NY unemployment benefits ran out but claim expiration is next year - what now?
So I've used up all my available benefit days but my claim doesn't expire until February 12, 2023. The system isn't giving me any option to file a new claim and I'm totally confused about what to do next. When I log in to check my payment history it shows zero days remaining but the expiration date is still months away. I tried calling the unemployment office but after waiting for over an hour the call dropped. Anyone else dealing with this? Do I need to file a new claim even though my current one technically hasn't expired yet? This is stressing me out because I still haven't found work and really need the income.

Yeah I had the same issue a few months back. If your benefit year isn't over but you've used all your benefit days, you won't automatically qualify for a new claim. It's super confusing because the system doesn't really explain this well. You've basically received all the benefits you're entitled to within your benefit year.

Its normal. You get a certain amount of benefit days per benefit year. Once those run out, you cant get more until your benefit year ends and you file a new claim. The DOL should send you a letter when its time to refile.

In NY unemployment, when your benefit days run out but your claim is still active, you're basically in limbo. Your benefit year establishment date (BYE) hasn't passed yet, but you've used all your entitled weeks. You need to wait until your BYE date passes to file a new claim. I believe what ur experiencing is normal. U get 26 weeks of benefits per benefit year. Once u use those up, u gotta wait til ur benefit year ends to file a new claim. The system is working as designed (even if it sucks for those of us who need help).

You need to understand the difference between benefit days and benefit year. Your benefit year is the period youre eligible to collect (usually 12 months from when you first applied). Your benefit days are how many weeks of actual payments you can get during that year (typically 26 weeks). Even though your benefit year goes until 2023, it sounds like you've used all your available weeks.

This happened to me! I called ny unemployment and they explained that once benefit days are exhausted, you cant get more until your benefit year expires. But they did say in certain circumstances you could qualify for additional help through other programs. I'd definitely try calling them... though good luck getting through 😫

As others have said, your benefit days are used up but your claim is still active. This is completely normal. Just to give you a personal example - I had a claim from March 2021 to March 2022, but my benefit days ran out in September 2021. I couldn't file a new claim until March 2022 when my benefit year actually expired.

Have u checked if ur eligible for partial benefits? If u can find even part time work, u might qualify for partial benefits that could stretch ur remaining benefits longer. Just a thought.

It might be worth double checking if you've actually exhausted ALL your benefits. Sometimes there are additional weeks available through different programs that you have to specifically request. But yeah in most cases once you've used your allotted weeks, that's it until your benefit year ends.
