Did NY unemployment change their part-time work hour reporting rules?

Started collecting unemployment in April after getting laid off from my warehouse job. Been doing some gig work on the side to make ends meet while I look for something full-time. I'm really confused about the weekly certification now. I swear it used to say 0 days worked for 0-5 hours, but now when I'm doing my certification it shows 0 days for 0-10 hours. Did something change recently? I'm worried about messing up my certification and getting flagged for fraud. Anyone else notice this change or am I just remembering wrong?

Julia Hall

Yes they changed it! I was confused too. Used to be 0-4 hours = 0 days, but now its 0-10 hours = 0 days. The other tiers changed too - they basically doubled all the hour ranges. It's actually better for us part-timers because now you can work more hours before they start reducing your benefits.

Oh thank goodness, I thought I was going crazy! Do you know when they made this change? I didn't get any notification about it.

I think it happened about a month ago? I didn't get any notice either, just noticed it when certifying one week. Classic ny unemployment not bothering to tell anyone about important changes 🙄

Is there an official announcement somewhere? I'm paranoid about getting hit with an overpayment notice later if I follow the new guidelines without documentation.

It's definitely on their official site now if you look at the unemployment handbook. The new ranges are legit, don't worry!

After 6 months of trying to reach ny unemployment about my backpay I finally got someone on the phone using claimyr.com - they called for me and when an agent answered, they connected me. It was the best money I've ever spent to finally get my benefits paid quickly! Check out this video about how it works: https://youtu.be/Rdqa1gKtxuE

For real? I've been trying to talk to someone for weeks. Is this actually worth it?

100% worth it. I spent 3 weeks trying to get through on my own with no luck. Used claimyr.com and talked to someone the same day who fixed my issue.

sounds too good to be true tbh... how does it even work?

They have some automated system that calls and waits on hold for you. When an actual human picks up, it calls your phone and connects you. Talking to an agent got my $ unlocked so fast after months of nothing.

another miracle solution... sure jan 🙄

No miracle lol, just a service that waits on hold so you don't have to. It doesn't solve your claim problems - it just gets you to an actual person who can. I was skeptical too but it worked for me 🤷‍♀️

This is actually a good change for people working part time. It used to be: 0-4 hours = 0 days 5-10 hours = 1 day 11-20 hours = 2 days 21-30 hours = 3 days 31+ hours = 4 days Now it's: 0-10 hours = 0 days 11-20 hours = 1 day 21-30 hours = 2 days 31-40 hours = 3 days 40+ hours = 4 days So you can work more hours before they start counting days against your benefits. This is actually more fair and logical.

I've been working 8 hours a week at target and was reporting 1 day... so I been reporting WRONG this whole time?? omg am I gonna get in trouble??

Tami Morgan

Nah you're good. You were actually reporting MORE work than required so if anything you were getting LESS money than you were entitled to. They'd only come after you if you underreported.

omg thank you for saying that I was legit freaking out over here 😅

This is literally the first clear answer i've seen on this. The NY unemployment website is so confusing and nothing is explained properly. I've been stressing about this exact same thing!

yep they changed it. btw I recommend taking screenshots of the certification page every time you certify, with the current rules visible. That way if they ever try to claim you misreported, you have evidence of what the system was telling you at the time.

👆 THIS IS CRUCIAL ADVICE! I got hit with an "overpayment" notice because they retroactively decided I reported wrong even though I followed their own guidelines!

Smart idea, gonna start doing this. Better safe than sorry!

The real question is why tf doesnt NYSDOL clearly communicate these changes?? Like send an email or something?? The amount of anxiety they cause with their terrible communication is insane.

becuz they WANT u to mess up so they can deny benefits. its all a game to them 🤡

Their whole system is designed to be as confusing as possible so people give up. Change my mind.

As someone who used to work adjacent to state agencies, it's not malice, it's incompetence. The IT systems are from the stone age and nobody knows how to update them properly.

It's honestly shameful how NY unemployment just changes these rules with ZERO communication. I've had sooo many issues with them over the past year. For anyone who needs to actually talk to a human being at NYSDOL, I've had success with claimyr.com - it was the only way I could talk to a live agent after weeks of trying. They wait on hold for you and then connect you when someone answers.

How long did it take to get someone on the phone using that service?

Same day for me! It was maybe 2-3 hours from when I signed up until I got the call that they had an agent on the line. WAY better than the weeks I spent trying on my own.

Here's the official info I found on the NY DOL site: "Effective March 2023, the part-time work reporting thresholds were adjusted to better accommodate workers seeking part-time employment while receiving benefits. Hours worked per week now correlate to days of work as follows: 0-10 hours equals 0 days worked; 11-20 hours equals 1 day worked; 21-30 hours equals 2 days worked; 31-40 hours equals 3 days worked; and 41+ hours equals 4 days worked." Hope that helps clear things up!

Can you share the link to where you found this? I want to save it for my records.

It's in the updated UI handbook on their website under the "Reporting Part-Time Work" section. Just Google "NY unemployment handbook 2023" and it should come up.

Not to hijack your thread but I've been having the WORST experience with ny unemployment. My account got hacked and someone changed my direct deposit info. Been trying to reach them for 3 weeks with no luck. Has anyone successfully gotten through to them lately? I'm desperate.

I was in the exact same situation last month! I finally got through by using claimyr.com - they have an automated system that waits on hold and calls you when an agent picks up. It was a lifesaver.

Thank you!! Going to try this right now. I'm at my wits end with this whole situation.

You can also try calling right when they open at 8am. That's how I got through, but it still took like 20 attempts.

Does anyone know if these new hour ranges also apply to PTO hours? Like if I use 8 hours of PTO from my new part-time job, is that still 0 days now?

0 coins

-

Kelsey Hawkins

Yes, PTO counts as hours worked so it would fall under the same ranges. 8 hours of PTO would be 0 days under the new system.
