Tax preparer refusing to give me my refund check until I provide new copies of children's SS cards - is this legal?

I went to a tax preparation service in April to file my 2023 taxes as a single parent with 2 dependents. They completed everything and my refund was approved for about $6,400. The check was sent to their office (I now realize this was my first mistake). When I went to pick it up yesterday, they refused to give me MY CHECK claiming they need 'clearer' copies of my kids' social security cards. The thing is, I already provided copies when I initially filed! They're saying the copies I gave them are 'too blurry' and now they want brand new ones. I've had to order new cards which will take 2-3 weeks to arrive. Can they legally hold MY refund check hostage like this? I'm beyond angry - that money was going to pay for summer childcare and some overdue bills. What are my options here?

Tax professional here. What they're doing is absolutely NOT legal. The refund check is YOUR money, not theirs. They have no legal right to withhold it regardless of what documentation they claim to need after the fact. The fact that they had your refund sent to their office is concerning, but not uncommon for some preparers. You have several options: 1. Inform them in writing that they are illegally withholding your property and you will report them to the IRS if not resolved immediately 2. Contact the IRS directly at 1-800-829-1040 to report this issue 3. File a complaint with your state's attorney general office 4. If they're an Enrolled Agent, CPA, or other licensed professional, file a complaint with their licensing board Don't wait for the new cards - demand your check immediately. They already filed your taxes with the information they had, so this request makes zero sense.

Lol I get why youd think that, but I promise im just a regular person who was fed up. It seriously works. After being on hold with the IRS for HOURS multiple times and never getting through, this was the only thing that worked for me. I'm an attorney and this is 100% illegal. Your tax refund is your property. At this point, they're essentially stealing from you. Document everything, including dates/times of conversations. Send them a formal demand letter via certified mail giving them 48 hours to release your check. If they don't comply, contact your local police department about theft of property, file complaints with the IRS, FTC, and your state's attorney general. If they're a franchise, contact corporate as well.

It can be both civil and criminal. Conversion of property (wrongfully taking control of someone else's property) is a crime in most jurisdictions. Police may or may not take immediate action, but a police report helps establish documentation for other remedies.

The EXACT same thing happened to me in 2023! My tax lady said she needed "better copies" of my W2 even though she already filed and got my refund ($3,200). I went to the IRS office in person and they handled it - apparently this is a common scam where they're trying to buy time while they use your money. Some even cash the checks themselves! Check if your state has a VITA program for free tax help next year.

former irs employee here. theres absolutely no reason they need NEW ss cards if they already had copies good enough to file with. the return was already accepted and processed by the irs, so clearly the info they had was sufficient. theyre holding your money illegally. call the irs practitioner priority line and report them immediately.

not technically illegal but its definitely a red flag. legit preparers almost always have refunds deposited directly to clients accounts or mailed to their home address. having checks sent to the preparer is a big warning sign.

They might. It depends on your location. My friend had a similar issue last year and the police actually did intervene because it was conversion of property which is criminal. Worth a try at least.

This seems weird. Why would they even need clearer copies AFTER the return was processed and approved? Something doesn't add up here. Are they a reputable company? Maybe they're stalling because they messed something up on your return that could come back to bite them.

I'd go there in person with witnesses and record everything (if legal in your state). Tell them you're reporting them to the IRS, state attorney general, and BBB if they don't hand over your check immediately. Make a scene if necessary. This is YOUR money.

You might want to check if your tax preparer is even authorized/registered with the IRS. Go to irs.gov/tax-professionals/preparer-verification and look them up. If they're not registered, that's another issue altogether and could explain the sketchy behavior.

my aunt works for the irs and she said this is completely illegal. theyre probably using your money for something and stalling. if you signed any kind of agreement or contract with them, review it carefully. but regardless, the refund check in your name is your property and they cannot legally withhold it.

she says to contact the IRS Return Preparer Office directly at 1-855-800-8299 and file a formal complaint. also check if theyre a registered preparer on the irs website. if the check is in your name and they wont give it to you, thats actual theft.

FYI - it's actually better to have refunds direct deposited to your account instead of having checks sent through preparers. Always use your own bank info, never let them handle your money. Good luck getting this resolved.
