NY Unemployment claim ends 8/1/2021 - Need to file new claim or recertify? $137.70 penalty on my account

My benefit year is ending on August 2, 2021 and I'm not sure what I'm supposed to do. I started receiving unemployment back in October 2020 after getting laid off from my restaurant job. I'm looking at my unemployment information right now: Name: Andrew Wils Start/Effective Date: 07/27/2020 Benefit Year Ending Date: 08/01/2021 Weekly Benefit Amount: $448.00 Maximum Amount Payable: $18,400.00 Effective Days Remaining: 0 Amount you owe for overpaid benefits: $0.00 Amount you owe for penalties: $137.70 Total amount you owe: $137.70 I'm really confused because even though my payment history was showing I had about 50 effective days remaining, now when I look at my account details it says I have 0 effective days remaining. And my weekly benefit amount is showing as $448.00, not the $296.00 I thought I was getting. I also noticed I have a penalty amount of $137.70 that I have to pay back from when I accidentally reported my hours wrong a few months ago. At least there's no additional overpayment amount showing. Does anyone know if I'm supposed to keep certifying weekly or if I need to file a completely new claim once my BYE date passes? My benefit year ending date is August 1, 2021, which is in just a few days. I've tried calling but can't get through to anyone who can help. The website is super confusing about this. I don't want to mess anything up and end up owing more money or having my benefits stop. Will they automatically roll me over to a new benefit year since I have a zero balance now? Or do I need to reapply completely? I'm worried because I still need this income while I'm trying to find steady work again.

If you still have days left, you should be able to keep certifying. But the system might make you file a new claim anyway since your BYE date is coming up. The best thing to do is to try to talk to someone at ny unemployment directly to make sure you do it right.

It's basically a system that keeps calling and waits on hold for you. When an actual person answers, it calls your phone and connects you. Saved me from going insane with that hold music lol

i just looked it up and they dont ask for any personal info - they just do the calling part. after seeing how the service works i gave it a try and got through in about 2 hours. no complaints here 🤷‍♂️

You need to file a new claim once your BYE date passes. Even with days left, the system requires a new application. Make sure you do it right after your BYE date expires - not before or you risk having issues. And btw, that penalty needs to be paid before they'll process a new claim. Found that out the hard way!

they'll deduct it from future payments usually. when i refiled they just took like 25% of each check until it was paid off. u should be fine

The whole BYE date thing is SO CONFUSING. I went thru this last month and had to file a new claim even tho I had days left. Then there was a gap in payment for like 3 weeks while they processed everything. Make sure u have some savings to cover that gap!!!

Yeah if you worked since your original claim and earned over 10x your weekly benefit amount, they'll recalculate everything. My bf had this happen and his benefit amount went down 😑

Yes, you can mail a check to NYSDOL Overpayment Unit with your claim info, or pay online through your account. But honestly, most people just let them deduct it - it's easier.

The same thing happened to me back in june. I filed a new claim after my BYE date, but kept certifying every week. There was about a 3 week gap in payments while they processed everything, but then they back-paid me for those weeks. Make sure you keep certifying no matter what!

heres the deal - the BYE date is when your claim expires. you gotta file a whole new claim even if you still got days left (which is stupid but thats how they do it). about that penalty - they'll take it outta your future payments so dont trip about that part.

My BYE date was last week and I'm going through this exact thing! File a new claim for sure, but call first about that penalty. Sometimes they make you pay it before you can get a new claim processed.

Go to payment history, then look at the most recent payment. It should show days remaining.

Just be glad ur BYE date is only in September. Mine was in May and I've been stuck in pending purgatory since then. Can't reach anyone, website gives me errors, and I'm about to be evicted. NY unemployment is a disaster.
