Missed TWC appeal deadline due to no internet - can I still appeal somehow?

I just realized I missed my deadline to appeal a TWC decision because my internet was out for almost 2 weeks (thanks a lot, construction crew who cut the lines). I only got the determination letter saying I was disqualified for benefits because I 'voluntarily quit' - which is NOT what happened! I was laid off but my employer is claiming otherwise. The appeal deadline was 3 days ago when I finally got back online. Is there ANY way to still appeal this? Can you appeal the fact that you couldn't appeal on time? I'm seriously freaking out because I need these benefits and I have documentation proving I was laid off. Would explaining the internet outage situation help at all or am I completely out of luck?

Seriously? That's what I'm afraid of. Did he try anything else or just give up?

You can actually request what's called a "good cause" exception for late appeals. According to TWC rules, if you had a good reason for missing the deadline that was beyond your control (like documented internet outage), you might qualify. You need to file your appeal ASAP and include a detailed explanation about why you were late. Include any documentation of the internet outage - maybe a service ticket from your provider or notice about the construction? The sooner you do this, the better chance you have. They'll first decide if your reason for being late is acceptable before even looking at the original issue. Here's the exact process: Submit your appeal through your online account (or mail/fax if needed) and clearly write "GOOD CAUSE EXCEPTION REQUESTED" at the top, then explain your situation. Be very specific about dates and what prevented you from filing on time.

Thank you SO MUCH for this! I just called my internet provider and they said they can email me documentation of the outage in my area. I'll submit everything first thing tomorrow morning with GOOD CAUSE EXCEPTION REQUESTED at the top like you said.

Umm actually I think it's called "good reason exception" not "good cause" and TWC is super picky about what counts. My neighbor tried to appeal late because she was in the hospital and they still denied her! Just saying don't get your hopes up too high...

You're thinking of a different term. TWC specifically uses "good cause" for late appeals. It's right in their appeal procedures documentation. Hospital stays absolutely can qualify if properly documented - your neighbor might have missed including medical documentation or there could have been other factors in her case.

When you file your good cause exception, make sure to ALSO address the original issue about being disqualified for 'voluntary quit' in the same document. That way if they accept your good cause reason, they already have your arguments about the original issue. I'd include any layoff documentation you have.

That's smart thinking! I have the layoff letter and even texts from my manager confirming it was a company downsizing. I'll include all of that with my appeal.

I was in a similar situation last year and what really helped was actually speaking directly with a TWC appeal clerk. They can sometimes give you specific guidance on what documentation they need to see for your good cause exception. The problem is it took me FOREVER to reach someone - kept getting busy signals for days. I finally used this service called Claimyr (claimyr.com) that got me through to an actual TWC agent in about 20 minutes instead of spending hours redialing. They have a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh Once I got through, the TWC person actually helped me phrase my good cause exception in a way that would meet their criteria. Made a huge difference in my case getting approved.

THE WHOLE SYSTEM IS RIGGED AGAINST US!! 14 days to appeal is NOT ENOUGH TIME with how slow mail delivery is these days!! My determination letter arrived ALREADY 5 DAYS PAST THE DATE ON IT!!! And then they expect you to have internet and printers and scanners at home??? What about people who don't have all that fancy technology??? TWC DOESN'T CARE!!!

I feel your frustration! The 14-day window is definitely tight, especially when you factor in mail delivery times. I'm lucky I at least have a computer at home when my internet is working.

Just to give you some hope - I've seen several cases where good cause exceptions were approved for situations similar to yours. Internet outage due to construction is definitely something beyond your control, especially with documentation. The key things TWC looks for in good cause cases are: 1. Was the reason truly beyond your control? 2. Did you act promptly once the obstacle was removed? 3. Do you have documentation supporting your claim? You have all three, so you have a reasonable chance. Be sure to file your appeal within 14 days of when your internet was restored to show you acted promptly once you could.

This gives me hope! My internet was restored 3 days ago, so I'm still within that 14-day window after restoration. I've gathered all my documentation now and will submit everything tomorrow. I'll update here once I hear anything back.

My brother works at TWC (not in appeals tho). He says they get TONS of late appeals and most get rejected because people just say "I forgot" or "I was busy" - but legitimate documented reasons like medical emergencies, natural disasters, or proven service outages have a decent shot at acceptance. Don't give up!

UPDATE: I submitted my appeal with the good cause exception request yesterday! I included all documentation of the internet outage from my provider, plus all my evidence about being laid off rather than quitting. Now I'm just anxiously waiting to hear back. Thanks everyone for the advice - will keep you posted on what happens!

Great job taking action quickly! Now be prepared to wait a bit - good cause reviews typically take 2-3 weeks, sometimes longer if they're backlogged. If you don't hear anything after 3 weeks, it might be worth calling to check on the status.
