NY unemployment BYE date ended but can't file new claim after earning 10x weekly benefit

My benefit year is ending this weekend (09/2025) and my effective days just hit 0. I'm working part-time now and I've definitely earned more than 10x my weekly benefit amount since my claim started. From everything I read on the NY unemployment website, I'm supposed to file a new claim when my BYE date ends if I've earned 10x my benefit rate. But here's the problem - the system won't let me file a new claim either online or by phone! It just keeps redirecting me back to my existing claim. Has anyone dealt with this situation before? Do I need to wait until exactly after my BYE date passes? I'm worried about a gap in my benefits since I still need the partial unemployment with my part-time hours.

I went through this EXACT same thing in March. The system is so frustrating!! You actually CAN'T file a new claim until your BYE date has completely passed. So if your BYE date is on a Sunday, you have to wait until Monday to file the new claim. Even though the website says you should 'apply before your benefit year ends' - that's actually impossible with how their system works. Just wait until Monday and try again.

Thank you! That makes sense but is so confusing with their instructions. I'll try again on Monday then. Do you remember if there was any gap in your payments when you did this?

There was about a 2 week gap for me because they had to review my new application. But I got all the back payments once it was approved. Just make sure you keep certifying every week even while waiting for the new claim to process!

This is a common issue with the NY system. The 10x rule is correct - if you've earned 10x your weekly benefit amount during your benefit year, you must file a new claim after your BYE date. The key part is "after" your BYE date. The system is programmed to not allow new applications until the exact day after your current benefit year ends. When you do file, be prepared to provide all your employment information since your last claim. They'll verify your earnings and determine your new benefit rate based on your recent work history. Since you've been working part-time, you should qualify for a new claim, but your weekly benefit amount might change based on your earnings during your base period.

wait is this the 10x rule thing for pandemic benefits? I thought that ended?

No, the 10x rule is a standard part of regular New York unemployment insurance, not related to pandemic programs. It simply means you need to have earned at least 10 times your weekly benefit amount during your benefit year to qualify for a new claim without serving a waiting week. This rule predates the pandemic and continues to be in effect.

I tried calling for THREE DAYS straight when this happened to me in June. Couldn't get through at all, just kept getting disconnected. Finally I used this service called Claimyr (claimyr.com) that got me connected to an agent in about 20 minutes. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE The agent confirmed what others here are saying - you have to wait until after your BYE date passes. But they also helped me set up my new claim over the phone which was way easier than doing it online. They walked me through all the right answers for my part-time situation.

Thanks for the tip! If I have trouble on Monday I might try that service. The phone system is so frustrating, I've been hung up on so many times.

did you have to pay for claimyr? seems sketchy

Yes, there's a fee, but it was worth every penny to me after spending days trying to get through. They just help you connect to an actual agent. Saved me hours of frustration and got my benefits sorted out quickly.

Can I just say how STUPID this whole system is??? They tell you to file before your BYE date but then make it IMPOSSIBLE to actually do it! And they never explain this anywhere on the website! I wasted SO MANY HOURS trying to file early because that's what their instructions said!!! Why can't they just update their website to tell people the truth about when they can file?!? The DOL is a complete disaster and nobody there cares about fixing anything!

I feel your pain. The conflicting information is incredibly frustrating. The website does need updating to match how the system actually works. In my experience working with clients navigating unemployment, I've found the technical limitations of their system often contradict their own written guidance. Always best to wait until the day after your BYE date to avoid these system errors.

i had this happen 2 me also! the secret is just waiting til after ur BYE date exactly passes. like if it ends on a sunday wait til monday morning. annoying but thats how it works.

Thank you! I'm definitely seeing a pattern here. I'll wait until Monday for sure.

UPDATE: You were all right! I waited until Monday (the day after my BYE date) and was able to file a new claim. The system actually worked pretty smoothly once I waited for the right day. They said it might take 2-3 weeks to process the new claim, but I can keep certifying weekly while I wait. Thank you all for your help!

Great to hear! Make sure you continue to certify every week while waiting for the new claim to process. And just a reminder that your new weekly benefit amount might be different based on your earnings over the last 18 months. Since you've been working part-time, your new calculation will include those wages.

Awesome! Glad it worked out! And yes definitely keep certifying every week so you'll get all your back payments once approved.

For anyone else reading this thread with a similar issue, here's a quick guide to the BYE date process: 1. Wait until the day AFTER your BYE date to file a new claim 2. Continue certifying weekly during the transition period 3. Have your employment information ready for all jobs since your last claim 4. Be prepared for a 2-3 week processing period for the new claim 5. If you've earned at least 10x your weekly benefit amount during your benefit year, you should qualify (assuming you meet other eligibility requirements) 6. Your new weekly benefit amount will be calculated based on your base period wages 7. Part-time workers can still qualify for partial benefits Hope this helps others navigating this confusing transition!
