EDD Appeal Letter Received - How Long Until I Get Hearing Date?

I just got an appeal letter in the mail from EDD after being disqualified from benefits. This is my first time going through the appeals process and I'm super nervous about it. The letter acknowledges they received my appeal request, but doesn't give me any date or time for when the actual hearing will take place. Has anyone gone through this before? How long did it take for you to get notified of your actual hearing date and time? I'm stressing out because my savings are almost gone and I need to plan ahead if this is going to take months...

I went through an appeal last year. After I got that first letter acknowledging my appeal request, it took about 4-5 weeks before I received another letter with the actual hearing date and time. My hearing was scheduled for about 3 weeks after I got that second letter. So all in all, about 2 months from when I filed my appeal to when the actual hearing happened. The letter should mention that they'll send you the hearing notification at least 10 days before the hearing date, so you'll have some time to prepare.

Thank you so much for sharing your timeline! 2 months sounds like a really long wait... Did they backpay you for the weeks you were waiting once you won your appeal?

mine took almost 3 months to get the hearing date!!! the system is completely broken right now. i filed my appeal in march and didnt get a hearing until june. its ridiculous!

3 MONTHS?? That's insane! Did they give you any explanation for why it took so long?

nope they just said they have a backlog. i was fuming but nothing you can do except wait

I had an appeal hearing in January. The wait time varies DRASTICALLY depending on your local office workload. Some people get hearing dates in 3-4 weeks, others wait 3+ months. It's COMPLETELY unpredictable! While you wait, make sure you're still certifying for benefits every two weeks even though you won't get paid until after a successful appeal. If you stop certifying, they'll consider your claim abandoned!!! Also gather ALL documentation that supports your case - pay stubs, emails with your employer, termination notice, etc. You'll need everything ready when you finally get that date.

Thanks for the tip about continuing to certify! I wasn't doing that because I figured what's the point if I'm disqualified. I'll start doing that right away. I'm worried I've already missed a few certification periods though...

The appeals process timeline typically works like this: 1. You file your appeal (sounds like you've done this) 2. You receive acknowledgment letter (which you have) 3. You wait for the hearing notice (where you are now) 4. You attend the hearing 5. You receive the decision (usually 1-2 weeks after hearing) Right now, EDD is taking anywhere from 4-12 weeks to schedule hearings after acknowledging receipt of appeals. This varies by office and how backlogged they are. The law requires them to give you at least 10 days notice before your hearing date. While waiting, make sure you: - Continue certifying for all weeks (even though payments are blocked) - Prepare your evidence (any documents supporting your case) - Consider what witnesses might help your case The hearing will likely be conducted by phone in 2025, though some in-person hearings are resuming.

Thank you for breaking it down so clearly! Do you know if I need to hire a lawyer for this? I'm worried about saying the wrong thing and messing up my case.

You don't need to hire a lawyer for an EDD appeal hearing, though you can if you want. Many people successfully represent themselves. The Administrative Law Judge (ALJ) will guide you through the process and ask questions. Be honest, stick to the facts, and explain your situation clearly. If your disqualification was due to a simple misunderstanding or paperwork error, these are often resolved without legal representation.

Have you tried calling EDD to ask about your appeal status? I know getting through to them is nearly impossible with their regular phone lines, but I found this service called Claimyr that got me connected to an EDD representative in about 20 minutes. I was in the same boat waiting for my appeal hearing date and was able to get more information about the timeline. Their website is claimyr.com and they have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km The EDD rep I spoke with was able to tell me approximately when to expect my hearing date letter and confirmed they had all my documents on file. Gave me some peace of mind instead of just waiting in the dark.

I hadn't heard of this service before. I've been trying to call EDD for days with no luck, just constant busy signals. I might check this out - did they actually give you specific information about your case?

Yes, they did! The EDD rep was able to see that my appeal was in the queue for scheduling and gave me a rough timeframe of when to expect the hearing notice. They also confirmed they had received all my documentation. It was definitely worth it to get actual information instead of just wondering and stressing.

That's encouraging that you won your case! Do you have any tips for the actual hearing? I'm really nervous about what to say and how formal it is.

I'm actually going through this exact same thing right now! Filed my appeal in May, got the acknowledgment letter two weeks ago, and I'm STILL waiting for the hearing date. The most FRUSTRATING part is being in limbo and not knowing if I should be looking for other income sources or if I'll get my benefits soon. I've been certifying every two weeks like clockwork even though nothing is being paid out. I've had to borrow money from family just to make rent. The system is COMPLETELY broken!

It's comforting to know I'm not alone, though I wish neither of us were in this situation. Please update here if you get your hearing date soon? I'd love to know what kind of timeline to expect.

I definitely will! This waiting game is the WORST part. I check my mail obsessively every day hoping for that letter. I've started doing food delivery gigs just to have some income while I wait. It's not much but it helps with groceries at least.

One more important tip: if you haven't already, make copies of all your appeal paperwork and keep a log of all communications with EDD. Note the dates you received letters and what they said. For your hearing, prepare a simple timeline of events related to your claim and disqualification. Judges appreciate organization and clear presentation of facts. Also, if your hearing is by phone, find a quiet place with good reception and no distractions. Have all your documents readily available so you're not shuffling papers during the call.

This is really helpful advice. I'll start putting together a timeline tonight. I think the biggest challenge will be proving that I did submit my work search activities since it was all done online. I hope they can see that in their system.

Just to give you some hope - I won my appeal after waiting about 8 weeks for the hearing. Once the decision was made in my favor, I received all my backpay for the weeks I had been certifying during the wait within 3 business days. It was a huge relief. The judge was very fair and listened carefully to my explanation. As long as you have documentation and tell the truth, you have a good chance, especially for work search related disqualifications which are often misunderstandings.

Thank you for sharing your positive outcome! That gives me some hope. I've been diligent about my work search and have documentation of everything, so hopefully the judge will see that there was just a misunderstanding.
