NY Unemployment: What happens to my remaining balance when BYE date (12/26/2021) hits with 0 Effective Days Remaining?
I've been receiving unemployment benefits since December 2020 and my benefit year ending date is coming up on 12/27/2021. I'm really confused about what happens next. My weekly benefit amount is $504.00 and I still have some money left in my maximum payable amount ($19,656.00 originally). According to my Current Claim page on the NY Department of Labor website, I have 0 Effective Days Remaining, but I still have funds available. I've been certifying every week and actively searching for work, keeping all my work search records. Just checked my payment history and saw the BYE date is approaching. The website shows my latest transaction as of 09/08/2021 - I last certified for benefits for the week ending 09/06/2021, and my payment for that week was released on 09/08/2021. I've noticed that the weekly payments for $600 showing "0" under the "Effective Days" column, and Debit Card or Direct Deposit under the "Type" column, are the Federal Pandemic Unemployment Compensation (FPUC) payments. The website explains that each day in a week (Monday through Sunday) that you qualify for benefits is called an effective day. There is a maximum of 4 effective days each week. Do I have to file a completely new claim when the BYE date hits? Will I lose the remaining balance? The website isn't clear at all about this process and I'm worried about having a gap in payments since I'm still job hunting. Has anyone gone through this recently with the NY Department of Labor system?

yes, you gotta file a new claim after your BYE date. even if you have money left in your account, the system won't let you certify once your benefit year is over. i went through this back in July. make sure you start the new application a day or two AFTER your BYE date or it might mess things up.

there was like a 2 week gap for me. but thats because I waited too long to refile. do it right away after your BYE date and you should be ok

Thats not always true, it depend on if u worked during your benefit year or not. If u didnt work at all, sometimes they just extend

Talking to an agent got my benefits flowing again SO fast after filing my new claim. I was skeptical too but I was desperate after three weeks of trying to get through. They basically call for you and wait on hold, then connect you when a real person picks up. Saved me literally hours of hold time.

It 100% worked for me. My claim was stuck in pending for weeks, got through to an agent who fixed it in like 10 minutes. The hold time would have been 3+ hours but I didn't have to deal with any of that.

The BYE date means your claim expires. If you haven't worked and earned 10x your weekly benefit rate during your benefit year, you might qualify for an extension. But most likely you'll need to file a new claim and have your eligibility redetermined. Make sure you have all your employment info from the last 18 months ready.

i just went thru this last month!!! if u didnt work at all during ur benefit year, u might just get an automatic extension. but if u had ANY employment during the year (even part time), u will 100% need to file a completely new claim. when I filed a new one, they reviewed my work history and recalculated my benefit amount based on what I earned. took about 10 days to process the new claim. good luck! 👍

Assuming u didnt work during ur benefit year (or didnt make enough), heres wat happens: - On the day after ur BYE date, file a new claim - They'll review if u had enough earnings to establish a new claim - If not, they might put u back on ur old claim if u still have balance - BUT theres often a 1-3 week gap where ur in limbo - KEEP CERTIFYING every week even if ur not sure whats happening - If u dont hear anything after 2 weeks, CALL THEM I lost 2 weeks of benefits cause i didnt understand this process. the system is such trash 🗑️

omg this EXACT thing happened to me. my bye date was in october and i was so confused. called like 50 times and couldnt get any1 on the phone. ended up having to file a new claim and then waited 3 weeks with no money coming in. system is broken af 😡

I'm going thru this RIGHT NOW. Filed my new claim after BYE date (10/2/22) and it's been in pending status for almost a month now. Can't get anyone on the phone. My old claim had money left but they won't let me touch it. Totally screwed until this gets fixed. The system is a joke.

little known fact: if u worked during ur benefit year but not enough to qualify for a new claim, they're supposed to put u back on ur old claim to use up remaining balance. but they almost NEVER do it automatically. u have to call and specifically ask for this

the dept of labor website is so misleading on this. it says ur eligible for 26 weeks of benefits but doesnt explain that the BYE date can cut you off before you use all 26 weeks. its all designed to confuse ppl
