EDD denied claim over employer address error - 6 months no payments and stuck in appeals

I'm at my breaking point with this ridiculous EDD bureaucracy. My claim has been in appeals limbo for almost 6 months over what should have been a 5-minute fix. When I filed in February after my restaurant closed down, I listed the physical restaurant address (where I worked for 7 years) instead of the parent company's headquarters address. That's it. That's the whole reason my claim was denied and sent to appeals. The company completely shut down operations at my location, but apparently I was supposed to magically know to put their corporate office in San Diego instead? I've called EDD at least 30 times trying to explain this simple mistake. I've offered to provide pay stubs, W2s, my termination letter - ANYTHING to prove I worked there. But no, they insist this has to go through a judge now. The appeals hearing keeps getting rescheduled. First April, then June, now it's set for August. Meanwhile, our savings are completely drained, credit cards maxed out, and we're falling behind on mortgage payments. All because of an ADDRESS. Something any competent employee could verify in 30 seconds by looking up the company's corporate filing or, I don't know, CALLING THEM? Has anyone dealt with this kind of bureaucratic nightmare? Any advice for speeding up an appeal or getting someone with actual authority on the phone? At this point, I'm considering contacting my state representative because this is beyond absurd.

OMG this is so typical of EDD! They will deny for ANYTHING they can find. My husband had almost the exact same thing happen except it was because he put his supervisor's name wrong (she got married and changed it). took us 4 months to get it fixed. such a nightmare.

4 months sounds like a dream at this point! Did you end up having to go through the whole appeals process or were you able to fix it another way?

This is unfortunately very common with employer address discrepancies. EDD's system is extremely rigid about matching employer information exactly as it appears in their database. The appeals process is frustratingly slow, but there are two things you can do right now: 1. Contact your local state assembly member or senator's office. They have EDD liaisons who can often cut through red tape. 2. Request an expedited hearing based on financial hardship. Submit Form DE 1000M with documentation of your financial situation (past due bills, eviction notices, etc.) Also, make sure you're still certifying every two weeks even while in appeals. If you win, you'll be paid for all certified weeks.

Thank you! I didn't know about the expedited hearing form. I'll definitely submit that ASAP. And yes, I've been religiously certifying every two weeks just in case. I'll reach out to my assembly member tomorrow.

Have you tried using Claimyr to get through to an EDD rep? It's the only way I was able to actually speak to someone with authority. They get you connected to an EDD rep in minutes instead of spending days redialing. Check out their demo at https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km and their website at claimyr.com. It was totally worth it because the rep I got was able to escalate my issue to a supervisor who actually helped resolve a similar address problem.

I haven't heard of Claimyr before, but at this point I'll try anything. The constant busy signals and disconnections when calling EDD directly are driving me insane. I'll check out that link, thanks!

The EDD system is totally BROKEN!!! They denied my claim 3 different times for 3 differnt reasons and each time it was THEIR MISTAKE not mine!!! I finally got paid after 11 MONTHS. Yes ELEVEN!!! The whole time my family was suffering and EDD didnt care at all. They should all be FIRED!!!!!

11 months??!! omg that's terrifying. how did you survive that long without benefits? did you get backpay at least?

We almost lost our house!!! Had to borrow money from family and max credit cards. Yes they did finally give backpay but the damage was already done to our credit and mental health!!!

I work as an employment counselor and see this issue frequently. Here's what you need to know about employer address discrepancies: 1. EDD cross-references your claim with quarterly wage reports submitted by employers. When addresses don't match, it triggers an automatic investigation for potential fraud. 2. While seemingly minor, these discrepancies are one of the top reasons claims get flagged and delayed. 3. For your appeals hearing: Bring every document showing your employment relationship - W2s, final pay stub, termination notice, and anything showing both addresses (the work location and corporate HQ). 4. Prepare a clear timeline of events and a statement explaining the simple error. 5. Contact the employer and ask them to confirm your employment details directly to EDD. Don't lose hope. The administrative law judges in these cases tend to be much more reasonable than the initial claims processors. They understand these are often just simple mistakes.

This is incredibly helpful advice. Thank you for explaining WHY this is happening - nobody at EDD has bothered to tell me it's a fraud prevention measure. That at least makes some sense, even if the execution is terrible. I'll start gathering all those documents right away for the hearing.

why dont u just call the edd fraud number instead? thats for employer issues i think. or maybe call the employer? they cuold just tell edd ur legit right

The fraud number won't help in this situation since this isn't about reporting fraud - it's about resolving a claim that was incorrectly flagged by EDD's automated system. And unfortunately, once a claim is in the appeals process, most EDD representatives won't touch it - they'll just tell you to wait for your hearing date.

i know exactly how you feel!!! the same thing happened to me last year but it was because i accidentally put the wrong employment end date (put the 17th instead of the 19th). took me forever to get it fixed and we almost got evicted waiting. the whole system is designed to make people give up i swear

That's EXACTLY how it feels - like they're hoping we'll just give up and go away. How did you eventually get yours resolved? Did you have to go through with the whole appeals hearing?

yeah had to do the whole hearing thing. it was actually quick once i finally got in front of the judge - like 15 minutes and he was like "yeah this is obviously a mistake" and approved me. but it was the 5 months WAITING for the hearing that nearly destroyed us

If you're still certifying every two weeks, make sure you're completing the work search requirements correctly. Many people don't realize that even while in appeals, if you don't properly document your work search activities, you can be disqualified from those weeks even if you win your appeal. Keep detailed records of all job applications, contacts with potential employers, networking efforts, etc. The EDD wants to see at least 3 work search activities per week.

I've been keeping a spreadsheet of every job application, follow-up call, and networking event just to be safe. Even though I'm not getting paid, I've been treating the certification process like a part-time job. Good reminder though - would be awful to win the appeal and then lose benefits over something else!

Quick update question - have you checked if you qualify for State Disability Insurance (SDI) or Paid Family Leave while waiting for UI to resolve? Some people don't realize they might qualify for other benefits if they have health issues or caregiving responsibilities. It's separate from unemployment but could provide some temporary relief.

I don't think I'd qualify for SDI since I'm physically able to work, just laid off. And no family leave situations either. I've been taking whatever gig work I can find, but it's nowhere near enough to cover our bills. The crazy thing is I've already found a new full-time job starting next month, so this whole appeal might be for the 6 months of back benefits I'm owed!
