Does ny unemployment BYE date mean I can't certify anymore or just my last day to claim?

My benefit year end date is showing as 8/21. Does that mean the week ending 8/21 is the last week I can claim for, or can I not certify at all starting that date? I've been on UI since last August when my restaurant closed permanently. Now I'm working part time but still claiming partial benefits. Not sure if I should be preparing for benefits to stop completely or if I can apply for an extension. Anyone know how this works?

Your BYE date (8/21) means that's when your claim year ends. You can still certify for the week ending on that date, but after that you'll need to file a new claim. Since you're working part time now, you might qualify for a new claim with a different weekly benefit amount based on your earnings in the last 18 months. The system should prompt you to reapply when you try to certify after your BYE date.

Thanks for explaining! So I should just try to certify as normal after 8/21 and the system will tell me what to do next?

Yep exactly! The system will guide you through the process. Just be ready to provide your employment history for the past 18 months when filing the new claim.

FYI - make sure you have your wage info ready when you reapply. They'll look at a different base period for your new claim calculation.

When my BYE date hit, I couldn't get through to anyone for weeks. Kept calling the 1-888 number with no luck. Finally I tried this service called Claimyr (claimyr.com) and they got me a callback with an actual agent within a couple hours! Talking to the agent got my benefits flowing again so fast. Seriously was the best solution after days of frustration. Check out this video about it: https://youtu.be/Rdqa1gKtxuE

wait is that actually real? sounds like another scam tbh 🤔

0 coins

Not a scam at all! It literally just calls the unemployment line for you and stays on hold, then calls your phone when a real person picks up. Saved me from wasting hours of my life on hold.

0 coins

yeah right, another 'miracle solution'... what's the catch? 🙄

0 coins

No catch - it just automates the calling and holding process. Totally worth it to not spend days trying to get through. My issue got fixed in one call after using their service.

hmmm I've been burned by so many of these 'services' before... what makes this different?

0 coins

It's different because it actually WORKS lol. It's not promising to file for you or anything sketchy. It just gets you past the impossible hold times so you can talk to a real person.

I just went through this last month! So the BYE date is the end of your benefit year. You'll need to file a new claim after that date - don't worry, the system walks you through it. Since you're working part-time, they'll calculate a new weekly benefit amount based on your earnings in the last base period. Be ready with all your employment info.

The NY unemployment system is such garbage. I had the same question when my BYE date came up. Tried calling for DAYS with no answer. finally just filed a new claim online and it eventually went through. took almost 3 weeks to start getting payments again tho 😡

0 coins

3 weeks?? That's terrifying. I can't go without income for that long. Did they backpay you at least?

0 coins

Yeah they did backpay eventually but it was super stressful not knowing when/if the money would come through. Try to have some savings ready just in case.

THIS is why I ended up using claimyr.com - couldn't afford to wait weeks for my claim to go through by itself. Got it sorted with one phone call once I actually reached someone.

After your BYE date, you gotta file a whole new claim. It's annoying af but that's how the system works. They recalculate your benefits based on your most recent work history. If you've been working part time that'll factor into your new weekly amount. It's a complete restart of the process - not an extension.

0 coins

When you say recalculate, does that mean my weekly amount could go down since I'm only working part time now?

0 coins

Yeah unfortunately. They look at your highest earning quarters in the base period. If you were making less at your part-time job than before, your benefit amount will probably be lower.

I've been through the BYE date process a couple times with ny unemployment during the pandemic. Here's what happens: - Your BYE date is the last day of your current claim - You CAN certify for the week that includes that date - After that, the system will tell you to file a new claim - They'll review your work history for the past 18 months - If you've worked enough quarters, you'll qualify for a new claim - If you haven't worked enough, you might not qualify for a new round - The process can take 2-3 weeks to process Since you've been working part-time, you'll definitely have some wages in your base period, which is good news. Just be prepared for possibly a lower weekly benefit amount based on your current wages. If you have trouble getting through to anyone when filing your new claim (which is super common), I'd recommend using claimyr.com - it's a service that gets you a callback with an actual agent instead of waiting on hold forever. Worth every penny when I was dealing with my claim issues!

This is exactly what I needed to know! Thank you so much for the detailed breakdown. I'll check out that service if I run into problems.

not falling for another unemployment 'hack'... these never work

0 coins

It's not a hack lol. It's just a service that calls and waits on hold for you. Trust me, when you've been trying to reach unemployment for days with no luck, you'll try anything.

dont panic! Just file a new claim after ur BYE date. The system will tell u what 2 do. just keep certifying like normal and it'll prompt u 2 file a new claim when the time comes.

0 coins

BYE date = end of your benefit year. You gotta file a whole new claim after that, based on your most recent 18 months of work. Since you've been working part-time, you should qualify for something, but probably at a lower amount than what you're getting now.

0 coins

This is accurate. I went through this last month and my benefit amount dropped by about 40% because I'd been working reduced hours. Better than nothing tho!

0 coins

So many wrong answers here!!! 🤦‍♀️ The BYE date doesn't automatically mean you need to file a new claim! If you're on regular UI (not extensions) then yes you need to reapply. But if you're on any kind of extension program, you might continue without filing a new claim. Best thing is to CALL and find out your specific situation.

0 coins

Extensions aren't a thing anymore tho? All the pandemic programs ended last year...

0 coins

Oh you're right, my bad! I was thinking of how it worked before. Yeah, with regular UI now you definitely need to file a new claim after BYE date.

0 coins

just went through this! after BYE date you file new claim, but warning: took me 6 WEEKS to get approved again 😱 system is broken af

0 coins

Six weeks?! That's terrifying. Did they pay you retroactively once approved?

0 coins

eventually yes but I had to call like 50 times. finally got through using claimyr.com after wasting days trying to call myself. But yeah they did backpay everything once it was fixed.
