NY unemployment benefits exhausted before September 5th deadline - why did my benefits end early?

I've been working part-time (more than 4 days per week) so I know I shouldn't receive benefits for those weeks. However, when I called the toll-free certification number today, the system told me my unemployment insurance is now completely exhausted. I thought my benefit year wasn't supposed to end until September 5th, 2025. Could it be because I still claimed for the last two weeks even though I was working? Did that somehow trigger my claim to close early? I'm confused because I thought I had at least 6 more weeks of benefits remaining in my balance.

did u check ur payment history online? sometimes the phone system says weird stuff but ur account might still be active

I haven't checked online yet. The automated phone system was pretty clear though. I'll log in and see what it says there. Thanks for the suggestion.

Working more than 4 days per week makes you ineligible for benefits in that week, but shouldn't exhaust your benefits completely. There are a few possible explanations: 1. You may have reached your maximum benefit entitlement (the total dollar amount you were approved for) 2. Your benefit year ended (claims typically last for 12 months from the initial filing date) 3. There could be a system error or misunderstanding of the automated message I recommend checking your payment history online as suggested above, and also look at your "Remaining Balance" on your account summary page. That will tell you if you truly exhausted your benefits or if something else is happening.

Thank you, this is really helpful. I didn't realize there was a maximum dollar amount separate from the time period. I'll check my remaining balance online.

The same thing happened to me last month! The system said my benefits were exhausted but when I called an agent they told me it was just a glitch and fixed it on their end. Took me THREE DAYS of calling to finally get through to someone though ugh

Three days?! That's ridiculous. I've been trying to call all morning without success. Did you just keep redialing or is there a better time to call?

I just kept redialing over and over until I wanted to throw my phone out the window lol. I think earlier in the morning is better but it's still nearly impossible

To clarify what's happening: in NY, unemployment benefits exhaust in two ways - either by reaching the end of your benefit year OR by using up your maximum benefit amount, whichever comes first. If you've been claiming but reporting that you work more than 4 days, those weeks still count toward your benefit year timeline, even though you received $0 for those weeks. However, since you weren't paid for those weeks, your benefit balance shouldn't have decreased. You should check your payment history and remaining balance online at labor.ny.gov to confirm your status. This is likely one of three things: 1. Your benefit year ended (separate from the 9/5 date you mentioned) 2. You misunderstood the automated message 3. There's a system error that needs a claims specialist to fix

I just checked online and it says my benefit balance is $0. But my benefit year definitely hasn't ended yet - I only started claiming in January 2025. I'm thinking this must be a system error?

I had to deal with a similar situation a couple weeks ago. Found out it was way faster to use Claimyr to get through to an agent (claimyr.com). After trying for days on my own, I used their service and got connected in about 15 minutes. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE The agent told me that sometimes when you certify for weeks you're ineligible for (like when working 4+ days), it can trigger system issues if done repeatedly. They fixed it on their end and restored my remaining balance.

Is that service legit? Sounds too good to be true with how impossible it is to reach NYSDOL lately.

Thanks, I'll look into this. At this point I'm desperate enough to try anything to get this fixed.

You shouldn't be certifying AT ALL if you're working more than 4 days!!! The system probably flagged you for improper certification even though you reported correctly. Now you'll probably have to wait weeks for them to review your claim...

This isn't entirely accurate. The NYSDOL system actually allows (and sometimes encourages) people to continue certifying even when they're working full-time, as it helps maintain accurate records in their system. As long as you truthfully report your work days, there's no penalty or flag for certifying while ineligible. The system simply records a $0 payment for that week.

UPDATE: I finally got through to a representative! They explained that there was indeed a system error. Apparently, when I certified for those two weeks while working full-time, the system incorrectly processed them as if I had received benefits (even though I reported working 5 days and received $0). This caused my benefit balance to incorrectly show as exhausted. The rep fixed it on their end and my correct remaining balance is now showing. They advised that in the future, if I'm working more than 4 days consistently, I should stop certifying until I need benefits again.

Thanks for updating us! This is actually a known glitch that happens sometimes with the NY system. Glad you got it resolved. Did they tell you how long it will take for the correction to fully process in the system?

nice! how did u finally get thru to someone??

I'm in a completely different situation but reading this thread made me realize I've been making a similar mistake! I've been working 3 days a week and certifying but I think I've been answering one of the questions wrong... now I'm worried I've messed up my claim. Has anyone had to do a backdated certification correction before?

Yes, you can request backdated certification corrections. Call NYSDOL and explain exactly which weeks and what information needs to be corrected. They may ask you to submit documentation through your online account or by mail. Just be honest about the mistake - they're generally understanding if it was unintentional.
