NY unemployment payment confusion - will benefits continue after BYE date with remaining effective days?
My friend is confused about her NY unemployment benefits situation. She still has effective days remaining but her benefit year end (BYE) date is coming up in March 2025. She's wondering if she'll still get her regular weekly payment (minus the $300 federal supplement that ended). Will her payments just continue normally until she runs out of effective days, or does something change when she hits her BYE date even with days left? Also, does she need to refile anything when March comes around?

Benefits typically end on your BYE date regardless of how many effective days you have remaining. Your friend will need to file a new claim after her BYE date in March 2025. The system is designed this way to reassess eligibility based on more recent employment. However, if she hasn't worked and earned wages since filing her original claim, she might not qualify for a new claim. In that case, she would need to contact NYSDOL directly to discuss her options.

•Thanks for explaining! So even though she has days left, they basically disappear when March comes? That seems unfair... Is there any way to use those remaining days?

my bye date was last month, had like 60 days left and they cut me off completely. had to file new claim. took 3 weeks to process. sucked.

•Oh no, that's exactly what I was afraid of! Did you end up getting the same weekly amount on your new claim?

When is your friend's EXACT BYE date? The DOL website literally says "If you are receiving benefits and still have days remaining on your claim when you reach your BYE date, you MUST file a new claim to continue receiving benefits." So yes she definitely needs to refile, and NO those remaining days don't carry over!!! I learned this the hard way and went 6 weeks without benefits because I thought it was automatic!

•Her BYE date is March 14, 2025. That's really unfair that the days just disappear! Did you get backdated payments for those 6 weeks once your new claim was approved?

NO I DIDN'T GET BACKDATED AT ALL! That's why I'm saying she needs to file THE DAY AFTER her BYE date! Mark March 15 on her calendar NOW and tell her to file first thing that morning. The system is designed to screw people over. And they'll make her wait for the new claim to process even though she was already in the system.

•I had a similar situation last year and found a way to actually get through to someone at NYSDOL who helped get my claim processed faster. I used this service called Claimyr (claimyr.com) that got me connected to an agent in about 20 minutes instead of spending days calling and getting disconnected. They have a video that shows how it works: https://youtu.be/Rdqa1gKtxuE It made a huge difference when I needed to sort out my BYE date issues. I was getting really stressed about the gap in payments, but the agent I spoke with was able to expedite my new claim.

•That's concerning. To clarify: continuing to certify AFTER your BYE date without filing a new claim can technically be considered misrepresentation. The system should prevent this, but if there's a glitch and it allows certification, you could be held responsible. Always file a new claim immediately after your BYE date if you need to continue receiving benefits.

Hey there - just to add to what everyone's saying, your friend's situation is super common. BYE dates basically reset everything, even if you have days left. It sucks but that's the system. Tell her to definitely file that new claim ASAP when March comes around.

•Thanks! I'll let her know. I'm going to tell her to set a reminder so she doesn't forget. Is there anything specific she needs to prepare before refiling?

For your friend's March 2025 refiling, she should have these documents ready: 1. Employment records for all work since her last claim 2. W-2s or 1099s for 2024 3. Any separation notices if she worked briefly during her claim period 4. Her Social Security number and NY.gov ID information The refiling process takes approximately 2-3 weeks if everything is in order. I recommend filing the new claim immediately after midnight on March 15th for fastest processing. Also, remind her that she must continue to certify weekly during the waiting period, even though payments won't be released until the new claim is approved.

•This is incredibly helpful, thank you! She hasn't worked at all since filing her original claim, so I'm worried she might not qualify for a new claim period. Will that be a problem?

If she hasn't worked since filing her original claim, she likely won't qualify for a new UI claim because she won't have earned any wages in her new base period. However, she should still file because NYSDOL will review her claim and determine if she's eligible for what's called a "transitional claim" based on her previous employment. The system will automatically review this - she just needs to answer the questions truthfully during the application process.

•Oh that's good to know about the transitional claim possibility! I'll pass that along to her. Really appreciate all this help.

•Good to know! I hope my friend doesn't need it, but it's nice to have options if things go wrong with her claim in March.

One more thing - tell your friend to print out her payment history and effective days remaining BEFORE her BYE date hits. Nice to have a record just in case there are questions later.

•Smart idea! I'll definitely tell her to do that. Better safe than sorry with these unemployment systems.
