Running out of effective days on my ny unemployment claim - do I need to file a new one?
Just checked my unemployment account and saw my effective days are down to 2 days left. I've been on this claim since October 2022 after getting laid off from my restaurant job during budget cuts. My benefit year isn't over until October 2023, but I'm stressing about what happens when these last days run out next week. I'm still searching for work but no luck yet. Do I need to file a completely new claim when my effective days hit zero? Or is there some extension process? I've been receiving about $410 weekly and really can't afford to have any gap in payments. The website isn't clear about this situation at all. I tried calling but after waiting 2 hours, the call dropped. Anyone deal with this recently? I'm afraid if I file a new claim it'll mess up my current one or cause delays.

You'll need to file a new claim. When your benefit year is up OR your effective days run out (whichever comes first), you gotta start fresh. It sucks but that's how the system works. Just make sure you have all your employment info from the past 18 months ready.

•There's usually a 1-2 week gap at minimum while they process the new claim. Could be longer if they need to verify anything or if you made any income during your benefit year.

You definitely need to file a new claim when you exhaust your effective days, even if your benefit year isn't over yet. That's what effective days are - they represent the maximum number of weeks you can collect in a benefit year (usually 26 weeks). When they're gone, they're gone.

I just went thru this in July. You 100% need to file a new claim once your days run out. But heres the kicker - if you haven't worked enough quarters since your LAST claim, you might not qualify for a new one. They look at the last 5 quarters of work history but cant include the same quarters they used for your previous claim. It's a mess 🤯

•Probably not tbh. You usually need to have earned at least $2400 across multiple quarters to qualify for a new claim. Might wanna look into emergency assistance programs if that's the case.

Everyone else is right - you gotta file a new claim. But FYI, your benefit amount might change with the new claim since it'll be based on your most recent work history. If you haven't worked much since your last claim started, you might get a lower amount or might not qualify at all depending on your work history.

Look for the "File A New Claim" button on your dashboard. Don't use the weekly certification page - that's different. And don't wait until your days hit zero! File a new claim when you're down to your last week. The system is supposed to automatically determine if you're eligible for a new claim.

Whatever you do, DON'T stop certifying weekly even while waiting for your new claim to process! Keep certifying every week as normal. If your new claim is approved and there was no break in your eligibility, they can back-pay those weeks.

IMPORTANT: Make sure you check for any overpayment notices before filing a new claim. If they think they paid you too much on your current claim, they'll deduct it from your new one. Happened to me and I didn't get payments for the first 4 weeks while they "recovered" the supposed overpayment. 😡

Y'all make this too complicated. When your effective days run out, you simply file a new claim. That's it. Whether you qualify or not depends on if you've worked enough in the base period they use for the new claim.

weird that nobody mentioned this yet - but if you exhaust your regular UI claim and still can't find work, check if you qualify for any extended benefits programs. NYS sometimes has additional weeks available during periods of high unemployment.

My friend just dealt with this. File new claim, but EXPECT problems. Her new claim took 7 weeks to process and she had to call multiple times. The system is a mess. Budget accordingly if you can.
