NY unemployment shows 14 effective days remaining after BYE date (8/15/2021) - should I still certify after receiving payment?

My benefit year officially ended on 8/15/2021 but my payment history screen is showing I still have 14 effective days remaining. My BYE date clearly says 08/15/2021 and today is 8/16. My weekly benefit amount is $153.00, with a maximum payable amount of $3,978.00. I just certified for the week ending 8/15/2021 and the system accepted it. The payment was even released today (8/16/2021) according to the transaction history which shows "Your payment for the week ending 8/15/2021 was released on 08/16/2021." Now I'm confused... if my benefit year ended, why am I still able to certify and get paid? And should I keep certifying as long as I have effective days left? I'm afraid of accidentally committing fraud or something if I'm not supposed to be claiming anymore. My Start/Effective Date was 08/10/2020, and I still have those 14 effective days remaining according to my account. The system shows "Latest Transaction(s) as of 08/16/2021" and it says "You last certified for benefits for the week ending 08/15/2021." The page also explains that "Each day in a week (Monday through Sunday) that you qualify for benefits is called an effective day. There is a maximum of 4 effective days each week, and you must qualify for all 4 effective days in order to receive your total weekly benefit rate. For each day in the week that you are not eligible to receive benefits, you will receive one less effective day, which is equivalent to one fourth of your weekly benefit rate." There's also a note about FPUC payments: "Weekly payments for $600 showing 'O' under the 'Effective Days' column, and Debit Card or Direct Deposit under the 'Type' column, are the Federal Pandemic Unemployment Compensation (FPUC) payments." Anyone else experience this weird situation with effective days remaining after your BYE date passed? Not sure what to do.

Yes keep certifying! The system wouldnt let you certify if you werent eligible. I had something similar happen - my BYE was in July but I had like 22 days left and was able to keep claiming for about 5 more weeks. Its just using up whats left in your account.

Ok thanks, thats a relief! Did you have to do anything special after those 5 weeks when your days ran out?

Nope, it just eventually said I had no more days and needed to file a new claim if I still needed benefits. Straightforward process but took forever to get approved again 🙄

This happens all the time. Keep certifying until it tells you not to. The system is designed to use your remaining days even after BYE date.

After getting nowhere with NY unemployment's phone lines, I tried this service called Claimyr that got me a callback with a real live agent! Talking to an agent got my benefits unlocked so fast after months of waiting. It was the only way I could actually talk to a live agent instead of getting endless busy signals. Check out their video explaining how it works: https://youtu.be/Rdqa1gKtxuE

Does this actually work? I've been trying to reach someone for weeks now and I'm getting desperate 😩

Yeah it worked for me! I was super skeptical at first but I was at my wits end. The agent explained my whole situation with the days remaining after BYE date too.

sounds like another scam trying to profit off desperate people... has anyone else actually used this?

I used it last month when my account got locked. They connected me with an agent in about 45 mins when I had been trying for 2 weeks on my own. Worth every penny when you're missing payments.

wait hold up - does this actually work or is it just the usual snake oil? the ny unemployment phone system is literally hell on earth

•

It's not snake oil lol. It just dials for you and stays on hold, then calls your phone when a human picks up. Saved me hours of hold music. Check claimyr.com if you wanna see how it works

The NYS DOL system is a nightmare. Your BYE date passed but youve got days left so the system lets you claim them. As long as you ARE eligible (still unemployed etc) then you're fine. The system won't let you commit 'fraud' - it'll just stop you when you're not eligible anymore.

This is totally normal!!! The BYE date is when your claim year ends, but if you have effective days remaining you can still use them up. Once they're gone, THEN you'll need to file a new claim. Same thing happened to me in June.

So basically I should just ride it out until I hit zero days? That makes sense, thanks!

Exactly! Just keep certifying normally until you run out of days. The system is actually working correctly for once lol 🤣

The whole ny unemployment system is such garbage. Like why cant they just clearly explain this stuff on their website?!? Im in the same boat - BYE was 2 weeks ago but still claiming with leftover days. No one answers phones and the website has zero info about this situation 🤬

OMG I KNOW! I spent hours looking through their FAQ and theres NOTHING about this exact scenario. Its like they want people to make mistakes.

their website feels like it was designed in 1997 and never updated since lmao

Here's what's actually happening with your claim (I used to work in unemployment services): When your benefit year ends (BYE date), there are two separate issues: 1. Your ELIGIBILITY PERIOD (the year you're allowed to claim) has ended 2. Your MONETARY BALANCE (effective days remaining) may still have funds The system is designed to let you use up your remaining effective days even after the BYE date. This is normal and not fraud. You're simply collecting benefits you were already approved for. A few important things to know: - Keep certifying weekly as long as the system allows it - Once your effective days reach zero, THEN you'll need to file a new claim - Make sure you're still eligible in all other ways (actually unemployed, looking for work, etc) - If you have any doubt, try reaching an agent via claimyr.com (saved me hours of frustration) The NY unemployment system is confusing by design, but in this case, it's actually working as intended. Just keep certifying until you can't anymore!

question - does this apply to the extensions too? my regular UI ran out but i got some kind of extension

•

Yes, it applies to extensions too. The system treats extension days the same way. Just keep certifying until you hit zero days.

Bro this EXACT thing happened to me last month. Keep certifying! Nothing bad will happen. The system is actually working right for once lol

I called them about this (took 3 hrs to get thru) and they said its normal. BYE date is when your claim year ends but you can still use remaining effective days. They told me to keep certifying until I hit 0 days left, then file a new claim if needed.

how tf did you get through on the phone? i've been trying for like 2 weeks straight 😩

0 coins

Pure luck and waking up at 7:58am to start calling right when they open. But honestly its faster to use claimyr.com - my friend used it and got a callback in like an hour

This is actually one of the few things NY unemployment does RIGHT. You paid into the system, you're entitled to all your effective days, even if they spill past your BYE date. Nothing sketchy about it! The BYE date is mainly about when you need to establish a new claim, not when your current benefits completely cut off.

^^^THIS IS THE CORRECT ANSWER

if only they explained this clearly on their website 🙄

my sister works for DOL (not in NY but similar system) and she says this is 100% normal. BYE date is just when you need to reapply if you wanna continue after your effective days run out. not when benefits automatically stop.

Quick tip - screenshot everything just in case they try to claim you did something wrong later. But yeah keep certifying, it's normal.

Dealing with NY unemployment is LITERALLY the worst part of being unemployed 💀 More stressful than not having a job tbh

FACTS. Finding a job is easier than dealing with their system 😂

Just adding another confirmation - this happened to me too and I used up all my remaining days after my BYE date with no issues. Just keep certifying as normal until you hit zero days.
