Can I file a new NY unemployment claim after using my last 4 days or must I wait until BYE date?
I'm getting really worried about my unemployment situation. I only have 4 days remaining in my current NY unemployment claim. My Benefit Year End (BYE) date isn't until June 2025 (next year). What happens after I use up those last 4 days? Can I immediately file a new claim, or am I stuck waiting until my BYE date in June 2025 to file again? I really need continuous benefits if possible since my job search isn't going well. Anyone know the rules about this?

The previous comment isn't entirely accurate. You actually have options after exhausting your regular UI benefits. If you've worked since filing your original claim and earned enough wages in at least two quarters, you might qualify for a new claim before your BYE date. Otherwise, you may be eligible for extended benefits programs if they're currently available. Check the NY DOL website for current extension programs as they change based on unemployment rates.

I went through this exact situation last winter. After my regular benefits ran out, I called and explained my situation. The rep told me I needed to have earned at least 10x my weekly benefit amount since filing my original claim to qualify for a new claim before my BYE date. I had enough earnings, so they helped me file a new claim right away. If you've worked those 3 months since your original claim, you'll likely qualify. BUT - and this is important - you MUST speak with an actual agent to have this processed correctly. The online system won't handle this special situation properly.

Try calling at EXACTLY 8:00am when they open. That's how I got through last time I had an issue. Have all ur info ready when u call so u don't waste time looking for it.

After struggling to reach NYSDOL for weeks about a similar issue, I finally used Claimyr (claimyr.com) and got through to an agent in about 20 minutes. They have this video showing how it works: https://youtu.be/Rdqa1gKtxuE The agent confirmed that since I had enough work history between claims, I could file a new claim immediately after my benefits exhausted. You need to have earned wages in at least two calendar quarters since your original claim filing date, and the total needs to be at least 10 times your weekly benefit rate. The agent processed everything while I was on the phone.

•They already had my wage information in their system from my employer's quarterly reporting. But I did have my pay stubs ready just in case. Definitely have documentation of your work dates and earnings when you call.

I'm actually confused about something related to this. If someone files a new claim before their BYE date expires (because they exhausted benefits and have new work history), does that reset their BYE date to a year from the new claim? Or does it still operate on the original BYE timeline?

If you've worked since filing your original claim and earned enough in at least two quarters (typically 10x your weekly benefit amount), you can file a new claim immediately. 2. If you haven't worked enough, you need to wait until your BYE date to file a new claim, unless there are special extension programs available. Don't risk a gap in payments by waiting until the last minute. Start the process as soon as you see you only have a few weeks of benefits remaining.
