IRS took my refund for child tax credit overpayment even though my kids qualify - how to contest this?
So I filed my taxes in June and was expecting a pretty decent refund of around $4,200. I checked the Where's My Refund tool last week and it showed my refund was approved but then immediately said it was being applied to a previous tax debt. I never had any tax debt that I know of! Called IRS today and they told me that my refund was taken because we supposedly got too much from the advance Child Tax Credit payments in 2023, but that makes no sense. We have 3 kids (ages 3, 5, and 9) who lived with us the entire year. Our income for 2023 was about $68,000 so we definitely qualified for the full credit. How is this possible? Has anyone else had their refund snatched for apparently no reason? Do I need to file some kind of appeal? And if I do challenge this, does anyone know how long it might take to actually get my money back? This was supposed to help us catch up on bills and now were completely out of options.

For me it was about 14 days from the call to seeing the deposit. The agent told me there was a clear error in how they recorded my CTC payments (system showed I got 2 payments in August which wasn't possible). They filed some internal correction form while I was on the phone.

This happened to me! The IRS had recorded that I received advance CTC payments for my nephew who I didn't even claim as a dependent. Turned out my sister had claimed him (as she should) but somehow the system got confused. Had to file an amended return and it took FOUR MONTHS to get my money. Start the process asap.

Have you checked your IRS transcript for 2023? That will show exactly what CTC payments they think they sent you. You can get it online at irs.gov/transcripts or request by mail. Also, double check your 2023 tax return - did you correctly report all the advance CTC payments you received on Schedule 8812? If you underreported the advances you received, the IRS will take the difference from your refund.

The IRS site is absolutely terrible. If you find it's not working right, try accessing it very early morning or late night when traffic is lower. Also, Schedule 8812 Line 14f is where you should have listed the total advance CTC you received.

Do you have Letter 4800C? That's what they should have sent explaining why they took your refund. If you never got it, that's a separate problem. Also, did the other parent possibly claim the same kids?

Yeah thats super sketchy then. They're required to send notice before offset. You should file Form 8379 (Injured Spouse) and definitely challenge this. Without proper notice they cant just take your money!

Just a thought - did you get any stimulus money for the kids in 2023? Sometimes people confuse that with the CTC advance payments. Check if maybe the IRS is counting stimulus as CTC advances.

Dealing with the IRS these days is a complete joke. I spent 9 hours on hold across 3 days last month trying to resolve a simpler issue than yours. The letter you recieved should have a specific offset code explaining exactly why they took your refund. What was the specific code? That will tell us what you're dealing with.

That's the thing - I never got a letter! Just checked the refund status tool and boom, it was gone. When I called they just said it was for "advance CTC overpayment" but couldn't give me specifics.

Thats not right at all. By law they have to send you notice before taking your refund. File Form 13911 (Taxpayer Advocate Request) immediately - this sounds like they didnt follow proper procedure.

Call the Child and Dependent Care Credit line at 866-321-4034. They have seperate agents who specificallt deal with this. Regular IRS agents don't have the training for these specific issues and will give you wrong info half the time.

Bingo! That's probably it. The CTC system and the main IRS system don't always sync right away. Check your mail forwarding - some of those checks might still be floating around or got returned to IRS.

This exact same thing happened to me last year. i finally broke down and paid for claimyr.com to get through to a live agent after trying for weeks on my own. the agent found that the system had double-counted my advance payments. she corrected it while i was on the call and my refund was released 10 days later. sometimes you need to talk to a human to fix these system errors.

check if u got a CP14H notice. had this problem (took my whole refund for ctc) and turned out they sent that notice to my old address even tho id updated my info. took 4 months but i got my money back finally 😫

If you used TurboTax or another tax program, double check what you entered for the advance CTC payments. A lot of people enter $0 thinking they're answering "did you get advances" with "no" but the system interprets that as "yes I got advances totaling $0" which causes the exact problem you're describing.

I'm a tax preparer and I've seen this issue multiple times this year. The IRS's record-keeping for the advance CTC payments has been a DISASTER. Most of the time it's because they recorded sending payments that never actually made it to the taxpayer. Request your 2023 Account Transcript ASAP and look for codes 766 with "credit reference number 1401" - these are the advance CTC payments they think they sent you.
