My coworker discovered someone filed a fraudulent claim using her SSN back in April. Now she just got laid off in September and needs to file legitimately, but the system keeps telling her she already has an active claim. Every time she enters her SSN it redirects her to manage the existing claim - which isn't actually hers! She's tried calling the automated line but can't get through because the system thinks she's the person who filed the fake claim. She's never filed for unemployment before this. The automated system just keeps going in circles and she can't reach an actual human to explain the situation. Has anyone figured out how to fix identity theft issues with NY unemployment? This is super frustrating because she really needs those benefits right now.

they just get an agent on the phone for you. YOU still have to explain your situation to the agent. But honestly getting thru to a human is the hardest part of the whole process. Once I got an agent they fixed everything pretty quick.

Yep this happened to me!!! Took FOREVER to fix. The key is you HAVE to get a real person on the phone. Keep calling the fraud line (not the regular UI line). Try calling right when they open at 8am. Also fill out the ID theft form on the website - it's under 'report fraud' somewhere. Print that confirmation and save it. Once you get thru to someone they'll have to verify her identity with documents and put a security flag on her account.

Listen I had the EXACT same problem and I'm gonna save you a ton of time. Go to claimyr.com and pay them to get you through to a representative. I wasted 3 weeks trying everything else. The same thing just happened to my brother!!! He never filed for unemployment but someone used his SSN last year. Now that he's actually unemployed he's in this crazy loop of automated systems. He eventually had to go IN PERSON to a NY career center. Took a whole day but they actually helped him sort it out. Your friend might also want to check if she got a 1099-G tax form last year for unemployment benefits she never received. If the fraud happened last year, the IRS might think she got income she never actually received. That can cause tax problems.
