NY unemployment benefit year ending - can't reapply despite meeting 10x requirement
My benefit year is ending in November 2023 and my effective days will hit zero this week. I've been working part-time while claiming, and I've definitely earned more than 10x my weekly benefit amount since starting my claim. From what I understood on the NY unemployment website, this means I should qualify to file a new claim. However, when I tried to apply online yesterday, the system wouldn't let me submit a new application. I also tried calling but kept getting transferred to an automated message saying I couldn't file a new claim at this time. Has anyone dealt with this before? The weird thing is I meet all the requirements they list for requalifying, but the system just won't let me file. Not sure if I should keep trying online, keep calling, or if there's some other process I'm missing?

I had the same issue back in August. Had to wait until the EXACT date my benefit year ended, not a day before. Also, even though I earned more than 10x my weekly benefit, they still made me reapply entirely from scratch which was super annoying.

•So did you have to wait until all your effective days were used up AND your benefit year expired? Or just the BYE date?

•Had to wait until the BYE date. I still had like 3 effective days left when I was finally able to reapply. The system is programmed to block you until then no matter what.

After going thru unemployment hell last year, I found a service called Claimyr that actually got me thru to a real person at ny unemployment. It saved me from weeks of trying to get answers on my own. I used it when my BYE date came up and the agent told me exactly what to do. Best money I ever spent to get my benefits flowing again. Check it out: claimyr.com or watch this: https://youtu.be/Rdqa1gKtxuE

•Is this actually legit? Sounds too good to be true with how impossible it is to reach anyone 🤔

•100% worked for me. They basically call repeatedly and when they get thru, they connect you. Got a callback in about 40 min when I'd been trying to call myself for days. The agent fixed everything on the spot.

•another day, another company promising to fix the unfixable unemployment system lol. Has anyone else actually tried this?

•I used it about 2 months ago when my account got locked. They got me through to an agent who unlocked everything while I was on the call. Totally worth it.

•wait hold up - does this actually work or is it just the usual BS? I've tried calling hundreds of times...

•It's real. Think about it - they only make money if they actually get you through. Got my issue resolved in one call instead of weeks of frustration.

The 10x rule is super confusing. Basically your new claim can only be filed on or after your BYE date, not before. Even if you meet all requirements. I had a similar situation and had to wait until my exact BYE date (3/23) before the system would let me file. It's dumb but thats how it works.

Having worked through the NY unemployment maze multiple times, here's what's happening: The system is designed with an absolute lockout until your BYE date, regardless of your work history or earnings. Even if you've met the 10x requirement (which just means you're eligible for a new claim), you cannot file until exactly on or after your BYE date. What to do: 1. Wait until your exact BYE date in November 2023 (not a day sooner) 2. Try filing online first thing that morning 3. If the system still blocks you, you'll need to speak with an agent The fastest way to get an agent is using claimyr.com - it's a service that calls for you and connects you when someone answers. Much better than spending days hitting redial. Keep all your employment records and pay stubs handy - they'll need to verify your work history for the new claim. The system often has issues with part-time work calculations, which is another reason why talking to a human agent helps. Don't wait until your effective days hit zero to start this process - plan to file exactly on your BYE date to minimize any gap in payments.

•Thank you so much for this detailed explanation! I'll definitely try right on my BYE date then. Have you had experience with them questioning part-time work on a new claim?

•Yes - they often scrutinize part-time work more closely on reapplications. Make sure you have exact dates, hours worked, and earnings for each week ready to go. It can slow down your approval if the numbers don't match their records.

The whole system is trash. My BYE was in July and even after waiting till the exact date, I still couldn't file online. Ended up having to call like 50 times before getting through. Such a waste of time.

•50 times?? You got lucky. I called 237 times (yes I counted) over 3 days before getting through last month 💀

•The system is literally designed to make people give up. It's criminal how they treat people who just need help.

Im dealing w/ this right now. They wont let u file until midnight of your BYE date. Not a minute sooner. And sometimes the system glitches even then. I ended up using claimyr.com to get a rep on the phone who manually filed my claim for me. Otherwise I was stuck in limbo for weeks.

Check if you have any outstanding issues on your account. Even tiny things can block you from filing a new claim. I had an unresolved ID verification from months earlier that I didn't know about, and that was stopping me from reapplying.

•How do I check for outstanding issues? I don't see anything flagged in my online account.

•You probably won't see it online. The only way to know for sure is to talk to a rep. I found out by finally getting someone on the phone who could see notes on my account that weren't visible to me.

Here's a weird trick that worked for me: try filing exactly at midnight when your BYE date starts. Less system traffic and sometimes bypasses the glitches. Worked for me and two friends.

•I can confirm this! Did this back in February and it worked while everyone else was complaining about system errors during business hours.

Have you tried logging out completely, clearing your browser cache/cookies, and trying on a different device? Sometimes the NY unemployment site has weird technical issues that can be bypassed this way.

they changed the rules recently!!! you now have to wait 3 business days AFTER your BYE date before filing a new claim. my cousin works for NYSDOL and told me this. its not documented anywhere online yet. 🤦‍♀️

•Is this for real? Why would they make it even MORE complicated? Typical NY unemployment nonsense...

•Swear on everything. He said it was part of their new "system update" in October. Supposedly to "reduce errors" but really just makes more work for everyone.

•I don't think this is true. I just filed a new claim last week on my exact BYE date with no issues.

•maybe ur claim was processed under the old rules? or maybe they're rolling it out gradually? idk just sharing what I heard 🤷‍♀️

I had to file a FOIL request to get someone to actually look at my reapplication issues. Sounds extreme but it worked when nothing else did. Google "NY FOIL request unemployment" if you want to go nuclear on them.

this exact thing happen to me last winter. i waited till my bye date and nope, system still blocked me. turns out there was a special form I had to fill out first because I had been working part-time. Try calling their technical support line instead of the regular claims line.

Javier Morales
•Do you remember what the form was called? And is the tech support line different than the main number?
0 coins
Mateo Gonzalez
•It was some kind of "partial employment review" form. And yeah its a different number: 888-209-8124 then press 2 for technical issues instead of 1 for claims.

Contact your state assembly person! This is literally what they're there for. My claim was stuck for 2 months, called my assembly member's office, and magically it was fixed within 48 hours.

OMG the 10x rule is such a nightmare. The system is rigged to make us fail. I went through this in July and ended up having to go to an in-person career center after trying everything else. It was the only thing that worked.

Javier Morales
•There are in-person centers where you can get help with unemployment claims? I didn't know that was an option.

Luca Ricci
•Yes! NY has career centers where unemployment staff sometimes work. Google "NY career center near me" and call to ask if they handle UI issues before going.

anyone else think it's suspicious they make it so hard to reapply? like they're hoping people just give up? i swear the whole system is designed to stop eligible people from getting benefits.

•I used to work for a state agency (not NY). This is 100% by design. They count on a certain % of eligible people giving up out of frustration.

I had a similar problem and found out it was because I had reported some self-employment income during my benefit year. Had to verify all that before they'd let me file a new claim. Check if that applies to you.
