Running out of days on ny unemployment claim with months left until BYE date - what next?
I'm down to only 3 days remaining on my unemployment benefits, but my Benefit Year End date isn't until May 2024. Wondering what happens once I exhaust these last few days. Do I need to file a whole new claim right away, or am I stuck waiting until my BYE date next May to reapply? Anyone gone through this before? The website is confusing and I can't get through on the phone. Really need this figured out since my job search is taking longer than expected and bills don't stop coming.

Once you use up all your benefit days, that's it until your BYE date, unfortunately. You can't file a new claim until after that May 2024 date unless you've worked and earned enough since you filed your original claim. The system is designed to give you a maximum number of days within that benefit year, and once they're gone, they're gone.

•Ugh that's what I was afraid of. Do you know how much I would need to have worked to qualify for a new claim before my BYE date?

•You need to have worked and earned at least 10x your weekly benefit rate in covered employment since filing your original claim. Plus meet all the other eligibility requirements again.

•this is correct 👆 but they make it unnecessarily complicated to figure out if you qualify

I was in the exact same situation last month. Tried calling the unemployment office for days and couldn't get through. Finally found this service called Claimyr (claimyr.com) that got me connected to an actual rep in under an hour! It was the best money I've spent to get my benefits situation sorted out. They told me I needed to have worked enough quarters to file a new claim, otherwise I'd need to wait for my BYE date. Check out this video that explains how it works: https://youtu.be/Rdqa1gKtxuE

•Is this some kind of scam? There's no way to get through to unemployment that easily...

•Not a scam at all! They basically call unemployment for you and stay on hold, then call you when they get a real person. Saved me hours of frustration. My claim had some weird issues and I needed to talk to someone asap.

•I used it last week. Got through in about 40 mins. The rep I talked to was able to fix my issue right away.

I went through this last year. You can't file a new claim until your BYE date unless you've worked since filing and earned enough to qualify. Even if you find work before May, you'd need to earn at least 10x your weekly benefit amount to qualify for a new claim early.

Just to add to what everyone's saying - start looking into other assistance programs NOW before your benefits run out. Don't wait until you're out of money. Check SNAP benefits, rental assistance, etc. The application processes take time.

•Thanks for the advice. I've already started looking into SNAP. Do you know if there's emergency assistance available when unemployment runs out?

•Yes! Look into Emergency Assistance to Adults (EAA) through your county's social services. Also check with local churches and nonprofits - many have emergency funds for people between benefits.

The ny unemployment system is such a nightmare 🤮 I spent WEEKS trying to get this exact question answered last year. Ultimately I had to work with a case manager at my local library who helped me navigate the system. Try your local library or workforce center, they often have people who can help for free.

This happened to me. I had 5 days left but my BYE date wasn't for 4 months. Here's what you need to know: First, yes, once those days are used up, you're done until either (a) your BYE date arrives or (b) you work enough quarters to qualify for a new claim. To qualify for a new claim before your BYE date, you need to have: - Worked and earned wages in at least two calendar quarters since your last claim - Earned at least 10x your weekly benefit rate in total - Have at least one employer who paid into the unemployment insurance system If you've had even part-time work during your claim, check if you meet these requirements. If not, you'll need to look into other assistance programs. If you need to speak to someone directly (which I recommend), use Claimyr.com - it got me through to an agent in under an hour when I'd been trying for weeks. The agent confirmed what I needed to qualify and checked if I had enough work history to file a new claim. Don't wait until your benefits run out to figure this out - call now! The unemployment system is extremely backlogged and you don't want to be without income while waiting for answers.

•Did you actually get a new claim before your BYE date? How long did the process take?

•I did! I had worked part-time for about 4 months while on partial unemployment. The process took about 3 weeks from application to first payment, but that was partly because they had to verify with my employer.

This is why NY unemployment is so broken. They don't make it clear what happens when you run out of days but still have months left in your benefit year. And then you can't even get someone on the phone to explain it! I've been through 3 cycles of unemployment benefits and it never gets easier ðŸ˜

This hapend to me. you DONT get more days. your benefit days are the total for the whole year. when there gone, there gone until your BYE date.unless u worked alot since your claim started.

•What counts as "alot"? Is there a specific amount needed?

•i think its like 10 times ur weekly benefit amount? so if u got $400 a week you need to have earned at least $4000 at a job since filing

You might be eligible for a 13-week extension depending on the current unemployment rate! Check if Extended Benefits (EB) is active in NY right now. The requirements change based on state unemployment levels.

•EB isn't active in NY right now. The unemployment rate isn't high enough to trigger it. That only happens during major economic downturns.

•Oh dang, thanks for the correction. That sucks for the OP then 😕

I found that calling right when they open at 8am is the only way to get through. Literally set an alarm and start dialing at 7:59. You'll still wait but at least you'll get in the queue.

•I tried this for a week straight and still couldn't get through. The system is completely overwhelmed

•Try claimyr.com instead, way easier than the alarm clock method lol

Whatever you do, DON'T file a new claim before talking to someone. My friend did that and it messed up his existing claim and took months to sort out. Get proper advice first.

I'm dealing with something similar right now - down to my last week of benefits with months left until my BYE date. From what I've researched and heard from others here, it sounds like we're basically stuck until either we qualify for a new claim (which requires significant work history since filing) or wait until the BYE date. Has anyone had success with getting temporary assistance programs to bridge the gap? I'm worried about the time it takes to get approved for things like SNAP and rental assistance. Also wondering if there are any local programs in NYC specifically that might help during this transition period. Really appreciate everyone sharing their experiences - this whole system is so confusing and stressful when you're already dealing with job search anxiety!

•I'm in NYC too and went through this exact situation a few months ago. For SNAP, the application process took about 2 weeks from submission to approval, but you can get expedited processing if you qualify (basically if your income is super low and you have less than $150 in resources). For rental assistance, look into ERAP (Emergency Rental Assistance Program) - they're still processing applications and it can cover past due rent. Also check with 311 for local emergency assistance programs. Some community organizations in the boroughs have emergency food pantries and utility assistance that don't require the same waiting periods as government programs. The Human Resources Administration also has a Cash Assistance program that might bridge the gap, though the application process can be lengthy. Start applying for everything NOW while you still have that last week of benefits coming in. Don't wait until you're completely out of money!

I'm in a very similar boat - just got down to my last 2 weeks of benefits and my BYE date isn't until June. Reading through all these responses has been super helpful, especially about the 10x weekly benefit rule for qualifying for a new claim early. One thing I wanted to add that I learned from my local workforce development center: if you do have some work history since filing but aren't sure if it's enough to qualify, DON'T guess! They told me that filing a new claim when you don't actually qualify can create a mess in the system that takes forever to untangle. Also, for anyone in a similar situation - I started the SNAP application process last week and they have an online pre-screening tool that gives you an idea if you'll qualify and for how much. It at least helps with planning while you wait for the full application to process. This whole system really needs to be clearer about what happens when you exhaust days before your BYE date. It's stressful enough being unemployed without having to decode all this bureaucracy! 😤
