Quick update on the tax implications: Even while you're waiting for a corrected 1099-G, you can still file your taxes. The IRS recommends only reporting income you actually received. Include a statement explaining that you've reported suspected unemployment fraud to the state and have requested a corrected 1099-G. Keep documentation showing you reported the fraud. The IRS has procedures in place for these situations, especially since fraud has increased dramatically in recent years.
One last tip: Make sure you take screenshots of EVERYTHING in your UC portal now - claim status, message history, payment records, everything. Sometimes these records change or disappear during fraud investigations. Those screenshots could be crucial evidence later, especially if you need to prove you never accessed the stolen funds.
Mine was classified as "non-fraud" too but they STILL denied my waiver request!! The whole system is designed to squeeze money out of people who can least afford it. They make the forms complicated ON PURPOSE so people will give up and just pay.

You have 30 days from the date on the Treasury offset notice to appeal in writing. This is separate from the PA UC overpayment appeal process. The debt was already paid in full 2. The debt was discharged in bankruptcy 3. You've established an approved payment plan (though this doesn't always prevent offset) 4. You weren't properly notified about the potential offset Also, if you filed jointly with a spouse who isn't responsible for the overpayment, they can file an Injured Spouse claim (Form 8379) to get their portion of the refund returned.

FINAL UPDATE: Had my hearing this morning and I WON MY APPEAL!!! The referee immediately ruled in my favor when my former employer couldn't explain why they gave different reasons for my termination. Now they're saying it will take 2-3 weeks for payments to start processing, but at least I'll be getting all the back payments from October! Thanks everyone for your help and support during this incredibly stressful time. For anyone else going through appeals - document EVERYTHING and don't give up!
Great news! Just be aware that the back payments might come in separate chunks rather than all at once. Also, your former employer still has 15 days to appeal this decision to the Board of Review, though it sounds like they don't have a strong case. Congratulations!
ugh classic PA UC mess up! glad u got it sorted out but so annoying about the 2 week delay 😠make sure u keep filing ur weekly claims while u wait for the new hearing!!!
