly benefit amount.

•So if my severance is $800/week and my unemployment would be $650/week, I have to wait until the severance ends?

Alberto Souchard
•Exactly. But you should still file your claim now to get your effective date established. The waiting period will be built into your claim automatically.

File your claim ASAP! I made the mistake of waiting until my severance ended and lost out on establishing my benefit year. Even though you won't get paid right away, you need to get the paperwork started.

•Good point, I'll start the application this week. How long does it usually take to process?

•Mine took about 3 weeks to get approved, but that was before they had to verify the severance details with my employer.

I had a similar situation and used Claimyr to get through to Washington ESD to clarify the severance rules. The agents explained that lump sum severance is handled differently than weekly payments. Check out their site at claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how to get connected.

•Is that service worth it? I've been trying to call Washington ESD for days and keep getting disconnected.

•For me it was. I got through in about 20 minutes instead of spending hours redialing. Saved me a lot of frustration.

•I've never heard of that service but honestly anything beats the endless busy signals from Washington ESD.

wait so if i got a lump sum severance of like $6000 do i have to wait 6000 divided by my weekly benefit amount before i can collect?? that seems crazy

•It depends on how your employer structured it. If it's allocated over a specific time period, that's how Washington ESD will treat it. If it's truly a lump sum with no allocated period, the rules are different.

•my termination letter just says 'severance payment of $6000' nothing about time periods

The Washington ESD website has a whole section about severance pay but it's confusing as hell. Basically they look at whether it's 'wages in lieu of notice' or actual severance. The timing of when you can collect depends on which category yours falls into.

•Mine is definitely severance, not wages in lieu of notice. My company gave me 2 months notice plus the severance package.

•That should help your case. Since you had notice, the severance might be treated more favorably.

I'm dealing with this exact thing right now. Filed my claim 3 weeks ago and it's still showing 'pending' because they're verifying my severance details with my old employer. Super frustrating.

•Are you able to file your weekly claims while it's pending?

•Yes, I have to keep filing even though I'm not getting paid. They said it's important to maintain the claim.

Another thing to watch out for - if your severance includes health insurance continuation, that might affect your benefits too. Washington ESD considers the employer-paid portion as additional compensation.

•Oh great, another complication. My severance does include 3 months of health insurance coverage.

•Just make sure you report everything accurately. Better to be upfront than have to deal with an overpayment notice later.

For anyone still struggling to get through to Washington ESD about severance questions, I'd definitely recommend trying Claimyr. I used it twice during my claim process and both times got connected to an agent within 30 minutes. Way better than the 2+ hour waits I was experiencing before.

•How much does that cost though? I'm already tight on money.

•It's worth checking out their pricing, but for me the time saved was worth it. Plus they have the video demo so you can see exactly how it works first.

I think a lot of people don't realize that even if you can't collect benefits immediately due to severance, you still need to do your job search activities. The work search requirements kick in regardless of whether you're receiving payments.

Nia Watson
•Wait, really? I have to do job searches even while I'm getting severance and not collecting unemployment?
0 coins
Chris Elmeda
•If you've filed your claim and are doing weekly certifications, yes. The job search requirement is tied to your active claim status.

Alberto Souchard
•This is correct. You need to log 3 job search activities per week in WorkSourceWA even during your severance period.

The whole severance thing is such a pain. I had to send in my termination letter, severance agreement, and pay stubs. Took forever for them to process everything.

•What documents did you end up needing? I want to make sure I have everything ready.

•Termination letter, severance agreement, last few pay stubs, and a letter from HR explaining the severance structure. Washington ESD wanted everything in writing.

Pro tip: when you're reporting your severance on the weekly claims, be super specific about the dates and amounts. I made the mistake of estimating and it caused a whole adjudication process.

Nia Watson
•How long did the adjudication take?

Charity Cohan
•About 6 weeks. They had to verify everything with my employer and then make a determination. It was a nightmare.

Does anyone know if vacation pay is treated the same as severance? I'm getting both and I'm totally confused about how to report it.

Alberto Souchard
•Vacation pay is usually treated as wages and allocated to specific weeks. Severance has different rules depending on how it's structured.

•This is so complicated. I wish Washington ESD would just have clearer guidelines.

I've been trying to get through to Washington ESD for weeks about my severance situation. The phone system is absolutely terrible - either busy signals or I get disconnected after waiting forever.

Marcus Marsh
•That's exactly why I ended up using Claimyr. The regular phone system was just too frustrating and I needed answers about my severance timing.

•I might have to try that. This is ridiculous.

Make sure you understand the difference between 'severance pay' and 'payment in lieu of notice' - Washington ESD treats them very differently for unemployment purposes.

Nia Watson
•What's the difference? My company just called it 'severance' but I'm not sure which category it falls under.

•Payment in lieu of notice is when they pay you instead of giving you notice. Severance is additional compensation beyond that. Check your termination paperwork.

I'm in week 6 of my severance and starting to panic about the transition to unemployment benefits. Has anyone gone through this transition smoothly?

•I'm in the same boat. Filed my claim early but still waiting for approval. The uncertainty is killing me.

One thing that helped me was keeping detailed records of everything - every conversation with Washington ESD, every document I submitted, all the dates and amounts. When questions came up later, I had everything documented.

Nia Watson
•Good advice. I'll start a file with all my severance documentation.

•Yeah, you'll thank yourself later. The unemployment system loves paperwork.

For what it's worth, even though the severance rules are confusing, Washington ESD is generally pretty fair about it once they get all the information. Just be patient and accurate with your reporting.

Nia Watson
•That's reassuring to hear. I was worried I'd get disqualified for something I didn't understand.

•As long as you're honest and provide all the documentation they ask for, you should be fine.

The key is to file your claim as soon as possible after your last day of work, even if you're getting severance. The effective date of your claim is important for your benefit year.

•Thanks everyone for all the advice. I'm going to file my claim this week and get the process started.

•Good plan. Better to get it started and deal with the severance timing than to wait and potentially miss out.

Just went through this exact situation last year. Filed my claim immediately after my layoff even though I had 10 weeks of severance. Washington ESD put my claim on hold until the severance period ended, but having that early filing date saved me weeks of processing time. The transition was seamless - my first unemployment payment came just 3 days after my final severance check. Don't wait to file, and make sure you keep doing your weekly certifications even during the severance period. Also keep all your severance paperwork handy because they'll likely ask for it multiple times during the process.
