Will my NY unemployment benefit rate change with few effective days left before BYE?
My Benefit Year End (BYE) date for my traditional NY unemployment is coming up in April 2025. I still have like 6 or 7 effective days left on my claim. Will I still get my usual weekly benefit amount for these remaining days, or does the rate change somehow when you're close to your BYE date? I'm trying to budget for next month and need to know exactly what I'll be getting.

Your weekly benefit amount stays the same until your benefit year ends, regardless of how many effective days you have left. Each effective day is worth 1/4 of your full weekly benefit amount, so with 6-7 days left, you should receive 1.5-1.75 weeks of benefits at your regular rate. After your BYE date, you'll need to file a new claim if you're still unemployed.

The benefit amount won't change, but you need to watch out for the BYE date. A lot of people don't realize you MUST file a new claim once your benefit year ends, even if you still had days left. The system won't automatically carry over those remaining days - I learned this the hard way and lost a week of benefits thinking it would just continue.

•EXACTLY THIS!! The NYSDOL website is SO misleading about this. They don't make it clear AT ALL that you need to refile right after your BYE date. I had 5 days left when my year ended and thought I'd get those benefits but NOPE! Had to start a whole new claim and wait WEEKS for it to process while bills piled up.

One thing nobody mentioned - you might actually be eligible for a higher weekly benefit on your new claim if you had any work during your benefit year with higher wages. Worth checking if your new benefit rate might be better anyway!

•yeah its legit, they just help you get through the phone system faster. i was skeptical too but was desperate after trying for weeks. they don't ask for any personal stuff beyond your phone number so they can call you when they get an agent

I'm in almost the exact same boat! My BYE is in May and I have 9 effective days left. When I called about it (took FOREVER to get through), the rep told me they don't prorate the last week either. So if you have 3 days left, you'll get 3/4 of your weekly benefit, but if you have only 2 days left, you might not get anything for those last 2 days since they need at least 3 days to process a partial week payment. Not 100% sure if that's right but that's what they told me.

•thats not true u get paid for every day left even if its just 1 day! each day = 1/4 of ur weekly. my last payment was for 2 days and i got half a week.

Just to add some clarity on what happens at the BYE date: 1. Your benefit rate stays exactly the same until your BYE date 2. You can collect all remaining effective days at that same rate 3. After your BYE date, you must file a new claim even if you had days remaining 4. Your new claim will have a new benefit calculation based on your base period wages 5. There will typically be a 2-3 week gap between claims while your new application processes The NY DOL should send you a notification about 2-3 weeks before your BYE date reminding you to file a new claim if you're still unemployed.
