How long for San Diego EDD appeal hearing date after receipt? Waiting since May
Feeling super stressed about how slow my appeal process is going. My EDD disqualification appeal was received by the San Diego appeals office on May 6th (over 6 weeks ago now), but I still haven't gotten any notice about a hearing date. My rent is due next week and I've been counting on these benefits after being laid off from my restaurant management job in March. Has anyone else gone through the appeals process with the San Diego office specifically? How long did it take from when they acknowledged receiving your appeal to actually scheduling a hearing? I've tried calling the appeal office, but I just get a voicemail saying they're experiencing high call volumes. Starting to panic a little...

I went through an EDD appeal with the San Diego office back in February. From when they received my appeal paperwork to getting the hearing notice took almost 9 weeks. The hearing itself was scheduled for 3 weeks after that. So all in, it was about 12 weeks from appeal receipt to actual hearing date. Unfortunately, they're seriously backlogged right now. The judge at my hearing mentioned they're handling about 3x the normal volume of appeals because of all the overpayment issues coming up from the pandemic period. Hang in there!

•9 weeks?! Ugh, that's even longer than I was afraid of. Did they backdate your payments once you won your appeal? I'm trying to figure out how to make it through financially until then.

•This is why the system is broken! 3-4 months for an appeal while your bills keep coming?? How are people supposed to survive when EDD takes forever just to schedule a hearing? I'm beyond frustrated with how they treat us like we don't matter. Had the same experience with my SDI claim last year - different benefit but same nightmare bureaucracy.

I had my appeal in San Diego last fall, and I found a way to actually reach someone about my status. I used a service called Claimyr (claimyr.com) that got me through to an actual EDD agent who was able to look up my appeal status and give me better information than the automated system. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km After I got through, the agent told me my hearing was actually already scheduled but the notice had been sent to my old address! I was able to get the info and make it to my hearing on time. Might be worth checking if there's any update on your case.

•It worked for me. Not saying it's magic or anything, but I literally couldn't get through for weeks before trying it. The agent I spoke with actually found out my hearing notice had been mailed to my old address even though I updated my contact info online.

I just went through this EXACT situation with the San Diego appeals office!! My timeline was: appeal received April 2, hearing notice arrived June 17 (about 11 weeks), and my hearing was scheduled for July 8. The judge was actually really fair and I won my appeal. The appeals board is overwhelmed right now because of all the overpayment cases. One thing I recommend is making sure you have ALL your evidence organized before the hearing. They only give you about 30 minutes, and having everything ready to reference made a huge difference for me. When you do get your hearing date, make sure you submit any supporting documents through their online portal at least 5 days before - the judge mentioned he really appreciated that I did that so he could review everything beforehand.

•Thank you SO MUCH for the tips!! This is super helpful. What kind of evidence did you have prepared? My disqualification was because they said I didn't respond to an eligibility interview request, but I never received any notice about it until the disqualification letter came.

I just don't understand how EDD expects people to survive while waiting MONTHS for appeal hearings! It's completely UNACCEPTABLE!! I had to wait 14 weeks for my hearing in San Diego last year and almost lost my apartment. The system is DELIBERATELY designed to make people give up. And don't get me started on their phone system - it's like they don't WANT you to talk to anyone. Then they act like WE did something wrong when THEY made the mistake!!

•fr its like they hope if they make it hard enough people will just give up and not get the money they deserve

Just to add something important - while you're waiting for your appeal hearing, make sure you KEEP CERTIFYING for benefits every two weeks. If you win your appeal, they can only pay you for weeks you properly certified for, even if you were eligible. A lot of people make the mistake of stopping certification during the appeal process, but you should definitely continue.

•Oh wow, I didn't realize this! I've still been certifying but was wondering if it was pointless. Thanks for the tip - at least I know I'm doing something right.

My friend had to wait almost 3 months for his appeal hearing date after they got his paperwork. This was back in January though so maybe they're faster now? He ended up having to borrow money from family to get by until it was resolved. The whole system is such a mess.

Quick update to what I said earlier - I just remembered something that might help you. When you do get your hearing notice, it'll come with instructions for requesting an expedited hearing due to financial hardship. If you can document that you're at risk of eviction or utility shutoff, they might be able to move you up in the queue. I didn't qualify for this since I was staying with family, but the judge mentioned they do prioritize these cases when possible.

•That's incredibly helpful information - thank you! I definitely qualify for financial hardship consideration. I'll keep an eye out for that option when I get my notice.
