How long until EDD schedules UI appeal hearing? Been waiting 4 weeks already

I got disqualified from my unemployment benefits last month because my former employer claimed I was fired for misconduct (totally not true - I was laid off due to downsizing). Anyway, I filed my appeal right away on April 7th, 2025 and received the acknowledgment letter about a week later. It's been almost 4 weeks now and I still haven't received any notification about a hearing date. The stress is killing me since my savings are running really low. How long does it typically take for EDD to schedule these appeal hearings? Is there anything I can do to speed up the process? I check my mail obsessively every day hoping for that letter!

The current wait time for an appeal hearing is about 6-8 weeks from when you file, unfortunately. It can sometimes take longer if they're backlogged. Make sure you continue to certify for benefits every two weeks even while waiting for your appeal - if you win, you'll get all those back payments. The letter will come from the California Unemployment Insurance Appeals Board (CUIAB), not directly from EDD, so look out for that in your mail.

Thank you for the info! Should I be doing anything to prepare while I wait? I'm so nervous about the hearing and worried I'll mess it up somehow. And yes, I've been certifying every two weeks even though it shows $0 for payments.

OMG I WENT THROUGH THIS EXACT THING!!! My ex-boss said i was "negligent" which was COMPLETE BS. took me 9 WEEKS to get a hearing date!! and then another 3 weeks till the actual hearing. keep certifying every week and document EVERYTHING. the waiting is the WORST part i feel ur pain

YES I WON!! Just make sure you have all your docs ready and practice what you're gonna say. The judge was actually pretty nice and let me explain everything. My employer didn't even show up lol. Got all my backpay after like 2 weeks!

I had to appeal last year after my seasonal job ended and they somehow marked it as a voluntary quit. The whole process from filing the appeal to actually having the hearing was about 7 weeks for me. But I've heard they're processing things faster now in 2025. BTW when you do get your hearing notice, it'll probably be a phone hearing unless you specifically request in-person.

Good to know about the phone hearing - that actually makes me feel a bit better. Did you have any documentation ready for your hearing? I saved some emails that show the company was downsizing.

Yes! Definitely have those emails ready! The judge asked me for proof, and I had text messages from my supervisor acknowledging the seasonal nature of the position. Having documentation is super important. If you have any coworkers who were laid off at the same time, their statements could help too.

Have you tried calling EDD to check the status of your appeal? Getting through to them is nearly impossible with regular methods, but I used Claimyr last month when I had issues with my certifications and it worked great. They got me connected to an actual EDD representative in about 20 minutes. Their website is claimyr.com and they have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km. Might be worth trying to see if they can give you any updates on your appeal status.

It worked for me! I was skeptical too but after trying to call for days with no luck, I gave it a shot. Got connected to a rep who was able to give me specific info about my claim that I couldn't see online.

Thanks for the suggestion. I'll check out that service. I've been trying to call EDD directly and it's been impossible to get through. Even if they can't speed things up, at least I might get some peace of mind knowing where I stand in the queue.

Appeal hearing scheduling is currently taking 6-8 weeks on average, but can vary based on your local office's caseload. While waiting: 1. Continue certifying for benefits every two weeks 2. Gather evidence supporting your case (emails about layoffs, performance reviews, witness statements) 3. Review the appeal guide on the CUIAB website 4. Keep your contact information updated with EDD Call the Appeals Board directly at 916-263-6589 for status updates (separate from regular EDD). Once scheduled, hearings typically occur within 2-3 weeks of notification. You'll receive instructions with your hearing notice about submitting evidence. Start organizing your documents now.

This is SUPER helpful, thank you! I didn't know there was a separate number for the Appeals Board. I'm going to call them tomorrow. I've started gathering emails and performance reviews. Should I also write down a timeline of events or prepare some kind of statement?

Yes, absolutely prepare a timeline! Administrative Law Judges appreciate organized presentations. Create a chronological list of key events leading to your separation. Also prepare a brief opening statement (2-3 minutes) explaining why you believe you qualify for benefits. Practice explaining your situation concisely, as hearings typically last 30-45 minutes. If your employer claimed misconduct, be ready to address those specific allegations point-by-point.

🤣 I doubt calling every day works but I get the desperation! I tried that and just got more frustrated when I couldn't even get through!

Just to add to what others have said, when you do get your hearing notice, read it carefully. It will tell you exactly what issues will be discussed during the hearing. This is important because you need to prepare specifically for those issues. If the notice says they're determining if you were discharged for misconduct, your preparation will be different than if they're determining if you were laid off due to lack of work. Also, if you have any witnesses, you'll need to arrange for them to be available during your hearing time. The notice will explain how to do this. Good luck with your appeal!

Thank you for the additional info! The disqualification letter did say it was for misconduct, so I'm preparing to show that I was actually laid off due to downsizing. I've requested my personnel file from HR to see if there's anything helpful in there too.
